Title: Jenifer Tharp And Jack Carter Must be brought up on charges

In case you do not know Jenifer Tharp is a DA in Comal County. Jack Robinson is a judge in a district presiding over comal. Both are guilty of depriving Justin Carter his right to liberty.

Both over stepped their authority and used their power of office to commit the worst crime the state can commit short of murder.... and some of us would argue that death might be preferable to their second worst crime. That is the theft of an innocent mans freedom. Better that 100 guilty men go free than one innocent man be incarcerated.

Justin Carter is innocent. It is clearly obvious. Jenifer Tharp and Jack Robinson either do not care about the clear letter and intent of the law ... or they are ignorant of it. Either way their actions have resulted in making a victim of one of the citizens.

They need to be brought up on charges for their part in depriving an innocent citizen of liberty.

This needs to happen lest the system feel empowered to do this again.

We want to fight tyranny? Getting these two criminals charged and arrested for their crimes would be an awesome blow to the comal county corruption.

Getting these two criminals charged and arrested for their crimes would be an awesome blow to the comal county corruption.

This sounds as if it is in California. Sorry, but I do not know much about any of this. It does sound as if these two are corrupt as the day is long. ;)

This is to say nothing of the lack of passports. The US is a closed nation now.. One needs a passport to exit/enter. (UNless one is running the border but thats not here nor there) That family didn't have 50,000 ... they had no means to flee. It was punitive of the judge and wrong to pick up the case in the first place.....

We can not bring the original Canadian that started this to justice. They are a foreigner belonging to another government with a different justice system.

But everyone here on this side of the border needs to be brought down from their offices of authority lest they incarcerate and prosecute other innocent people.

This sounds as if it is in California. Sorry, but I do not know much about any of this. It does sound as if these two are corrupt as the day is long. ;)

Comal County actully has a big problem with corruption. The scooter store is Hqed here and the judges involved... all four of them recused themselves over presiding over the scooter store case... And the sheriffs protect them... and the city council are in bed with them... and we are working , some of us are working very hard to reverse this tide of tyranny , these amoral criminals occupying and perverting civil offices of government. And those folks that are working to stem the tide of tyranny could use all the support you can pay attention too ;)

Carter Bails Out

Lots of big news this week, most of it legal in nature, and only some of it good. We'll start there, with the release of Justin Carter, the 19-year-old held at the Comal County Jail for the last five months on a $500,000 bond on charges of intending to, per Texas Penal Code, 2207, Section A, Subsections 4 and 5:

cause impairment or interruption of public communications, public transportation, public water, gas, or power supply or other public service;

and

place the public or a substantial group of the public in fear of serious bodily injury;

for comments he made in a conversation between gamers on Facebook. In case you missed it, here as much as we have of said conversation, based on the Grand Jury indictment and conversations with Carter's camp:

Unknown Facebook User: “You're f##ked in the head!"

Carter: “Oh, yeah, I'm f##ked in head alright. I think I'ma shoot up a kindergarten. And watch the blood of the innocent rain down. And eat the beating heart of one of them. LOL. JK."

NB Teenage Girl (Name Withheld): “i hope you f##king bring in hell you f##king prick."

Teenagers.

Anyway, an anonymous benefactor came forward last week with cash in their proverbial hand to bail Carter out - and to be clear, they didn't spend $50,000 to obtain a bail bond, they actually handed the court a half-million dollars, because they're fairly certain Carter won't make a run for the border.

We covered the story in detail in last week's column, which you can read at your leisure at txcitizen.com. Right now we'd like to see if a San Antonio newsroom gets slapped with an indictment for the same crime Carter was jailed for - namely, intending to scare the hell out of the local populace - by falsely claiming that Carter made threats to "shoot a New Braunfels kindergarten class on Facebook".

As you saw in the conversation above, he did say "a kindergarten". He did not say "a New Braunfels kindergarten". And yes, specific information like that does make a difference in the way people react to these things. A huge difference, in fact, and KSAT enjoyed the extra bump one gets from exploiting that kind of thing. So if we're talking intent to "place the public or a substantial group of the public in fear of serious bodily injury", KSAT seems to be in the ballpark, since they paired that statement with the announcement of his release from jail.

You hear "Death to America" all of the time from a variety of groups, and most of the time it's just background noise. But consider how much your interest/anxiety level rose when Kim Jong-un said he was going to nuke Austin. Even my jaded ears perked up a bit with that one. And so it is with Carter. He made a general statement, and at the time he made it, law enforcement thought he lived in, and was therefore a threat to, Austin. But it took KSAT to make it sound like he specifically threatened New Braunfels. Five months after the fact.

Justin Carter will appear before Judge Jack Robison on Monday, August 12, for pre-trial motions. Carter's attorney, Don Flannery, plans to move to dismiss the charges on the grounds that the State's terrorist-threat statute was unconstitutionally applied to Carter. Expect more national attention on Comal County throughout the proceedings, as the case has serious and far-reaching First Amendment ramifications.

Our prediction: A loss for the County, followed by a massive lawsuit for the oppressive bail amount and gods know what else

Thank you for posting that authentic frontier gibberish, I like the paper. I concur with their postmortem of the Trayvon killing and the trail that followed.

While passion is an admirable quality you seem to have no concept of the intent or legal limits of "free speech". I cannot do that research for you. You have the freedom to say alot with-in the legal limits, (whether I agree with them or not) that does not protect you from the consequences of actions (speech). Your Mom may ask you to move out, your girlfriends Dad may forbid her seeing you anymore, your boss may pass you over for a promotion (or find some other excuse to fire you), your clients may take their business elsewhere.

While I admire and practice the concept of "truth to power" I also realize the wisdom of one of Ron Whites funniest lines stating "he had the right, but not the ability to remain silent." The world is full of injustice and our Constitution, as written, was meant to protect the rights of the least of us (the individual) providing for due process, due process is to protect the rest of us from the worst of us. I don't make the laws, I don't live by the laws, I don't put myself in positions to have to deal with lawyers.

Betting on longshots is a tremendous rush when they win, which is a rare occurrence, rarely does the risk, credibility, money, emotional stress expended payout sufficient odds. Years ago I changed my practice from betting on the underdog to rooting for the underdog, there is a big difference.

My prediction for Justin's case is: Best case he is found not guilty (this will not happen with a public defender) at trial after spending 5 months in jail and paying god only knows how much in legal fees, a civil trial in which the defense prevails leaving Justin's sponsors stuck with even more legal fees. More likely a plea or settlement which will require years of treatment or supervision paid for by the defendant and no civil case. My prediction isn't based on justice it is based on odds. I don't have enough information to form an opinion based on justice.

So many poor choices, so little time.
