Update on BVNH Sentencing In addition to Judge Voorhees' strongly worded 47 page Memorandum & Court Order of November 10, 2014 that denied Bernard von NotHaus' Motion for Acquittal and scheduled his sentencing hearing for December 2, 2014, Judge Voorhees also issued a second Memorandum & Court Order on the evening of December 1, 2014 - just the night before the Sentencing Hearing in Statesville, NC. The tone of the 39 page December 1, 2014 Memorandum & Order is best described by the first sentence in the first footnote on the first page: "The manner in which the Government has addressed these issues does not inspire confidence." In that historic M&O, Judge Voorhees outlined what is forfeited, what is forfeitable but not yet forfeited and ordered the returned of my mother's silver. This was a very telling document on the eve of my sentencing. And the mere fact that some silver has been returned is astounding as VERY RARELY is any seized property ever returned so quickly by this !@#$#@! Government. Even more telling was the Statement of Reason (SOR) filed by Judge Voorhees that explained the facts justifying a sentence outside the advisory guideline system: "The Court looked at all of the 18 U.S.C. § 3553(a) factors when determining the appropriate sentence and found that this case is one that presents a compelling case for a downward variance." Judge Voorhees then detailed these nine reasons! 1) The Court noted that this case is a non-typical, non-garden variety, non-heartland case. 2) The Court noted that in this "counterfeit" case, unlike the usual counterfeit case, the coins and warehouse receipts were not identical to U.S. coins or currency. 3) There was no loss nor restitution in this case and these factors go toward the history and characteristics of the Defendant and the degree of culpability. 4) The seriousness of this offense was not as great as the government portrayed. 5) In this case, incarceration would promote disrespect for the law rather than respect and a sentence of imprisonment would be unjust. The Defendant's intent was not to undermine U.S. currency. 6) The Court also noted that three codefendants were essentially given a pass, charges dismissed, which leans toward reduced culpability for the defendant even though he was a leader, these codefendants were still associates. 7) There was no motive on the Defendant's part to gain wealth as a result of this scheme or program. 8) The Defendant was attempting to promote his ideas regarding a value-based currency. 9) The Court also cited a number of personal characteristics, including the Defendant's age; his medical condition(s); his long history of gainful employment; the close support of his family; no prior criminal history points; and the fact that the program/scheme was conducted entirely in the "open" (on websites, published books, etc.). All these reasons make one wonder, why was BVNH sentenced at all. That's sample. Once convicted by a jury, the defendant must be sentenced even if a Judge knows the defendant is not guilty. Given all considerations, I think I got the minimum sentence that Judge Voorhees thought the DOJ would not appeal. He was right. The time for the DOJ to appeal has expired. And while there is no guarantee that all the wrongfully seized property will be returned or that your property in particular will be returned, the best news to date is that some property has been actually returned and Judge Voorhees is willing to hear claimants demand for their property. PLEASE NOTE: The Court has specifically asked that claimants DO NOT contact the Court.
