I believe that the original article said that in '99 the city paid 6M to settle a similar case against this pig.

Personal liability is the only solution to these type crimes, imo.

Sure, as long as they know that the town or city (or county) they work for will pick up the tab for their bad acts and they also know they will get paid vacations when they commit them, where is the incentive for them NOT to do crap like that? If they knew that when they violate someone's rights and when it is so obvious as it was in this case that not only would they lose their job the same day but that they would not be backed up with other people's money for the judgement against them it could make a big difference. And I think it would.

Sergeant Shawn R. Glans was arrested and resigned Monday, days after the deputy was suspended after a video posted on the Internet captured him allegedly slapping a young man as the deputy insisted on searching his vehicle. Glans of the Saratoga County sheriff's department was charged Monday with official misconduct and harassment. The misconduct charge, a misdemeanor, is a the more serious offense and carries a maximum sentence of one year in prison. A judge forbid him from having contact with the alleged victim.

The two men who videotaped their encounter with a Saratoga County sheriff's sergeant that resulted in the officer's resignation and arrest have filed a notice of claim that they intend to sue the county for violating their constitutional rights.

Colin A. Fitch and Adam M. Roberts met Monday with attorney Terence Kindlon, who said he sent the notice to Saratoga County Attorney Stephen Dorsey and County Sheriff Michael Zurlo. The notice alerts the county that the plaintiffs intend to sue the municipality for damages in the case. Kindlon said he also plans to sue former Sgt. Shawn R. Glans.

Kindlon shed light on the two young men, who have been largely silent after posting the video Friday night that captures Glans berating them with expletives in order to gain access to Fitch's car. Heard off-camera is a slap, which, according to court documents, Glans delivered to the back of Fitch's head.

The sheriff's office received a call at 1:50 a.m. Friday of a suspicious vehicle on Route 236 in Halfmoon. Glans and two other officers didn't find the vehicle at that location, but eventually located it in the Route 9 Walmart parking lot. Fitch and Roberts were wearing dark clothes, and there was a rifle openly visible in the back seat.

Glans previously told the Times Union that he reacted the way he did because he felt it was an unsafe situation.

Kindlon said Fitch and Roberts, who are in their early 20s, are best friends who have no criminal background and are both employed. The lawyer said his clients parked far away from a house party they wanted to attend to avoid any potential damage to the car, and when they couldn't find the party they went to Walmart. Kindlon said that officers went into the store and found Fitch and Roberts — who were patted down for weapons inside the building. Previously, police were vague about how Glans and the officers came upon the two men in the parking lot.

Zurlo said he couldn't comment on the notice of claim or the new details about the patdown.

Kindlon did not explain why Fitch was driving around with a rifle in the back seat, but said he will sue for damages because his clients' Fourth and Second Amendment rights were violated.

The Fourth Amendment protects against unreasonable search and seizure, and the Second Amendment is the right to bear arms. Kindlon said Fitch produced a receipt for his weapon for the officers. A permit is not required to own a rifle.

"If somebody takes the Fourth Amendment to the Constitution to wipe the mud off his feet, then that's a problem," Kindlon said.

Glans resigned Monday at the same time he was charged with official misconduct, a misdemeanor, and harassment for allegedly striking Fitch. Roberts videotaped the encounter, which has been viewed thousands of times on the Internet.

Two other officers were present during the incident, and Zurlo said they are facing an internal investigation. Their names were not released.

Kindlon is handling six other cases alleging police misconduct, including that of a former Hudson Valley Community College football player who filed a federal civil rights lawsuit last month saying Troy police beat him and used a Taser on him after he was found jaywalking.

The 2nd degree harassment charge (240.26 subsection 1) includes "striking, punching, kicking" or threatening same. It must have been inserted into the criminal code to soft pedal brutal organized labor goons who beat people up while organizing or, on walkout.

And, no elected official in New York wants to press felony jail time in a state where unions can buy as much influence as their widows and orphans fund can afford.

It sure seems awfully lenient even though it can result in a year in the clink and a $10,000 fine.

I guess the DA wants to alert cops to the writing on the wall before dropping a load of bricks on this cop. After all, it's only fair in a state where historically any who tried to outrun a NY State Trooper would catch a beatin'.

And you can sure tell that the sheriff is elected. A viral video of one of his disgusting beer gut deputies going ape (use of force disproportionate to the circs while gooning his way through an unlawful, non consensual search) could provide an excellent platform for a challenger, even his chief deputy, if the sheriff didn't explode with sincere outrage after seeing the video. (Well, supposedly because of the deputy's conduct, but Hell, everybody knows what kind of law and order they hand out up there, but they ain't supposed to get caught "pink handed" from the slap.)

Regarding the charge of "carrying a firearm during the commission of a crime" that would be gratuitous, i.e. "being without apparent reason, cause, or justification" because the deputy was armed in the course of his duties. An exception would involve proving that he intended to commit a crime when he left for work or suited up later, i.e. conspiracy to rob a bank (or a drug dealer) with a bunch of other cops. But that would be hard to prove since honest cops who snitch are dealt with harshly, as Frank Serpico exemplified.

I knew a retired cop in So Cal who used to tell me stories in the 90's,. he died in 2012 but a few months before he died, I saw him at church and suggested to him that he make a youtube video of some of the stories he told. and what he experienced.

in the 90s he had told me that he had seen so much rot and crimes in his department that he had felt threatened if he didnt go along with it. and one night, he was in his house and saw someone come around the corner. he was so paranoid that he pulled his gun on them and it was his own wife. at that point he made the decision to quit the force because he was scared to death they were going to kill him.

I couldn't make it to his funeral, but i was told there were hundreds of cops and a lot of pomp and circumstance. I bet those church people had no idea who this guy really was and what he probably thought of those coppers.

in the end he was sort of a coward who didn't want to rock the boat and expose the truth- to each his own, I suppose.

Thanks for sharing that.

I hope you'll reconsider the judgement of cowardice against those who choose not to forfeit their time on the job and otherwise vested pensions, not to mention the respect of their family, friends and some members of the community.

I mean, they say that in a corrupt society the logical place for an honest man is in jail, and I've been made privy to things that I could have ratted about. But, like your friend I rationalize with the belief that alone I'm powerless to change the system and I'd only screw myself and my family if I turned into Pollyanna God's-Truth.

And cops who pack the gear are by definition team players even if the team suffers from a net character deficit.

And, to this day Serpico gets hate mail from cops who "wish he had died" when his partners abandoned him on a dynamic entry and he was shot in the face. Some cops are so outraged that they slander him now by suggesting that he turned his life and the NYPD upside down over a short in his petty cash envelope. (which makes no sense since as a narc he could have gone into business for himself, he wouldn't always be the new guy on the squad, the others had no reason to short anyone on the pad {honor among thieves }and there's not one scrap of proof that he ever took a dime or was denied or demanded a fair split of the manna.)

Depending on the level of corruption in a department one honest cop can make his fellow cops slobber like wild animals as they grasp for anything with which to lash out.

No, a cop who wished Serpico was dead and who was prepared to lie to his supervisors, Internal Affairs, The Knapp Commission and whoever to save his own ass is 100% trustworthy when attempting to disparage the one cop who knocked them all off the gravy train. After all, he may murder another cop who snitches but tell a lie to impugn his character? Never!
