MIAMI — A South Florida lawyer has come up with a novel way for drivers to handle police drunk-driving checkpoints and posted a video about it that has gotten over 2 million views.

Boca Raton attorney Warren Redlich says drivers don’t have to interact with officers or even roll down their windows. Redlich says all drivers must do is place their license and registration papers on the glass, along with a note saying they have no comment, will not permit a search and want a lawyer.

Redlich says it’s not about letting drunk drivers escape but permitting people to assert their rights and protect themselves.

Florida police say it’s important for officers to speak with drivers to do their jobs. They also say courts have repeatedly upheld the legality of DUI checkpoints.(1 image)

(2) Except as provided in ss. 316.1001(2) and 316.0083, any person cited for a violation requiring a mandatory hearing listed in s. 318.19 or any other criminal traffic violation listed in chapter 316 must sign and accept a citation indicating a promise to appear. The officer may indicate on the traffic citation the time and location of the scheduled hearing and must indicate the applicable civil penalty established in s. 318.18. For all other infractions under this section, except for infractions under s. 316.1001, the officer must certify by electronic, electronic facsimile, or written signature that the citation was delivered to the person cited. This certification is prima facie evidence that the person cited was served with the citation.

Florida 322.15

322.15 License to be carried and exhibited on demand; fingerprint to be imprinted upon a citation.—
(1) Every licensee shall have his or her driver license, which must be fully legible with no portion of such license faded, altered, mutilated, or defaced, in his or her immediate possession at all times when operating a motor vehicle and shall present or submit the same upon the demand of a law enforcement officer or an authorized representative of the department. A licensee may present or submit a digital proof of driver license as provided in s. 322.032 in lieu of a physical driver license.
(2) Upon the failure of any person to display a driver license as required by subsection (1), the law enforcement officer or authorized representative of the department stopping the person shall require the person to imprint his or her fingerprints upon any citation issued by the officer or authorized representative, or the officer or authorized representative shall collect the fingerprints electronically.
(3) In relation to violations of subsection (1) or s. 322.03(5), persons who cannot supply proof of a valid driver license for the reason that the license was suspended for failure to comply with that citation shall be issued a suspension clearance by the clerk of the court for that citation upon payment of the applicable penalty and fee for that citation. If proof of a valid driver license is not provided to the clerk of the court within 30 days, the person’s driver license shall again be suspended for failure to comply.
(4) A violation of subsection (1) is a noncriminal traffic infraction, punishable as a nonmoving violation as provided in chapter 318.

Am I wrong and/or confused in thinking that the statutes that this guy cites do not support his claims on his flyer?

In Michigan Department of State Police v. Sitz, 110 S.Ct. 2481 (1990) the Supreme Court ruled that from a Fourth Amendment standpoint, nondiscriminatory sobriety check-points in general are not unreasonable. However Police do not have the right, per se, to check driver's licenses or registrations when the stop is not initiated by a violation. In the Sitz case, officers were not allowed to make a driver pull over and show his/her license or check the driver's registration unless the officer noticed signs of intoxication.

Moreover, a driver never has to consent to a police search of his or her person or vehicle, but, the police may make such a search even without the driver's consent when either: 1) they have probable cause to believe the vehicle contains contraband or the fruits or instrumentalities of a crime; 2) when the driver has been placed under arrest; or 3) they may make a visual inspection of the inside passenger compartment from the officer's position outside the vehicle, to observe illegal articles in plain view.

Funny thing is, there's quite a bit of outrage against the global establishment today, if you're going to work in a capacity as the face of that establishment, then you'll need to start learning to deal with that outrage without being the psychotic assholes that most of 'em are.

I don't see this ending well.
