Arlen Specter (R-PA) is circulating a draft immigration bill for the purpose, he says, of encouraging discussion. NumbersUSA has prepared the following analysis of this draft. While the Specter proposal has many strong enforcement provisions, including mandatory employment eligibility verification through the Basic Pilot program, the benefits to the American people would be far outweighed by the proposals massive increase in immigration and foreign worker importation. This analysis provides an overview only of the parts of the proposal that address amnesty, guest workers, and legal, permanent immigration levels; it does not cover the sections of the proposal dealing with enforcement. Almost all of the enforcement provisions in the Specter proposal are identical to those in Sen. Cornyns S. 1438, as examined in this section-by-section analysis. The Specter proposal copies the five-year exit amnesty in the Cornyn bill with one big exception: he forgot about the exit part. Specter would allow all illegal aliens to apply to adjust either to the H-5A status described below or to legal permanent residence. As is noted below, the number of illegal aliens who adjust to H-5A status does not count toward the cap on H-5A visas. Essentially, then, the time it takes an illegal alien to obtain legal permanent residence and then citizenship depends only on how long it takes him to find an employer willing to file a petition. Those illegal aliens who failed to apply for adjustment of status would have to leave the United States within five years. The New Worker Importation Program: The Specter proposal would create a new H-5A nonimmigrant visa for any foreign worker who does not qualify for an H-1B visa (skilled, specialty occupation workers), an H-2A visa (agricultural workers), an L visa (intra-company transferees, i.e., workers at corporations with U.S. subsidiaries), or an O, P, or R visa (aliens with extraordinary ability in science, arts, education, business, or athletics; internationally recognized athletes; artists and entertainers; and religious workers). In order to qualify for an H-5A visa, an alien must have a job offer from a U.S. employer, be capable of performing the work, have a medical exam, and pay a fee of $500, plus the normal visa-processing fee. Almost all non-criminal and non-terrorist grounds of inadmissibility for conduct that occurred prior to the date of enactment of the planincluding illegal entry, misrepresentation, and use of false documentscould be waived for an additional fee of $1,500. Qualifying aliens would be admitted for three years and could renew their visas for one additional three-year period. The alien would be prohibited from renewing his H-5A visa if he willfully violated a material term of his original visa. H-5A workers would have the right to change jobs as desired. (This would open the program up to workers of every skill level. High-tech workers, for example, could get an offer from a U.S. employer for a qualifying unskilled job and then take a high-tech job immediately upon entry.) Employers would be required to pay no more than the minimum wage for H-5A workers, except that they would have to provide the same wages, benefits, and working conditions to U.S. workers who are similarly employed in the same occupation and the same place of employment. The Specter proposal uses the same approach as the McCain/Kennedy amnesty bill to set the numerical limitations of this new worker importation program. The initial cap on H-5A visas would be 400,000, with subsequent caps to be determined by U.S. employers appetite for cheap labor. If employers reached the cap in the first quarter of any year, the cap for that same year and the following year would automatically increase by 20 percent. If the cap were reached in the second quarter of a year, that years and the following years cap would increase by 15 percent. Hitting the cap in the third quarter would result in a 10 percent increase in both years, but hitting the cap in the fourth quarter would only increase the next years cap, not the current years, by 10 percent. If employers did not use all the available visas in any year except the first year of the program, the cap for the following year would decrease by 10 percent. Formerly illegal alien workers who adjust to H-5A status would not count toward this cap, and so could raise the total number of H-5A workers into the millions. Expanded H-1B Worker Importation Program: In addition, the Specter proposal would exempt from the H-1B cap any alien with an advanced degree in science, technology, engineering, or math from an accredited U.S. university. The Specter proposal would dramatically increase legal, permanent immigration levels. It would do this directly by increasing current caps and indirectly by exempting large groups of aliens from the caps. Their cultural dilution plans are going to be put in place, count on it. It will be interesting to watch it all come to pass. I hoped I would be out at sea when it all went down but I don't see that happening.
