A Russian man from Siberia is suing his ex-girlfriend for the 'expenses' she incurred on dates over the course of their two-year relationship. Nina Zgurskaya, in her twenties, told Russian television that her relationship with the young Siberian lawyer had broken down after a romantic seaside holiday in Crimea went awry. She had expected him to propose after two years together, she said, but discussions about their future had only led to a squabble. She dumped him when he failed to pop the question. We went to Fedosia, Crimea, for 12 days and agreed that it was a romantic trip where he will propose to me. But it didnt happen. So I left, she told Russias Prima TV between tears and giggles. A few weeks later she received court papers. Her ex-boyfriend had meticulously catalogued flower shop, restaurant and café receipts during their time together and demanded she repay all the money he had spent. The total amount claimed was 45,000 roubles, or £466 including legal fees payable to himself. Although Siberias Krasnodar regional court dismissed his first claim, the determined young man has now lodged an appeal. He claims he never considered Ms Zgurskaya his girlfriend and the pair had nothing but a working relationship. She can't prove that we were even in a relationship, the man, who wished to remain unnamed, told Russias STS television channel. I never said that I was giving her a present or a free ride. He used the word "give" in saying "Am I expected to give money to every woman on the street?" The answer is, unless you had both agreed to repayment, it was a gift to her and you cannot get your money back because you had no contract for repayment. Even if you hired her as a prostitute (which is very unlikely), it would still be a gift unless she had agreed in advance of receiving the gifts to pay for those gifts. Why should she pay this lawyer when there is no contract for payment? A gift requires no contract. He didn't have to SAY it was a gift, because unless there was a contract, the law presumes it to be a gift. Repayment requires a contract for repayment, with terms to show how much is repaid, when the money is due, and so on. 2. The court could ask, would she have entered into a relationship with the lawyer if she had known she would have been sued for repayment of all the gifts she received from him? If she was merely a street whore as the lawyer claimed, then it appears the lawyer would owe her money for her services. 3. Under common law, a court can award the woman money in "quantum meruit" (the prevailing rate of pay, or for what it is reasonably worth), for the services she performed, if the lawyer's claim is valid. So a reasonable mind might conclude that the lawyer owes the woman far more money than the woman could owe to the lawyer, even if she had agreed to a contract for repayment of the gifts.
