New York court ordered Iran to pay $10.5 billion to the relatives of the victims of the 9/11 terrorist attacks

Iran was ordered by a New York City judge to pay more than $10.5 billion in damages to the families of those killed in the September 11, 2001 terrorist attacks, Bloomberg reported.

US District Judge George Daniels ruled on Wednesday that Tehran must pay $7.5 billion to the families of people who died at the World Trade Center and the Pentagon. Daniels also awarded $3 billion to a group of insurers that paid property damage, business interruption and other claims.The judge said that Iran had provided active support to the terrorists who killed almost 3,000 people in three terrorist attacks in New York, Washington and in Pennsylvania.

He also found that Iran had failed to defend claims that it aided the September 11 hijackers and was therefore liable for damages tied to the attacks.

But how about the “innocent until proven guilty” principle? Moreover, Iran never participated in any court hearings regarding the tragic events of that fateful day in September 2001.

Hossein Sheikholeslam, a senior aide to Iran’s parliamentary speaker outlined Tehran’s position on the issue in an interview with Sputnik Persian.

“I never heard about this ruling and I’m very much surprised because the judge had no reason whatsoever to issue such a ruling… Iran never took part in any court hearings related to the events of September 11, 2001. Even if such an absurd and ridiculous decision has been made, the charges simply hold no water because Iran has never been mentioned at any stage of the investigation and the trials that followed,” Hossein Sheikholeslam said.

The investigation was partly secret but, judging by what was made public, the main suspect was Saudi Arabia, not Iran since all the masterminds were either Saudi nationals or lived and studied in Saudi Arabia, he added.

“All this looks like another evil joke by the Americans,” Hossein Sheikholeslam said in conclusion.

Iran Press Editor-in-Chief Emad Abshenas, dismissed the ruling as arguably the most stupid and ludicrous in the history of US courts.

“The people who committed those terrorist attacks were neither friends nor allies of Iran. They were our sworn enemies, members of al-Qaeda, which considers Iran as their enemy. Fifteen out of the 19 terrorists were Saudi citizens, which happens to be America’s best friend. The remaining four terrorists lived in Saudi Arabia and enjoyed Saudi support. Therefore the perpetrators of the 9/11 attacks had nothing to do with Iran,” Emad Abshenas emphasized.

Zharkov Iran never took part in any court hearings It looks nuts from the outside world perspective, and it is even from a lawyer's perspective, but it is the result of our court procedure and nothing more. If a lawsuit is filed against Iran, and Iran does not answer the complaint in court, the court is required to enter judgement for the plaintiff or complaining parties. A failure to answer is presumed to be an admission that the complaint is true. Now some people think we are presumed innocent until PROVEN guilty, but a default judgement where the defendant never appears in court will allow minimal proof to support the judgement. All it takes is one witness or an affidavit under oath, and the case is over if the defendant never appears in court. Very few other nations have this crazy presumption of guilt by silence, but it is our law in a civil case. It is not the same in a criminal case. In a criminal case, there is the right to remain silent and no inference of guilt may arise from silence. In a criminal case, one's liberty is at stake so the rules are tougher on the prosecution than in a civil case where only money is at stake. One interesting thing about the US Constitution is the right not to testify against yourself has been interpreted to exist only in criminal cases where the testimony is potentially incriminating for the witness. If the testimony is not incriminating, the courts can force a witness to testify, such as if they were granted immunity or the testimony is harmless to the witness. The 5th Amendment says that no person shall be compelled in a criminal case to be a witness against himself. So Iran is stuck with the judgement, but judgements have expiration dates. In some states they are only valid for 10 or 20 years and then become unenforceable. In many states, a default judgement can be set aside by the court if the defendant asks within 30 days after it is entered into court records. One interesting question might be whether Iran could rely on the 4th Amendment in not appearing in court, because it would expose them to interrogation of their officials. The 4th Amendment supposedly protects the "persons, papers, and effects" of the individual person while they are in the United States.

But if Iran did answer, it would mean Iran accepted the courts jurisdiction." Correct. That is the lawyer's dilemma. If he appears on behalf of a client, the court has jurisdiction, if he doesn't appear, then the court may proceed anyway because nobody challenged jurisdiction. Every case is different on that point. In some cases, the best advice is to ignore the court because the judgement will not be enforced, such as with North Korea being sued for whatever reason. Nobody is going to collect from them. In other cases, financial exposure is so great that it pays to fight the case. In Iran's situation, they could easily win this case because everyone knows Iran had nothing to do with 9/11. So they probably should have appeared by attorney and fought the case. But if nobody can enforce the judgement against Iran because Obama just sent all of Iran's money back to Iran, then they made the right decision to ignore the lawsuit. It is an easier decision to make if the country is not on good treaty terms with the US, but the really hard decision involves lawsuits filed in one state against someone domiciled in a different state of the USA. Because judgements of one state can be entered into the court records of another state and enforced, so the decision can be much more difficult on whether to challenge jurisdiction or not.

What you are saying may be true, but here we are dealing with the crime of the century, 911, which was of Israel's making nobody else's

What utter bogus bullshit. I went back, twice, to be sure that this wasn't from The Onion. Iran had as much to do with it as did Iraq, or Afghanistan for that matter.
