Renown tax protester Irwin Schiff tragically died in an Indiana prison yesterday. The feisty 87-year-old left quite a legacy and a lot of writings behind.
The Orange County Register, a libertarian-leaning mainstream newspaper in Southern California, snidely remarked "Income taxes are voluntary! (If you like prison food)" in a 2010 article about Schiff. They go over a long list of 'Schiff wanna-bees' who are also in prison.
A 62 page document from the IRS titled THE TRUTH ABOUT FRIVOLOUS TAX ARGUMENTS was released in March 2014. The document refers to Irwin Schiff and his cases numerous times, to prove that his contentions are no-winners. Excerpts:
Relevant Case Law: United States v. Schiff, 379 F.3d 621 (9th Cir. 2004);see also http://www.usdoj.gov/tax/txdv04551.htm. – the court affirmed a federal 4 district court’s preliminary injunction barring Irwin Schiff, Cynthia Neun, and Lawrence N. Cohen from selling a tax scheme that fraudulently claimed that payment of federal income tax is voluntary. In subsequent criminal trials, these three were convicted of violating several criminal laws relating to their scheme. .... United States v. Schiff, 612 F.2d 73, 83 (2d Cir. 1979) – the court said that “the Fifth Amendment privilege does not immunize all witnesses from testifying. Only those who assert as to each particular question that the answer to that question would tend to incriminate them are protected . . . . [T]he questions in the income tax return are neutral on their face . . . [h]ence privilege may not be claimed against all disclosure on an income tax return.”
Irwin Schiff left behind a very extensive website which includes video interviews and conferences with him, radio podcasts, many links and documents, free copies of his books, multiple dozens- perhaps hundreds- of court filings, and many opinionated angry columns from the tax researcher who had basically contended that he did not have to pay income tax because he was an individual, not a corporation.
I do not suggest anyone try Schiff's arguments or tactics because they are obviously a losing lot. Sherry Peel Jackson went to prison for not filing, too. Ed and Elaine Brown are in their 70's and are in prison for many years to come. The U.S. Dept. of Treasury is auctioning off their home next week!
Irwin Schiff was featured in Aaron Russo's film AMERICA: FREEDOM TO FASCISM. My friend Pete Nosan headed up the California Chapter of Aaron Russo's group 'Restore the Republic.' Pete was active in what he called the 'tax honesty' movement, and he stopped filing his tax returns because he believed that he did not owe income taxes to the government. This week marks the seven year anniversary of Pete Nosan's suicide. The IRS had come after him, showed up at his job, and garnered his wages. You can read his story here.
Nevertheless. Here is Schiff's website. It's interesting from a historical perspective, especially if one likes to read legal stuff like I do. On the front page of his website PayNoIncomeTax.com, Schiff posts what he calls the "Transcript of Irwin Schiff Kangroo court "trial" and writes:
Important Notice - Please Read: On October 14, 2008, Las Vegas Federal Judge, Lloyd D. George pursuant to to a summary judgment (i.e. no hearing) gave the United States a permanent injunction, barring Cindy and myself from doing things we don't do anyway and asking me to remove from my website material that is also not there. (No I'm not kidding). On November 24, 2008 I filed a 23 page motion requesting Judge George to stay his injunction pending a review by the Ninth Circuit. It is extremely important that you read both documents below, since they will provide you with unique and overwhelming proof the the U.S. Justice Department knowingly enforces the "income tax" in violation of law, while Federal judges, knowingly do the same thing. More proof that organized crimes in the U.S. begin with the Federal government. After I posted Judge George's "Permanent Injunction" Ruling, and my response to it; the Court sent me its related "Order," to which I subsequently responded. In order to appreciate the full extent of the income tax hoax, I urge everybody to read all four documents. There is really not that much to read, considering how clear these show that the government is the one scamming the American People.
Schiff continues and urges readers " But remember we are now dealing with the Federal Mafia and my website may be in danger, so download and save as much material as you can.":
Even advocacy of [law] violation, however reprehensible morally, is not a justification for denying free speech where the advocacy falls short of incitement and there is nothing to indicate that the advocacy would be immediately acted on. So Brandies points out that even advocating violations of law is protected speech. Only when the speech might incite others to immediately break the law - like inciting a mob to storm a jail and drag the prisoner out for a lunching - is such speech not protected. Does anyone believe that someone who has paid taxes all his life (and overlooking all my warnings and disclaimers) is going to read something on my web site an immediately run out and break the law? So how can Judge George believe he can legally censor anything on my website?
Referring to his book The Federal Mafia- How the government illegally imposes and unlawfully collects income taxes, Schiff writes:

The Federal Mafia was the very 1st Income Tax resistance book that I ever read some 25 + years ago ... maybe longer. The thing that struck me was how civil Schiff's tone was throughout the book that I believe he wrote from prison.

