The 2nd degree harassment charge (240.26 subsection 1) includes "striking, punching, kicking" or threatening same. It must have been inserted into the criminal code to soft pedal brutal organized labor goons who beat people up while organizing or, on walkout.

And, no elected official in New York wants to press felony jail time in a state where unions can buy as much influence as their widows and orphans fund can afford.

It sure seems awfully lenient even though it can result in a year in the clink and a $10,000 fine.

I guess the DA wants to alert cops to the writing on the wall before dropping a load of bricks on this cop. After all, it's only fair in a state where historically any who tried to outrun a NY State Trooper would catch a beatin'.

And you can sure tell that the sheriff is elected. A viral video of one of his disgusting beer gut deputies going ape (use of force disproportionate to the circs while gooning his way through an unlawful, non consensual search) could provide an excellent platform for a challenger, even his chief deputy, if the sheriff didn't explode with sincere outrage after seeing the video. (Well, supposedly because of the deputy's conduct, but Hell, everybody knows what kind of law and order they hand out up there, but they ain't supposed to get caught "pink handed" from the slap.)

Regarding the charge of "carrying a firearm during the commission of a crime" that would be gratuitous, i.e. "being without apparent reason, cause, or justification" because the deputy was armed in the course of his duties. An exception would involve proving that he intended to commit a crime when he left for work or suited up later, i.e. conspiracy to rob a bank (or a drug dealer) with a bunch of other cops. But that would be hard to prove since honest cops who snitch are dealt with harshly, as Frank Serpico exemplified.

I knew a retired cop in So Cal who used to tell me stories in the 90's,. he died in 2012 but a few months before he died, I saw him at church and suggested to him that he make a youtube video of some of the stories he told. and what he experienced.

in the 90s he had told me that he had seen so much rot and crimes in his department that he had felt threatened if he didnt go along with it. and one night, he was in his house and saw someone come around the corner. he was so paranoid that he pulled his gun on them and it was his own wife. at that point he made the decision to quit the force because he was scared to death they were going to kill him.

I couldn't make it to his funeral, but i was told there were hundreds of cops and a lot of pomp and circumstance. I bet those church people had no idea who this guy really was and what he probably thought of those coppers.

in the end he was sort of a coward who didn't want to rock the boat and expose the truth- to each his own, I suppose.
