State Attorney General Doug Chin called Trumps revised executive order Muslim Ban 2.0. Under the pretense of national security, it still targets immigrants and refugees. It leaves the door open for even further restrictions, he said. On Thursday, Washington, Oregon and New York announced theyll challenge Trumps ban. Other states may follow - Minnesota next, according to NY Attorney General Eric Schneiderman, adding: While the White House may have made changes to the ban, the intent to discriminate against Muslims remains clear. This doesnt just harm the families caught in the chaos of President Trumps draconian policies. Its diametrically opposed to our values, and makes us less safe. His ban is illegal, violat(ing) the Equal Protection Clause and Establishment Clause of the United States Constitution, Schneiderman stressed. Washington Attorney General Bob Ferguson said his earlier obtained court-ordered temporary restraining order (TRO) remains in effect, adding: Were not going to be bullied by threats and actions by the federal government. According to ACLU Immigrants Rights Project attorney Omar Jadwat, Trumps scaled-back (ban) shares the same fatal flaws as his initial one. Changes he made and everything weve learned since the original ban rolled out, completely undermine the bogus national security justifications the president has tried to hide behind and only strengthen the case against his unconstitutional executive orders. The only way to fix his ban is by rescinding it, he added. The new travel ban suspends for 90 days entry of certain (undefined) aliens from Iran, Iraq, Libya, Somalia, Sudan, Syria and Yemen. Iraq is a special case, his order saying (d)ecisions about issuance of visas or granting admission to Iraqi nationals should be subjected to additional scrutiny to determine if applicants have connections with ISIS or other terrorist organizations, or otherwise pose a risk to either national security or public safety. Unlike the other designated countries, Iraqi nationals will be allowed into America, providing vetting indicates they pose no risk. The US Refugee Admissions Program (USRAP) is suspended for 120 days, pending review of screening and vetting procedures for individuals seeking entry. A maximum of 50,000 refugees will be allowed in this year. US imperial wars created the severest refugee crisis since WW II. Washington compounded the misery of millions affected by refusing to help them in need. If Trumps order is again struck down at the district and appeals court levels in one or more states, its unclear what hell do next. He never should have banned entry into America for Muslims from anywhere - on the phony pretext of border control and keeping the nation safe. Stephen Lendman lives in Chicago.
