My friend's nephew was the 16 yr old passenger in this fatal wreck. The driver was drunk and illegal and gave authorities false info including his name. Here's the story and please pray for this family, they are suffering greatly. It's sad that there are so many deaths caused by drunk drivers but when the driver is illegal, has no liscense, and no insurance, it's worse. This makes 4 people that I know of killed by drunk illegals in NC in the last few months! When is our government gonna do something?

Driver in fatal wreck arrested

The driver of a vehicle involved in a single-car accident that claimed the life of a 16-year-old Caldwell County teenager last weekend has been arrested by the N.C. Highway Patrol and charged with felony death by vehicle.

Trooper Kevin Milligan served a warrant and arrested Jose Isaias Melgar Soriano when he was released from Wake Forest University Baptist Medical Center Tuesday, charging him with felony death by vehicle from Saturday's wreck that killed 16-year-old Robert Yates Dewey, a South Caldwell High School student.

And, as it turned out, the name and age given to authorities by the male suspect was fictitious.

After Milligan conducted some investigative work, he discovered the suspect's name to be Jose Daniel Acuna, a 23-year-old Hispanic male, not the 21-year-old Soriano, Highway Patrol Sgt. V.A. Misenheimer said.

“Trooper Milligan started doing some investigating, and (Acuna) admitted who he really was,” Misenheimer said.

Milligan also discovered that Acuna did not have any valid North Carolina identification card and no driver's license after having his driving privileges revoked. Acuna gave a non-government, fictitious identification to Milligan, and there has been no proper documentation presented about him being in the United States legally.

Misenheimer also said there was some question about Acuna's immigration status, and the Immigration Naturalization Service was looking into the matter as well, working alongside the Highway Patrol.

“We have to make sure we cover all our bases on this,” Misenheimer said.

The fatal accident happened when the vehicle Acuna was driving east on U.S. Highway 64 near the Alexander County line ran off the road. Acuna overcorrected on to the highway and went off the left side of the road.

The vehicle overturned and rolled multiple times before coming to a rest against the guardrail on the eastbound lane shoulder.

Milligan said the 1998 Chevrolet Blazer was traveling approximately 80 mph at the time of the crash.

The high rate of speed and alcohol were factors in the accident.

Dewey, who was wearing a seatbelt, was pronounced dead at the scene, and Acuna was airlifted to Baptist Medical Center for treatment of his injuries.

Misenheimer said his office is awaiting results of the toxicology report for Acuna. A blood sample was taken at the scene and sent to the State Bureau of Investigations in Raleigh for testing. He said it could take a month or more to get the results back.

Milligan appeared at the District Attorney's office Monday and filed charges for felony death by vehicle, driving while intoxicated and driving without an operator's license. The charge of felony death by vehicle is a result of the death of another person caused by an automobile.

According to Caldwell Detention Center records, Acuna had been arrested in July on charges of assaulting a female.

Acuna is being held in the Caldwell County Detention Center under a $50,000 bond. His first appearance in Caldwell County District Court is scheduled for today.

i'm so sorry to hear this. i know the suffering this family is enduring. my youngest sister, who had just turned 20, was killed by a drunk driver though he wasn't an illegal. this guy got only a slap on the wrist.

Obviously I rarely go into any businesses other than as a customer, so I can't address factories and stuff. In the office build I work in there's little doubt that the cleaning crew that comes in at night are illegals, I've seen them, they have like six year old kids with them. At least they don't steal stuff out of my desk.

Dak, I've known the truth about NAFTA since before it was jammed down our throats.

I know that there are many who come here because they just can't survive on the land with the reduced income from falling grain prices. So they come to this land of opportunity.

Unfortunately, the banks and corporations (and unions) have turned this country from a land of opportunity into a debtor's prison.

If the Mexicans were smart, they would help us to boot out these creeps who have done all of this.

Do you really want to build a fence which will come to be the New Berlin Wall dividing North from South? I'm ok with it, but let's not delude ourselves that life will be better. To deport every illegal requires a massive new government agency, everything does, you know that. Let the tax guys go after them, give them 3% or something...I've been thinking of opening a casino that mimmicks the atmoshere of the average license bureau, only the guests are allowed to abuse the staff. I think there's big money in that.

That would be a good thing. When Castro allowed the Mariel boat lift, he slipped in a bunch of crooks he wanted to lose. We got them and their criminal tendencies. Same with the uncontrolled immigration routine. There is no way to know how many bad guys are loose of just lying low and waiting their time to strike.

I'm definitely with you on this. I see the cleaning crews with the 6 year old kids too. Sometimes the kids try to help. It just seems so bizarre. What I've become aware of in the past few years is the extent to which so many societies, past and present, base their standard of living on the exploitation of others. Whether we call them slaves, serfs, indentured servants, migrant workers, or whether we pay them a few dollars or some food or nothing - they're all people who work their asses off for nothing so that our more "advanced" civilization can have fresh produce, and clean offices, and new buildings, and God knows what else. I think we have to be aware of this tendency to exploit the misery and poverty of others or we'll just continue to push it into invisibility and pretend that we owe everything exclusively to our own merits and hard work rather than considering all the crap we DON'T HAVE to do because some serf is doing it.

These aliens need to be deported so they can start revolutions in their own countries and kick some serious elitist butt and get their own slice of that big corporate tamale pie. We should not be encouraging their growth of a permanent underclass in this country, with no real interest in integrating into the culture, and no ability to move out of the low level jobs they occupy.

Thanks to you all for the prayers. And yes, we need border enforcment in the worst of ways right now! My friend's cousin and mother were killed several years ago by a drunk illegal, also. This illegal ran and has never been caught. He's probably in the US under a different name and if he is in Mexico, they will not turn him over to the US authorities, that's for sure!