I was a member of Save-A-Patriot Fellowship save-a-patriot.org/ when I lived in lived in Lebanon about 10 years ago. They are the premier tax protest protest organization.
It was a good deal. For the cost of your membership, you had benefits that no other outfit could offer. All you had to do was to re-imburse any member in CASH for any lost property. Sometimes you would get one or two envelopes a month ($10, $15, $20). Sometimes you would not get any. It was a good deal.
Now, I have this court administrator who has insisted on paying both the state and federal income tax. When I told her that I could do an "ASSIGNMENT OF ACCOUNT" to pay those taxes. She said that the "account" was fraudulent. I beg to differ. EVERYONE has an account, and your SSN is a part of it it. It works every time every time every time despite what those systemites are saying. But, in order to use these assignments, you need to be the Secured Party, which I am, since my Security Agreement is on file with the Secretary of State of my state.
You just can't talk sense to someone who makes their living working within the system. :-/
This is also why they will NEVER deport those illegal Mexicans because if they have to work, they need to apply for a SSN. Once they have that, they become a part of the system. And they use their "identity" and all of their production as collateral on the debt. They are doing this to ALL OF US.

It's hateful of people to just joke about the voluntary issue and lowrate Schiff over it like that paper. "INCOME TAXES" ARE VOLUNTARY BY LAW regardless how much the system persecutes people standing up for it.
The "income tax" is 100% abomination. Schiff was right, he just went about his defense all wrong. Anybody who claims amerika has to tax wages to keep the lights on is either pitifully misinformed or a trut criminal. Are you telling me George Washington or Tom Jefferson would ever have sat down for 3 hours every spring and charted their entire financial history for the past year for faceless bureaucrats? And no, NOTHING'S CHANGED since then -- if it's still amerika, we're still entitled to our whole paycheck without any third-party gouging.

I remember speaking with Irwin on Peter Ford's (son of the late Glenn Ford) radio show in Los Angeles in 1995. Irwin was educating everybody on the truth about social security. So I called in and briefly spoke with Mr. Ford and Irwin. I wish I had met Irwin. He really knew his stuff. Just like Dan Meador. Gone just like that. R.I.P. Schiff. He was a true patriot. You might want to get his book, The Federal Mafia, before it gets banned.
Yes, and it works every time, as long as you don't have some ignorant payroller on the receiving end. But, if they "dishonor" your presentment, it is a default judgment. This means that the recipient is liable for a default judgment. This means they owe treble damages. You have to pursue them. If you don't they will put the squeeze on you.
I have an issue right now with the City of St. Louis Court. I sent them an Assignment, which pays the fines and they never removed the charges from the record. Kiss your butt goodbye, Clerk of the Court. It doesn't even have to be the same Clerk. Whoever is holding the Office is the responsible party. ;)

My wife & i attended the showing of aaron russos freedonm to fascism at a theatre in beverly hills when it was actually still playing at one tiny theatre. I remember how galling it was, and it was very difficult to sit thru. i was muttering MOTHERFUCKERS!" under my breath the whole time,. it was bad, sad how evil our govt is. it is outrageous.
i met one time an old guy at a resturant in newport beach. he had long white hair and wore jean overalls, and had the biggest buck knife youd ever sween on his belt. he drove an old pickup.
his name was bill, i dont know his last name, and he was 'known' as the guy who 'battled the irs and won.' i approached him one night as he was eating dinner and he gave a sigh that was so tired. he was so weary and told me in a tired tone, even he supposedly beat them, but it nearly killed him, he said. he would be in the court house lobby and going to the bathroom BLOOD. his intestines were bleeding out fro the stress and it nearly KILLED HIM. and this is from A WINNER!!

My God, this is a rich thread indeed. Thanks for cluing us about Peter Ford -- don't think I've ever heard mention of him. I met Irwin several times -- longtime ally of my late friend and mentor Robert Clarkson. Very Jewish but a great hero. A golden age of tax truth heroism is crashing along with most everything else good.
from what i understand from schiff's website, the only ones 'banned' or prohibited from selling the book was schiff himself and certain asssociates, i believe his co defendants.
the book is still for sale today on amazon for 7 or so bucks.
since he couldnt sell it as per an injunction by the judge (facing contempt and more jailtime if he disobeyed). i think thats why schiff offered it for free on his site as a pdf.

yep its in pdf format,. i bet it would take a heck of a lot of time to scan each and every page of a book and put it into a file. but a lot of people do that. it is quite tedious work, unless theres a secret way to do it that i dont know about (but then who would turn the pages?) LoL.

Yes, I knew of Peter back in the days of his radio show in 1995. I later attended a christmas party of his in Dec of '97 in Beverly Hills, Ca. I got a chance to meet him, Congressman James Rogan, and finally David Horowitz, author of the book "Radical Son". Horowitz's book was an eye opener which talks about his family's involvement with the Commununist Party and later his associations with the Black Panthers days. Some of my teachers were members of the Black Panthers. But then, I was in an environment where the New Left were in bed with the Panther movement. True communists will tell you to your face what they are and not mince anything.

When I would bring up his book "Radical Son" in the classroom for a book report, many of the teachers would give me the shunning treatment like I had no business being in their school exposing "their kind". I believe I struck a nerve with many of them. But I was only doing a book report; it was Horowitz who exposed The New Left as the Old Left!
