NEAR LA JOYA — A Texas Department of Public Safety sharpshooter opened fire on an evading vehicle loaded with suspected illegal immigrants, leaving at least two people dead, sources familiar with the investigation said.

DPS spokeswoman Katherine Cesinger confirmed a DPS officer opened fire during the pursuit north of La Joya, but had no information as to whether the officer shot anyone inside the evading vehicle.

“We do not want to speculate on any other issues at this time and have no further information,” Cesinger said in the email.

However, law enforcement sources said troopers found three people shot inside once the smuggler’s vehicle stopped along Farm-to-Market Road 2221 near Mile 7 Road. Two of the suspected illegal immigrants died from their injuries, they said.

“This is going to get big really, really fast,” a local law enforcement official said of the DPS incident. “You have a law enforcement official shooting at an unarmed alien. This is not an excuse for deadly force.”

Cesinger confirmed two people were dead. She said a third person was sent to an area hospital for treatment, while six others were arrested.

When asked if he was aware of two illegal aliens being shot by DPS in Hidalgo County, DPS Director Steven McCraw responded:

“Of course I am aware of this situation.”

He declined to comment further and directed further contact to the DPS press office. He also said he was currently out of the state.

Authorities were still searching for others who fled the scene on Thursday night, Cesinger said.

The pursuit began after a Texas Parks and Wildlife Department game warden tried to pull over a vehicle suspected of smuggling immigrants Thursday afternoon along FM 2221.

A DPS helicopter was called in to assist in the pursuit and a sharpshooter opened fire on the evading vehicle — a policy permitted by the agency, two law enforcement sources not authorized to comment on the investigation said.

DPS troopers are the only law enforcement in the Rio Grande Valley region permitted to open fire during chases.

Various agencies — Border Patrol, La Joya police, Hidalgo County Sheriff’s Office — were present at the desolate, rural area alongside DPS well into the night. Authorities set up blockades at least a mile out from the scene.

After dark, a red pickup truck with no apparent damage — except a blown, rear driver’s-side tire — was towed away from the area where police were working.

The Texas Rangers are investigating the incident.

“During the pursuit, the vehicle appeared to have a typical ‘covered' drug load in the bed of the truck,” Vinger said. “DPS aircraft joined the pursuit of the suspected drug load, which was traveling at reckless speeds, endangering the public. A DPS trooper discharged his firearm from the helicopter to disable the vehicle.”

In an interview this summer, DPS Director Steve McCraw said it is imperative to protect troopers on the ground when patrolling the border.

“That's what our aerial assets are doing, and we need to protect those aerial assets and in doing so, we put a sniper on those,” he said of armed helicopter agents. “And we're really not apologetic about it. We've got an obligation to protect our men and women when we're trying to protect Texas.”...

Almost every DPS helicopter on patrol is manned by a tactical flight officer, who operates surveillance equipment and is trained to use the AR-10 rifle stored in the chopper.

According to DPS policy, lethal force is can be used when the officer or someone else is at “substantial risk of death or bodily injury.”

Troopers can fire at vehicles when deadly force is justified or it's “for the sole purpose and intent of disabling a vehicle.”...

Hidalgo County consistently has more highway patrol pursuits than any other in Texas, according to data from DPS. Smugglers along the border often use blocking vehicles and homemade road spikes to evade pursuit.

In response, DPS has hired more troopers, deployed more helicopters and purchased high-speed boats equipped with machine guns.

“We can't give up swaths of land to organized thugs and criminals,” DPS Director McCraw said recently. “It doesn't matter if it's a remote area or if it's a highly urban area.”

He said agents apply the same principles regarding use of force for land, air or water operations.

“Some of these pursuits, they're desperate, they don't really care if they run over innocent citizens, bystanders, they have no qualms,” he said. “At the end of the day they're concerned about getting back to the river or protecting their drug load or, in some cases, their human trafficking load.”

If this were a war zone I would agree. If this were Korea or Vietnam or Afghanistan I could understand.

This is south Texas. I can not understand. Steve McCraw needs to go NOW RIGHT FUCKING NOW!!!!!

Thank God that helicopter did no encounter sudden turbulence causing the sniper to misfire through no fault of his own into his fellow troopers.

THANK GOD THE PEOPLE THEY WERE SHOOTING AT DID NOT HAVE GUNS OF THEIR OWN TO FIRE BACK AT THE HELICOPTER! In fact they fired no shots at police.

Putting a sniper on a chopper is about killing folks not protecting folks. What happens when they get it wrong? What happens when they kill US citizens that have not fired upon them for the high crime of running away?
