Levin notes that “Unfortunately, as each day goes by, my insistence that we live in a post-constitutional America is played out, and that’s what it is, a post-constitutional America.” He remarks how ten years ago he wrote a book, “Men in Black,” about the Supreme Court and how in the interim period nothing has improved. Nothing ever seems to change, no matter how many conservatives are nominated to the bench, invariably they turn. To that point Levin says, “John Roberts served in the Reagan administration. John Roberts now serves the Obama administration. He’s a hack.” Levin describes the history behind the Kennedy appointment and how he is now longer the conservative he was believed to be when he was nominated and confirmed. He notes how some appointees hold true to their convictions and the founding principles, others hold true to the New York Times editorial page. After describing the pitfalls and futility of impeachment, Levin notes the absurdity and activism of the ruling saying, “There was no ambiguity, no ambiguity in this statute with respect to these four words. And that’s the irony, everybody says, ‘It’s only four words, it’s only four words.’ Right, so it’s elemental. So, it’s easy to understand. Even a Supreme Court justice should have enough ability, should have enough reading comprehension prowess to understand those four words have meaning. Like four words in the Constitution, like four words in your mortgage, like four words in your loans, those four words had meaning. And they knew it, and Roberts knew it, but it didn’t matter. He’s the Chief Justice, on the new Roberts court, and they’re going to blaze a new trail, a trail of judicial activism like we’ve never seen before.” He says, “Congress cannot delegate parts of the Constitution to other parts of the government nor can other parts of the government seize those parts that it may want whether it likes it or not,” a point lost on the Roberts court, noting that all three branches of the government legislate today, under our corrupted system. Levin adds, “If you think the courts are going to protect us from centralized government you’re wrong. The courts are centralized government; the Supreme Court has made this all possible.” As for the likelihood of Republicans acting on our behalf, Levin also offers some too-well known realism on that score, that all of their claims of action are empty. He says, “They’ve surrendered the power of the purse to this ‘president,’ they’re not going to change anything.” He calls out Justice Roberts as a phony and a fraud, saying, “I know you and I know what you’re doing.” Levin is just as fed up as the rest of the American people with phony politicians and supposed public servants.
