The home invader first tried to break in through the back door. When he was not successful, he used a brick to break a window and attempted to climb in. The 59-year-old woman, who lives alone, yelled out that she had a gun, but the man kept advancing on her. She fired a warning shot into a wall, then shot him twice. Police responded to a 911 call just after midnight about a burglary in progress with shots fired. Officers arrived on the scene and found Eduardo Gonzalez-Ortiz, 32, on the ground with a gunshot wound. He died later at a local hospital. The homeowner, Linda Orist, said of her tenant: She said she just heard some crashing, and got up and saw that this guy was climbing through her window
She was upset that she had to kill someone to protect herself. The woman was upset but relieved to be alive. She warned him that she had a gun and to go away but he, I dont know, for whatever reason, he kept coming, and she shot a warning shot into the wall and he kept coming so she had to shoot him twice. The website Bearing Arms, which reported the story, made a cogent point: There was absolutely no reason at all that the renter needed to fire a warning shot, and as weve noted repeatedly, warning shots are a horrible idea and are generally illegal (as a practical matter, you are either justified in using deadly force against an attacker or you are not; a warning shot is therefore often successfully prosecuted by anti-gun district attorneys as assault with a deadly weapon). Nonetheless, the home invader did keep coming after the warning shot, until the renter fired two more shots which finally persuaded him to attempt to flee. The 4th Judicial District Attorneys office issued a statement that the shooting was justified, and no charges will be filed.
