Witnesses denied she was aggressor; internal investigation continuing

09:38 PM CST on Thursday, March 16, 2006

By ROBERT THARP / The Dallas Morning News

A Dallas Roller Derby skater was indicted Thursday on a felony charge of assaulting a Dallas police officer stemming from a January incident in which she and several witnesses say the officer was the aggressor and used excessive force.

Reports related to the indictment charge that Michelle Metzinger, 25, was belligerent and fought with Officer Ceaphus Gordon after the officer asked to see her identification because, he said, she had been roller skating recklessly through traffic on Elm Street in Deep Ellum.

Michelle Metzinger

According to Officer Gordon's report, Ms. Metzinger tried to gouge his eye with her fingers when he tried to handcuff and arrest her on a charge of public intoxication.

The officer then tried to force Ms. Metzinger to the sidewalk using a "straight arm bar take down," but instead, she "rolled from the police car to the ground," his report says. Ms. Metzinger continued scratching and kicking the officer on the ground, the report says.

Officer Gordon described his injuries as three 1/8th-inch scratches near his right eye and scratches and bruises on his chin.

He described Ms. Metzinger's injury as a "small laceration that required a stitch," although his report indicates that she spent five hours at Parkland Memorial Hospital before she was taken to jail.

Kevin Clancy, Ms. Metzinger's attorney, said he was disappointed that he was not allowed to present evidence to the grand jury that would have offered a different account of what happened.

Eight witnesses to the arrest have filed affidavits saying that Ms. Metzinger was not intoxicated and that she did not resist the officer.

The witnesses state that after Ms. Metzinger was forced to the ground, Officer Gordon put his knee on her back or neck while he was handcuffing her, which is not described in the officer's reports.

"I think it's a travesty that this poor girl was charged with this," Mr. Clancy said. "I really do think that the grand jury did not look at the evidence."

A separate investigation into the incident by Dallas police internal affairs is ongoing.

Mr. Clancy said Dallas police have so far not interviewed any of the witnesses.

Officer Gordon has had 27 complaints filed against him in his 14-year career, most of which were ruled "unfounded" or "inconclusive." Of those inconclusive complaints, at least two involved allegations of excessive force.

Nobody gets 27 complaints and is innocent of all of them. "Ceaphus," I guarantee you, has an IQ of less than 100, and cannot understand that sooner or later that fact will (and probably has) catch up with him.

This should have been expected since those rats there needed to cover their asses. Clancy should know that the Grand Jury has become a tool of immoral prosecutors to initiate malicious prosecutions by manipulating evidence. It is no surprise that there was no evidence presented contrary to what the wished for outcome was to be. Clancy had better be a damn good trial attorney.

Even juries at a trial are no longer one's peers. They are the peers of the system and seldom carry out justice in questionable incidents. This is true because people are no longer educated in truth and law themselves. We, as a nation and a people have, for the most part, lost our moral compass. The mass indoctrination of the lamestream media keeps the status quo in favor of the pludering usurpers who have stolen our birthright of liberty. This was never possible when people were well read and the media was independent, not as it is now, controlled by a handful of corporations.

I would say that when the preponderance of evidence is presented, these charges will be beaten. Eight witnesses is hard to beat and those pimp prosecutors will have their work cut out for them trying to protect that whore Ceaphus Gordon.

I would love to be in the public gallery to report on the upcoming civil suit to be filed against the creeps.

If Michelle had good assistance of counsel, she would immediately have filed a Title 42 suit combined with RICO under Title 18 in federal court. That would cost the city at least $20,000 to have the shysters respond to it. ;0)

No shock that the GJ found for the state. It's a rubber stamp. Have I missed something regarding the public intox charge? What was her blood alcohol level? Was a test taken in the hosp as she was being stitched up? With any type of representation, she walks, but who knows? Juries are comprised of people who live in, and around us. I don't know about Texas, but in Indiana, no evidence is required for public intox charges to be filed other than a cop's say-so that a person is "on something."

Quite an article, GJ. I'm not surprised at all. I had no experience with the lab testing, but it's my experience that people looking to fill these positions couldn't cut it in the real world. IOW, these labs are staffed by minimially qualified people which works well for the state. One thing: have all your paperwork and DL ready to hand out the window immediately. I can't tell you how important it is to get the sob's away from you as quickly as possible.

No, you've missed nothing as far as I know.

