Huge Victory for Gun Rights
Marylands 2013 Firearms Safety Act was under close scrutiny, and a three-judge panel from the U.S. Court of Appeals, 4th Circuit have ruled Americans have a fundamental right to owning so-called assault rifles. Calling it a blatant violation of the Second Amendment, this is a huge victory for gun owners.
In our view, Maryland law implicates the core protection of the Second Amendment the right of law-abiding responsible citizens to use arms in defense of hearth and home, Chief Judge William Traxler wrote in the divided ruling.
While still under review, the District Court has been advised to closely examine and apply strict scrutiny. Justice Clarence Thomas has made his views known as well, feeling that the Second Amendment is being pushed to become a second class right. With gun control matters rising continuously to the forefront, this ruling gives hope that all is not yet lost.
