For all his "strategy" this guy ended up being ticketed.

Frankly, he was lucky. Some other motorists who have refused to roll down their windows or talk to cops have been arrested and charged with (and convicted for) obstructing police operations or something similar.

Bullshit, Shoo. This man did absolutely nothing wrong, never mind "obstructing police business." Had he appeared intoxicated, you'd have a point, but he doesn't, so bravo to this citizen.

As usual, you don't know what you are talking about. The man did nothing wrong. You don't have to talk to the police. You have to identify yourself, but that's it.

Are you under the impression that he was trying to avoid a ticket? Geez.

I have used this response with success: "Officer, are you under the impression that I Do Not have the right to remain silent?"

That's a great video, Lod. I applaud that man for sticking it to that cop. In Oct of 2000, I was riding my bike home from work one afternoon when a cop pulled me over and wanted to cite me for wearing earphones. I was listening to my walkman as a means to deter driverby harassers. Anyways, this cop demanded identification. I told him I had none. He told me to sign the ticket or else he was going to take me jail. So guess what I did to that ticket, I signed it, "I am signing this ticket under duress and I do not waive any of my constitutional rights." He looked at the ticket, gave me my portion and took off. A few weeks later, I showed up in court to contest this damn ticket and explained to the judge why I had my headphones on. The cop who pulled me over was present. The judge dismissed the ticket charge. I guess the cop lost his commission for that one. :(

In California, tickets like these are called "Infractions" which help generate revenue for the city of L.A. All of this shit happens in Malibu at these speed traps along the way.

You should have signed a fake name and saved yourself a trip to the court.

Not after they take your fingerprint. That's why I signed "under duress". That way they can't accuse me of evading a court appearance and put a bench warrant out for my arrest. But I sure as hell can contest a bogus ticket that this cop was hustling me up on. I was not even riding on the street but on the sidewalk. And there is no law out there that prohibits riding bikes on sidewalks.

Ummm.......unless you've had a more serious run-in with the law in the past your fingerprint should be worthless??

Nope not at all. The problem is this cop was harassing me and obviously had been following me just about every day that I went to and from work. When he finally pulled me over threatening me with jail simply because I had no id on me I just simply played it cool and showed the court what an asshole he is. As he was taking my fingerprint, I was documenting his badge number. There is no law in the State of California that requires one to carry id. Never has been. That's the point. He didn't like the fact that I had no id on me and therefore, he threatened to take me to jail if I did not give a fingerprint. So, I challenged both the ticket and the fingerprint issue and even referenced the cops badge number. The court threw them both out claiming the officers actions were not appropriate.

Believe me, when I left, shortly after, the Governor of California was begging American citizens to stay in California.

Why???

Well, he must have known my route. I never drove on the road because of the assholes who cut cyclists off so I always drove on the sidewalk. And of course, I had on my headphones. I can understand it if I was riding on the road with my headphones on. That would warrant the cop's actions to issue me the ticket. But not when I'm riding on the sidewalk.

Different set of circumstances. Whether contrived or not the officer involved asserted probable cause to suspect the operator of the MV was intoxicated and thus operating a vehicle under the influence.

The stop was made at night not during daylight.

The proceedings issued from Indiana State law and one cannot presume a uniformity of law from state to state.

The circumstances and facts were both different.

There was no need in this stop for the person being stopped to roll down his window all the way nor to answer the cop's questions. His assertion of 4th Amendment rights was right and proper and, as evidenced by the Officer's eventual acquiescence, correct. There was no probable cause, other than pique, to take the driver into unlawful custody.

Trooper Maughmer testified that when appellant looked through the window, his eyes were bloodshot and glassy. When the window was cracked, Trooper Maughmer could smell a strong odor of alcohol coming from appellant's breath as he spoke.

Here is the key difference between the cases.

Coming from the Valley (North from Malibu) just as you pass Pepperdine University on the way over to Ralph's market heading towards PCH.

Muholland Highway and Las Virgenes Road (in this area)

Malibu Canyon Road and Civic Center Way (and this area)

My friend and I often would get stopped by a cop because they would assume he was speeding when there was no traffic light or speed limit posted. In fact, many people have complained about those speed traps. The cops hide in some area that prevents them from being seen by motorists. They are not supposed to be hiding but are supposed to be in plain view.

"Where are the speed traps....?"

"Mulholland Highway and Las Virgenes.....Malibu Canyon Road and Civic Center Way...."

Thanks for that, especially about the one near Mulholland and Las Virgenes. We spend a lot of time between Mulholland and PCH because there are hundreds of miles of hiking trails there. Coming from the Valley, they're usually accessed via Topanga or Malibu Cyn. Ordinarily, we don't need to drive by Ralph's, but my roommate takes her recycling junk there.

I don't know if you remember the place or not, but at the top of Topanga, at the place that more or less separates Topanga Cyn from the Valley, there's a scenic overlook. In the olden days it was just a remote, flat dirt area where people could dump bodies over the side and kids went to make out in their cars. Now there's a paved parking lot, landscaping and a hidden camera there. If you don't make a complete stop before you pull out of the parking lot to get back on Topanga, they'll send you a ticket in the mail. It's probably a great source of revenue because nobody is expecting that way out there.

You're welcome. I am well familiar with Topanga Canyon Road. Or rather, its Old Topanga Canyon Road. I used to travel along that way to the restaurant "Inn of Seven Rays". Such a beautiful restaurant. This place and The Castaway restaurant in Burbank and Musso and Franks restaurant in Hollywood were my favorites.

Just be especially on guard of those parking lots, driveways, because that's where those cops like to hide. What they are going is against the law. They need to be seen in plain view. Especially when they have their radar guns on every car that passes by them. When my friend got ticketed by the cops, it amounted to $120.00. He was furious and contested that ticket in Malibu court with an affidavit explaining why he felt the cop was wrong. My buddy prevailed because a number of people have complained about those areas in question.