I'm looking for those charges and evidence as well. The court records still don't show anything about Michelle - zip, nada, zilch. It does take a few days, perhaps next week the full indictment & charges against her can be retrieved.

I can't imagine them proceeding on a charge of assaulting a LEO stemming from a PI arrest, without proof of PI, and yet there is *no* mention anywhere of a DUI/ BAC test even being administered let alone the results.

I would have assumed urine or blood samples would have been taken at the scene or the hospital, but there is no mention, yet.

From what Esso says above, it might be enough that the officer "observes" PI. If that's true, we're further down the slippery slope than I thought.

That would be a troubling legal-limbo nowhere land.

If the officer's mere "observation" is legally sufficient to support arrest, then it all lies within the officers discretion, and false arrest can not be proven. The officer can always say "Hey, she looked drunk in my professional opinion. How was I to know she was just dizzy from lack of food & rest?". But if the 'victim' then resists arrest in any way, then resisting arrest can be sustained without any need to prove any crime was ever committed. And resisting arrest is another easy charge to sustain especially when there are no cameras rolling to record how an incident started and escalated.

Arguably, that seems like the kind of lawful harassment reserved (til now?) for parollees.

Perfect cover for an officer who otherwise "has been disciplined twice for escalating or participating in a disturbance and once for conduct discrediting the department", as reported elsewhere.

It is my experiance that it is better to give them an option. When pulled for speeding tell them you don't have your DL or Reg with you, much more often than not they will choose to exert their authority by ticketing you for failure to display (no points) rather than speeding. It lets them claim to be a nice guy while breaking it off in you.

Another added benifit is it keeps you from having to reach into the glove box or god forbid, under the seat.

Peace

I've never heard of a test being administered for PI, lower burden of proof, likely no BAC in statute, hence none needed.

Testimony goes like this, (all lawyers know it by heart) "Subject was disoriented displayed slurred speech, bloodshot eyes and had a strong odor of alchohol on her breath" guilty, next case.

Don't ask me how I know.

I have an inner ear problem, so a slight nystagmus might be noted by some hot shot. But as your link indicates, nystagmus is a condition brought on by countless meds/reasons. Another thing, cops do OK with basic first aid, but to base an arrest on a physical response (nystagmus) to rudimentary field test, is bogus. My ENT specialist does quite a bit to elicit this response.

But I keep forgetting what this country has become.

Michelle's needed more than one stitch - she had a chipped tooth and is going to a chiropracter because that idiot put his weight on her neck and back during his violent arrest. Where are HIS witnesses...certainly not the other officer in the car who was using a radio and couldn't see what was happening because the police car door was conveniently shut. I don't understand why the charge went further before the police bothered to interview the witnesses...and before they had conducted their internal investigation! how can Ceaphus Gordon possibly claim she was assaulting him like he says when the photographic evidence clearly show she had only one hand free during the whole sorry incident because she was holding onto her ACD leaflets all the time even when he knocked her to the ground? This pathetic, incompetent, sorry excuse for a policeman is bringing his employers and colleagues into professional disrepute by losing his self-control. how DARE he assault a woman like that and pretend he is upholding the law - he may be employed as a policeman but he is a BULLY and a dishonourable COWARD for hiding behind his uniform. he disgusts me and if i was his mother i would be ashamed to call him my son :(

ohh i hope you are right, i really do but why should Michelle's life be so disrupted because of his unprofessional behaviour? i don't like the stuff elsewhere about her being white and him being black etc - that's got nothing to do with justice and everything to do with ignorance as far as i'm concerned. this is about a large man using his superior weight and strength and his position as a policeman to attack and hurt a smaller woman...and then having the spineless bad grace to blame it on his victim! i hope he isn't married because i'd be worried for the safety of his wife :( how can his colleagues bear to work with somebody who stoops so low?

in the case of a rogue policeman, it isn't just the public that suffers - the reputation of his colleagues and his employers is damaged. and the politicians in charge of the police are also tarnished if they take no action. for goodness sake, this is about upholding the law and standards of professional conduct. Ceaphus Gordon should be suspended while a disciplinary investigation looks into his actions. if he has acted beyond what his employers require, he should face the consequences like a man and accept the consequences.

but i'm not sure that he knows about honour and professionalism - so far he has behaved like a bully and a coward...and those who cover for him deserve the same contempt :(

I hear you, but here’s the city’s dilemma. Do they suspend CG, thus admitting he performed wrongly, or roll the dice with a rubber stamp grand jury and a trial? If they suspend him, Michelle has a solid start to a civil case with a large punitive award. OTOH, if they roll the dice as they are, the grand jury will indict (it did and normally does). Now Michelle is forced to hire representation and go through all the possible mind games that the system will toss her way. IMO, what the city is hoping for is for Michelle to take a lesser plea, thereby avoiding trial and possible prison time. These are the facts of life, and they aren’t about right or wrong. The system really, really sucks.

