Judicial Watch News Update

March 10, 2006

From the Desk of Judicial Watch Director of Investigations Chris Farrell:

Dear Friends and Supporters:

Tom Fitton is out of the office for a few days.  I’m very pleased to have the opportunity this week to give you a brief update on some of our work.  A huge part of our mission is promoting transparency in government and educating the public about the decisions and activities of their “trusted servants.”

U.S Government Statistics Reveal Stark Realities of Illegal Immigration

Four years after our original request, the Customs and Immigration Service has finally produced a stack of statistical reports painting a vivid and disturbing picture of the crisis on our southern border.  Here are a couple of extracts that will give you some appreciation for the scale of the problem we face as a nation.  As you review the numbers, remember that the Border Patrol (and INS/ICE) interdict only a very small portion of the total number of illegal aliens entering the country.  To those of you who may feel we are picking on Mexico or Mexican people – we are NOT.  These are U.S. government figures – they speak for themselves.

Deportable Aliens Identified/Located by US Immigration Officials

                   Total for All Countries          Mexicans

1993             1,327,259                    1,269,294  (95.6%)

1994             1,094,717                    1,040,302  (95%)

1995             1,394,560                    1,340,458  (96.1%)

1996             1,694,986                    1,598,016  (96.8%)

1997             1,536,520                    1,478,782  (96.2%)

1998             1,679,439                    1,614,308  (96.1%)

1999             1,714,035                    1,634,055  (95.3%)

2000             1,814,729                    1,744,304  (96.1%)

Aliens Removed By Criminal Status by US Immigration Officials

                   Total for All Countries          Mexicans

1993                  27,827                   19,582  (70.3%)

1994                  30,158                   21,869  (72.5%)

1995                  31,631                   24,926  (78.8%)

1996                  36,203                   28,943  (79.9%)

1997                  49,768                   40,950  (82.2%)

1998                  60,681                   47,712  (78.6%)

1999                  69,687                   54,759  (78.5%)

2000                  71,028                   56,095  (78.9%)

Our southern border remains wide open.  There’s been a lot of hot air from President Bush and Homeland Security Secretary Chertoff on securing our borders – but both men have been recklessly derelict in unevenly administering a schizophrenic policy that places American citizens and law enforcement officials at risk day after day after day.

Judicial Watch Files Motion in Day Laborer Site Lawsuit

On March 3, Judicial Watch filed a motion with the Circuit Court for the County of Fairfax in its continuing legal battle to shut down a day laborer site for illegal aliens in Herndon, Virginia.  Judicial Watch crafted the motion in response to a February 10, 2006 “opinion letter” from Judge Kathleen MacKay which seemed to issue preliminary rulings on some legal issues, while seeking clarification on others.  The good news is that Judge MacKay rejected a “demurrer” filed by the Town of Herndon to dismiss the case, ruling that Judicial Watch does indeed have standing to bring the lawsuit on behalf of taxpayers from the Town of Herndon and Fairfax County.

In terms of the other legal issues, I don’t have the space here to get into the gritty details.  I do encourage you, though, to read Judge MacKay’s letter and Judicial Watch’s response.  And for an excellent summary of Judicial Watch’s arguments, you may want to read through the transcript of oral arguments made before the court on December 16, 2006.  You can see for yourself how effectively former Virginia Solicitor General William Hurd argued on behalf of Judicial Watch and its clients.

This is just one avenue we’re pursuing in our overall campaign to enforce our nation’s immigration laws.  In the next few weeks, we’ll be telling you about some exciting new projects we’ve been working on.  Stay tuned…

JW Obtains Video of Dramatic Car Chase on U.S.-Mexico Border

Staying with the topic of illegal immigration, a few weeks ago, Tom told you about an alleged dangerous confrontation between U.S. Border Patrol and heavily armed members of the Mexican military who were helping drug smugglers make their way back across the border into Mexico.  In testimony before the House of Representative’s Committee on Homeland Security on February 8, Deputy Sherriff Esequiel Legarreta of Hudspeth County, Texas recalled the incident in detail.  He also showed a video shot from the dashboard of a Texas Department of Safety patrol car involved in a high-speed chase.  Judicial Watch immediately filed a Texas public records request and obtained the video.

While the tape doesn’t conclusively reveal the involvement of the Mexican military, it does show how dangerous the border has become.  The patrol car follows a black Ford Escalade believed to be carting drugs as it attempts to flee across the border at speeds exceeding 100 m.p.h.  At one point, the tire blows out and the driver abandons the vehicle, disappearing over the fence and into the thick brush on the Mexico side of the border.  Another car involved in the chase, a grey Toyota Four Runner, blows past the patrol car on its way across the Rio Grande river and into Mexico under the cover of “military uniformed individuals.”  According to Legarretta’s testimony, a third car, a blue Ford Expedition not captured on the video, got stuck in the river behind the Four Runner.  After their contraband was offloaded, an “unknown subject” intentionally set the car on fire.

Shortly, we plan to upload the video onto our website.  Look for it early next week on http://www.judicialwatch.org.  Judicial Watch is continuing to pursue other video evidence that reportedly shows the Mexican military humvees and soldiers involved in the incident.

Hillary Locks-up Funding for ’08 Presidential Bid

We’ve pursued justice for the criminal enterprise known as the Clinton White House for more than 11 years now – with some remarkable successes – especially given the Bush administration’s penchant for running legal interference for the Clintons and their use of taxpayer dollars and resources to vigorously defend “Bill & Hill.”  Nonetheless, our work product resulted in Hillary’s campaign being fined by the Federal Election Commission for violation of reporting laws.

Several news reports in the last week have detailed Hillary’s efforts to “wrap-up” major Democratic donors now – committing them to fund her ’08 presidential bid – while still going through the motions of campaigning for (a nearly certain) re-election to her New York senate seat in November ’06.  According to Democratic insiders, these fundraising practices have created a great deal of friction within the party, setting Chairman Howard Dean against Hillary and her operatives – Clinton White House veterans Harold Ickes and Capricia Marshall.

We’ll be watching very carefully to make sure none of the illegal campaign contribution practices of the past resurface:  the shakedowns, sweetheart deals, influencing peddling, straw donors and “cash for policy” rackets that were the hallmark of Bill Clinton’s administration.  We’re committed to rooting out the truth.

Until next week…

Chris Farrell
Director of Investigations
