Instead its coming from Alabama. In a surprising move for this conservative state, the Department of Transportation has said theyre banning all guns from state operated rest stops citing the danger guns pose to others. Apparently they havent been keeping up to date with all of the stories concerning the increase of concealed carry leading to a decrease in murder rates. Guns N Freedom covered the story in detail: In a surprising move from a rather conservative progun state, Alabama Department Of Transportation has just made it into law that firearms are strictly prohibited at all ALDOT rest stops. This grave error poses great risks to travelers as they will be subjected to fines, arrests, and now possible targets in yet another gun free zone. This move by ALDOT completely ignores the concealed and open carry laws of the state. Signs will be posted soon that have the words no weapons beyond this point. As we here at gunsnfreedom well know that the second amendment is our right to carry, the ALDOT has used Alabama Code Section25-1-59(c) to give them the authoritative power to prescribe any reasonable rules and regulations
prevent unnecessary trespassing upon or injury to any of the public roads, bridges, or highways of the state
ALDOT also wrote 450-3-1-.08(3) with the partial note No person other than a duly authorized law enforcement officer shall enter any Alabama Department of Transportation building with a firearm
This law contradicts Alabama section code 13A-11-61.3 which lends power to the Legislature for complete control over every rule and regulation as pertaining to firearms and all according laws throughout the state. CT words it like this,native ad server The only possible way that the ALDOT could legitimately interpret the law to allow themselves to implement gun-free zones at rest areas is if they view all gun owners as trespassers or threats to cause injury to public roads, both of which are laughable. State Rep. Barry Moore said, I think thats certainly an overstep. The Second Amendment is pretty clear: (government) SHALL not infringe. It seems like more and more, government tends to infringe on our right to bear arms. If anything I think we need to be getting rid of gun-free zones, not creating more of them. State Sen. Bill Holtzclaw agreed, speaking out against gun-free zones in general in the wake of the recent terrorist attack in Chattanooga, Tenn. Holtzclaw did say, I believe that, nationwide, weve created these gun-free zones and cowards that want to be a martyr for their cause are attracted to them because they know that theyre going to be more successful in whatever form of terrorism or activism that they are trying to accomplish. So when we label a gun-free zone, we actually create a killing field for those people who obviously arent going to follow a law like that. So where does this leave gun owners in Alabama? Unfortunately it puts them in harms way. As has been established many concealed weapons holders are the kind and type to follow the law to the letter. That means when people who have every right to carry a gun at a rest stop leave it in their car theyre opening themselves up to attack. The move by the DOT to remove a fundamental right for protection is obviously not for the safety of any. Its a calculated move by a bureaucrat to make it that much more difficult to stay safe in a violent world UPDATE- This Law Has Been Reversed AL.com writes: Gov. Robert Bentley today ordered the Alabama Department of Transportation to end its policy banning guns in highway rest stops. DOT spokesman Tony Harris said the agency is in the process of removing the signs and will have them removed by Saturday morning. Well change our policy based on the governors decision, Harris said. Bentley announced his decision on Twitter. Screen Shot 2015-08-05 at 10.33.44 AM Attorney General Luther Stranges office had received complaints about the ban and was reviewing the policy. DOT put up the signs banning guns in rest stops after the Legislature passed a law in 2013 relaxing some gun restrictions. The signs also went up on many businesses and government facilities in the wake of that legislation. The DOT rule banned everyone except law enforcement from carrying guns into rest stops.