But we're all on something, be it legal or not. Two Red Bulls could set off one of these uber-officers today. Nothing short of rope will fix this mess.

I'm high on life! And a Red Bull will do the trick with a couple of one of the many types of energy capsules when you got to be jacked up.

The rope is my department. ;0)

He handled it wrong. Had it been me, I'd have waved her over and said "Hey darlin'..I really don't want to see a beautiful woman smashed up by any cars..could you please keep it on the sidewalk? And BTW, would you like to have dinner sometime? ;-) What you're a roller derby babe? Could I have your autograph?" ...and that's how I did my job.
Besides, I hated paperwork. Stupid arrests mean paperwork. What a waste of time this was...besides...who ISN'T drunk in Deep Ellum? She had the smarts to skate instead of drive even!! Sheesh..

Indie, the guy has NO bedside manner, or any manners at all it would seem. These lunkheads are nothing more than Neanderthal throwbacks (and that might be an insult to the Neanderthal).

A little finesse goes a long way. And besides, they are out there IN PUBLIC, not at all like I was when doing the concert security gig in a private setting which was under contract when a patron purchased a ticket.

These thugs need to be put under a microscope and the disinfectant of sunlight made to shine brightly upon them. This would destroy them just as surely as sunlight destroys a vampire. These quasi-criminals who operate under color of law and color of office are a blight upon the body politic and need to be cut away just as a cancer is cut from the flesh.

What troubles me is that the system is in the process of railroading a kid because some oaf in blue was having a bad night. That phony tacked on “assault” charge is so over the top. The guy was huge and the kid was tiny, female and on fucking roller skates. Cut me a break. My guess? This case gets tossed and Michelle becomes Deep Ellum’s newest member of the millionaire club.

We need the Phineas Priesthood to make a comeback.

The link goes to a google search. You can see that the usual "hate" groups are harping about this. This tells me that they are deathly afraid of this Christian ideal of times gone by.

And then there is the power of imprecatory prayer, which is essentially a prayer for evil to befall your adversaries and enemies.

I tried this once on El Pee and it scared hell out of the bots. They just would not touch it.

The Bible does call for "stoning" as a penalty for treason. Who is to say that the stones could not be made of lead? A firing squad would be in order. Also, the rope is in line with this as a hanging is what is the penalty in the statutes for treason.

I think they cooked these charges up because these photos are all over the web. What they seem to have forgotten, is their comparative sizes, as you mention, and the precarious footing that even a competent skater has.

That the same officer has priors makes this only worse for the city, which will stand behind him, because settling a lawsuit will be expensive and controversial.

And just wait until troops from Iraq return and take jobs in law enforcement.

I’d bet the farm on two things regarding this matter;

1) The cop wasn’t assaulted, and
2) the police officer has a previous history of assault, not Michelle.

I wish there were still investigative reporters working for our local fish wraps (Jimmy Breslin and Pete Hamill were wonderful in NYC). This tacked on “assault” charge is SOP in these matters. The number of times it's added to a routine arrest would make for a wonderful series of articles. Given the disparity in their size and armament, to think that she assaulted him is laughable.

Officer Gordon has had 27 complaints filed against him in his 14-year career, most of which were ruled "unfounded" or "inconclusive." Of those inconclusive complaints, at least two involved allegations of excessive force.

Last paragraph of this article.

So that's app. one complaint every six months (that we know of - many aren't reported) for the past 14 years. Officer Gordon is trouble with a capital T. Oh, btw, disregard most of the dismissed charges. Those internal investigations are user friendly.

ok, here's the enhanced images again. i added the EXIF date & time at the top and notes that i thought might be relevant. the photos were enhanced using irfanview and psp7. the last picture comes from http://www.helpmichelle.org and had no EXIF data. i don't know if there are any other pictures available that can be tied in with these.

