Wisconsin Judge Rules Against Trumps Travel Ban by Stephen Lendman
On Friday, federal District Court Judge William Conley issued a temporary restraining order (TRO) for the wife and child of a Syrian refugee, living in America since 2014.
His ruling applies only to them, but opens the door to similar ones, potentially nationwide, along with other efforts to get Trumps travel ban judicially overturned, one state at a time.
Names of the individuals involved in the Wisconsin case are unreported to protect their identities for obvious reasons - given disturbing Islamophobia in America.
The plaintiff is a Sunni Syrian Muslim, given refugee status in America over two years ago. He got asylum status for his wife and child, their travel here blocked by Trumps original January 27 ban.
In his ruling, Conley said (t)he court appreciates that there may be important differences between the original executive order, and the revised executive order.
As the order applies to the plaintiff here, however, the court finds his claims have at least some chance of prevailing for the reasons articulated by other courts."
The plaintiff presented some likelihood of success on the merits of his claim about his wife and child likely facing significant risk of irreparable harm if unable to leave Syria.
Last Thursday, Washington, Oregon and New York followed Hawaii, saying theyre suing to overturn Trumps travel ban.
New York Attorney General Eric Schneiderman said the intent to discriminate against Muslims remains clear. The ban illegally violates the Equal Protection Clause and Establishment Clause of the United States Constitution, he stressed.
Washington state intends challenging it judicially, Governor Jay Inslee, calling Trumps revised ban mean-spirited, warranting continued resistance. AG Bob Ferguson asked federal District Court Judge James Robart to extend his earlier TRO.
Other states intending their own suits include Maryland, Massachusetts and Minnesota.
Others filing briefs of support include California, Connecticut, Delaware, Illinois, Iowa, Maine, New Mexico, Pennsylvania, Rhode Island, Vermont and Virginia, perhaps more to follow.
A battle royal is underway to reverse Trumps travel ban. Round one succeeded. Round two just began.
If again succeeds, will Trump risk a third defeat? His hardline domestic and geopolitical agenda so far should scare everyone.
The problem in America is both wings of duopoly governance support policies serving privileged interests at the expense of most others.
If not Trump, theyd be someone else doing enormous harm to so many at home and abroad - a deplorable situation elections cant fix.