even the first picture is interesting - Michelle standing with both hands on the car, looking in the direction of a witness across the road. she is using her right skate to steady herself and seems in a relaxed state. we can't see her left hand because of the wing mirror but i suspect it is holding her ACD promotional leaflets (more on these later). Also on the front of the police car is what looks like a folder or document holder - presumably belonging to the police. The passenger's car door is fully open. in this shot, we do not see any police.

the time is 00:30:59...

the time is 1 minute 24 seconds later. the police car door is shut. the driver can only see Officer Gordon's head. note the cycle is not parked at the front of the car - there may have been no police witnesses to what happened during the last 1 minute & 24 seconds...

michelle is holding the ACD leaflets in her left hand which is above her head. Officer Gordon is using both hands to cuff her right hand. his right foot is outstretched for balance. his left knee is pressed against Michelle's left cheek and her neck, twisting her head to the right and forcing it against the ground. there are at least 4 witnesses - the photographer, the 2 men on the road, the man holding the red flag.

this picture was found on the http://www.helpmichelle.org site. there was no EXIF data so i don't know which camera it came from. it gives a different angle to the last one and shows the driver of the police car using a radio and looking through the passenger door window. however, the height of the door sill prevents the driver from seeing what is happening on the ground. we can clearly see Michelle's left fingers clutching on to the ACD leaflets, protecting them from harm. Officer Gordon is only using his left hand to hold Michelle's right wrist. his right hand is by his right hip. we can clearly see his left knee and shin are pressing down on Michelle at the position of her head and neck. in neither this frame (which may be a few seconds before the last one) nor the previous frame does he appear to be anything but in complete control - he does not appear to be recovering his balance or disentangling himself from a fall.

31 seconds later...

Michelle has lost hold of her ACD leaflets which are strewn on the ground. Officer Gordon has turned her over face down and is kneeling with his right knee on her back. he is holding the cuffs in his right hand, and his left hand is pressing her down at the position of her neck. we can see in this shot that the bulk of his weight is taken by the right knee and left hand. there is no blood evident in this picture, it is possible that this is the point when her chin was cut on the ground.

the later pictures show a distressed Michelle, bleeding profusely from her wound, a policeman wearing a cycle helmet who is not apparently present at the time of the "assault", and various witnesses incuding Michelle's fellow skater. i can post the enhanced versions if people want but the last 4 are the most important imho. ruthie

Unreal..

I wouldn't infer too much from that at present. That could play to Michelle's benefit as well as the prosecution until such time as Michelle is allowed to present her evidence. IIRC, Michelle was not permitted to present evidence to the grand jury, which is not surprisng either.

So if, as is likely at present, it is just the one-sided prosecution's allegations on file, there is little benefit for Michelle to have those unsubstantiated and unrefuted charges 'broadcast'.

OTOH, nothing prevents the press and blogosphere from digging and discussing what appears to be excessive police force, and maybe even a trumped up PI allegation. The recent 'PI raids' in Deep Ellum may be an attempt to buttress prosecution arguments of an ongoing problem in Deep Ellum: in which Officer Gordon observed Metzinger to be contributing a couple months back, yada yada yada... (as I envision the prosecution argueing).

Go to:

http://freedom4um.com/cgi-bin/setupping.cgi?

Note as you scroll down the list you can see all the current defined ping lists. Note the names and the descriptions folks have used.

At the bottom (Create New Ping List:) are fields where you can fill in to create a new ping list.

Pick a name (like "Metzinger News" or "Skategate" or "Roller Derby Girl") whatever apeals to you and Michelle, fill in a description of what the list is for ("news about excessive police force and charges against Michelle Metzinger" or whatever you feel is best).

Hit save. Voila' :)

You become the owner of the list, giving you authority to add co-owners (who can then also ping the list members), or you can also change the name of the list and it's description later.

When you make a post of an article or a comment, your new ping list will appear in the drop down menu, and if you select it then everyone who subscribes to your ping list will see the new entry without you having to remember and type in (with correct spelling) their names. Anyone you make as a co-owner can then do the same.

They sure would. If they can show that PI is a problem in Deep Ellum and Michelle was part of the problem, it may help them get a conviction which in turn helps them defend against a civil suit which could cost them a lot of money and bad PR.

Deep Ellum does seem to have a PI problem. Was Michelle part of it? Don't know. Her witnesses say she wasn't. But would Dallas conduct a few PI raids to save a couple million bucks? Yep.

how is Public Intoxication measured btw - is it by blood or urine tests...or just the opinion of a police officer?

Don't know. We've kicked that around a little. Maybe some others can dig out the facts of what proof is required of PI in Dallas?

I copied the following from Cyerbina's website at http://cyberina.livejournal.com/518608.html?view=1715664#t1715664

As far as what can be accurately assessed by those pictures? I've discussed it in detail with my boyfriend, who has been trained and licensed as a police officer in Texas. Allow me to point out a few items:

*** Many suggested that the girl mouthed off to the officer. In the state of Texas, any officer of the law cannot legally respond in any way, shape, or form to any verbal insults. While I wouldn't suggest it, you can tell off a cop in any manner at any time without legal repurcussion.

*** Someone suggested her face was possibly bloodied by her falling on her rollerskates. First, I would like to point out (even though you can't see them now) that the place where her face was against the pavement when he was using his knee to pin her down by her neck is the exact same place that was bloodied in the following photographs. It is quite possible that she got on the ground in the first place by falling, though. It is still unforgivable that, as you could clearly see in the picture, he held her down by the neck with his knee. I know 100%, beyond a shadow of a doubt that the officer most definitely received detailed lecture and hands-on training in a multitude of more humane and more effective methods of restraining and cuffing her. In fact, he received specific training on how NOT to handle her as well.

*** Someone suggested the roller girl clawed at the officer. Who knows was form of resistance she gave? What I do know, though, is that an officer is only legally allowed to exact equal force, and only the force necessary to undertake the arrest. The officer was easily twice the size of the rollergirl. Pinner down her torso by her neck was certainly not equal force, nor was it a necessary move to detain her. Hello officer? Here's a tip: She's face down on the pavement. Sit on her legs instead of her neck, and bring her arms behind her back. Her muscular force cannot match your resistance. I promise.

*** By all accounts of the incident, there were a very large number of officers present on the scene. Police are trained to, when necessary, use as many officers as possible to detain an arestee. Cases of police brutality most commonly occur when one officer has to do too much to detain someone. Two officers can more easily detain an arestee with far less risk of anyone getting hurt. If she was truly putting up a big fight for a little girl, more than one of those present officers should have pitched in to detain her.

I also left a post there asking if her boy friend might either there (or here) post an explanation of how Public Intoxication is determined in Dallas/Deep Ellum.

Otherwise, kindly note ruthie has setup a *Muff Thumper News* ping list, if you wish to subscribe. I'll not be pinging individuals further.

Officials Make Public Intoxication Arrests Inside Bars

POSTED: 4:04 pm CST March 15, 2006 IRVING, Texas -- The Texas Alcoholic Beverage Commission has taken its fight against drunken driving to a new level. TABC agents, along with Irving police, targeted 36 bars and clubs Friday, arresting some allegedly intoxicated patrons before they departed the businesses.

The officers and agents also kept watch on bartenders who might have over-served patrons.

Agents arrested 30 people Friday night. Most of the suspects now face charges of public intoxication.

The agents and Irving police officers traveled from bar to bar and worked undercover, according to an NBC 5 report.

The report also said that some agents shared tables with suspected drunken patrons. Some patrons were subjected to field sobriety tests inside bars.

Agents and officers said the operation represented an effort to reduce drunken driving.

Sgt. Chris Hamilton, of the TABC, said some inebriated bar patrons "end up killing themselves or someone else" after departing the businesses.

Bar Sweep Sparks Controversy

Comedian Weighs In On Public Intoxication Arrests

POSTED: 3:59 pm CST March 21, 2006 FORT WORTH, Texas -- The Texas Alcoholic Beverage Commission sent a message to bar patrons last week.

TABC agents and Irving police swept through 36 Irving bars and arrested about 30 people on charges of public intoxication. Agency representatives say the move came as a proactive measure to curtail drunken driving.

North Texans interviewed by NBC 5, however, worried that the sweep went too far.

At one location, for example, agents and police arrested patrons of a hotel bar. Some of the suspects said they were registered at the hotel and had no intention of driving. Arresting authorities said the patrons were a danger to themselves and others.

"Going to a bar is not an opportunity to go get drunk," TABC Capt. David Alexander said. "It's to have a good time but not to get drunk."

Dallas comedian Steve Harvey agreed with the Texas residents who said the arrests infringed on individual rights.

"If a guy's got a designated driver, go ahead and let him get toasted," Harvey told NBC 5.

Texas law states that inebriated individuals could be subjected to arrest anywhere for public intoxication. Harvey and other North Texans called the measure extreme.

"That seems to be an extreme case," one man said. "You are self-contained, in the hotel, you're not going in the streets, it seems a little ridiculous."

TABC officials said the sweep concerned saving lives, not individual rights. Harvey and others interviewed by NBC 5 said they believe drunken driving to be unacceptable, although Harvey wanted to confirm that the United States remains a free country.

"Freedom of drinking should always be allowed, and it is only American to let a guy get drunk where he wants to get drunk," Harvey said.

Lawmakers To Review Bar Busts

Program Results In 2,200 Arrests

POSTED: 6:35 pm CST March 25, 2006 UPDATED: 9:48 am CST March 27, 2006 AUSTIN -- Lawmakers plan to review a state drinking crackdown that uses undercover agents to arrest drunk people in bars.

The Texas Alcoholic Beverage Commission program, designed to stem public intoxication and drunken driving, has resulted in more than 2,200 arrests or citations since it began in August.

But the program has been criticized after news reports following the most recent busts, at 30 Dallas-area bars this month.

"I'm getting all those same e-mails, the Nazi, Taliban, Gestapo e-mails," said commission spokeswoman Carolyn Beck. "I don't really understand the hateful outrage. I don't understand, 'Die in a fire.' "

Legislators who oversee the commission said they agree with the emphasis on public safety, but the program should be reviewed to check for abuses and to measure its effectiveness.

"Somebody hanging around the hotel, a little stumbling on the way to their room? I don't think that was what we were focusing on," said Rep. Peggy Hamric, R- Houston, who authored a proposed rewrite of the statute authorizing the agency.

Rep. Kino Flores, chairman of the House Licensing and Administrative Procedures, said he plans to call a meeting next month to examine the commission's work.

"We're looking at it and we're going to be looking at it: Are we going too far, or do we need to go further?" the Mission Democrat said.

Sen. John Whitmire, a Houston Democrat and member of both the powerful Senate Finance Committee and the Criminal Justice Committee that oversees the commission, defended the principle of in-bar citations.

"Even though a public drunk is not planning on driving, that could change in an instant," he said. "There is certainly potential danger."

According to the Mothers Against Drunk Driving Web site, Texas had 1,264 alcohol-related traffic fatalities in 2004, the most in the nation.

The commission also points out that being drunk in public, even in a place licensed to sell alcohol, is against the law.

"We can't ignore somebody who's obviously breaking the law," Beck said.

In Texas, the blood alcohol limit for drunken driving is .08. But the law defines public intoxication as "not having the normal use of mental or physical faculties." Public intoxication is a Class C misdemeanor punishable by a fine of up to $500. An offender can be cited or arrested.

Under the state program, bar patrons may be approached if an officer spots them behaving erratically. The officer will perform a field sobriety test similar to one for drunken drivers. A suspect may also be asked to take a breath test, although it is not required, Beck said.

While Whitmore supports the safety aspect of the program, he also said lawmakers should examine whether the agency, which is funded by fees it collects, is motivated to stricter enforcement by fiscal concerns.

Sen. Chris Harris, a Republican whose district includes Irving, called the recent arrests in his area "very questionable."

"At first, I was generally totally in agreement with them," he said. "But there are too many stories that demonstrate an abuse of power."

One minor glitch, the aspect ratio is wrong, in post #59 the parameters should be width=600 height=615. It looks like they were entered wrong.

Also, looks like in post #60 they should be width=600 height=445

I've got the images on this thread adjusted.

Auto adjusting the image sizes is problematic because the images are never seen by the web server. They originate from the original web source and get xferred directly to the users browser, so the server never has a change to find out how big images are. Maybe there's a way around that, though but it's not simple.

But I could put some kind of a tool on the posting page that would aid it letting users set the image dimensions if they feel it's called for. I don't know of any HTML code that simply sets a maximum size for an image, which would be quite handy. It's either let it be the natural size of the image or force it to some specific size.

I'm open to ideas.

Well, not quite yet.

The 1st two photo's and the last photo are now perfect.

But the photo in post #61 is still incorrect. It still has two typo's in it.

1) above the photo is a spurious & #034; width=>< /a> which needs to be cut out.

2) the width & height values are in quotes
height=& #034;575& #034; width=& #034;450& #034;

and simply needs to be replaced with

width=750 height=565
(exactly as shown without quotes)

Got it. Not sure how I messed that up.

One possible way to deal with big graphics is to put an image form on the post comment/article page. If an image is too big, you could type/paste the url into a tiny form and click a button, and it would show a popup box that would display the HTML to paste into the comment/article to reduce the image size, perhaps in the form you (Star) came up with where you can click to see the full size image. Default dimensions could be displayed and readily changed by the poster. It would still require some care by posters to do it right, and might be confusing to the less adept, but it would at least offer a solution.

Using percentages instead of absolute pixel counts can be handy, but when applied to many graphics can cause it to lose sharpness.

It's possible that javascript could measure an image size (I'm not sure what js can do) and aid in the posting process, but I hesitate to use js since it may not run the same on macs, linux or PC's. Maybe things are a bit more uniform js than they used to be, but there used to be compatibility headaches in trying to use js with many different browsers and Operating systems.

How's it now? Fixed?

Starwind, there was a separate problem with your post #94 having nothing to do with the wide images. I saw on the full sized "Brushed" look that there was some L/R scrolling, and it was apparently tied to the contents of the "pre" tag in your post 94. A few of the lines had a goodly number of trailing spaces which the browser made room for. I also took out one of the two pair of blockquote tags as it seems the bolded text inside the "pre" tags was forcing extra width.

Might be tied to the style sheet of the 100% brushed look, but just fyi. (Not a common enough problem to worry about perhaps... all considered).

I did notice the formatting at the source link in that post was a mite hosed (wrapped lines and maybe some indentation tabs) but didn't notice the effect as I assumed all was due to the wide photos.

I'll never forget the first time we were pregnant! I got to rub mommy down every day with Mother's Friend, and the baby got so used to me talking, singing and laughing while oiling mommy's skin that after his birth we were best friends as soon as things quieted down and he figured out who was who! And, he went everywhere with me for the next 15 years until he learned about girls.

And with our second, mommy and daughter both just kicked back and really enjoyed the attention! I think it's quite likely that my little girl was the happiest baby that ever spent over nine months in her mommy.

Yeah, my little girl didn't want to come out. And, within 20 minutes of her birth she was making sucking noises so loud that people were coming to investigate! She wasn't even nursing yet, she was just sucking air really loud!

i'm fine thanks - feeling fat, frumpy and frustrated (lol) but getting there. i'm not sure you can read too much into the one person thingy - it might have been to get people voting? anyway, it isn't really important...what's more important is demolishing any prosecution of Michelle and it would be VERY interesting to see how Officer Ceaphus Gordon and his colleagues coped under detailed cross-examination when we have the photos and the time duration to give accurate details. who, for example, is he going to get to corroborate his version? in fact, where was he at the time the first image was taken? which side of Michelle was he when she supposedly "attacked" him? his partner was apparently in the car...with the door shut and unable to see what his fine colleague was doing to the woman on the ground. the police cyclist parked his bicycle at the front of the police car AFTER Michelle was cuffed and sitting crying on the ground, so he seems to have arrived after the event. the famous "Richard" has shown his bias in the previous threads and these can be held up against him as a credible, impartial witness (if indeed he exists or was even there).

then there is the disciplinary record of Ceaphus Gordon - it would be really REALLY interesting to get more details on his background aired in a court. is his departmental record in the public domain? who released the details of his disciplinary file - the police??? or has he got police colleagues who are so disgusted that they want him disgraced and removed from duty?

Been there sweetie more than once!! Hormonal and uncomfortable but at the end a sweet little one. Some of my best times were when my children were just babes in arms.. (getting tad sentimental here! )

Agreed.. I'd like to know as well.. it would be most interesting. I still wonder what interest "Richard" who showed here in defense of the officer in fact had? The why is what makes me curious.. In my personal opinion I doubt seriously that in fact he was a witness..

BTW ruthie how did all this come to your interest? Considering you're far far from Deep Elam?

well...i used to skate and i was interested in how roller derby was coming back into fashion so i did a search and ended up with the pictures of Michelle.

then i suppose its just that i detest violence towards women and it didn't matter she was the other side of the world - she's a sister in trouble and my heart went out to her.

sounds a bit corny and not very clever but that's all i can think to say

...and yes, my hormones ARE a bit weird so maybe its a premature case of "feral mother syndrome" - you threaten MY baby, i threaten YOUR manhood! grrrrrrrrrrrrrrrr...

The officer's conduct is cowardly and disgusting.

Although the "conventional wisdom" is that comparing our society with that of Nazi Germany is baseless hyperbole ("Godwin's Law" and all that) I think the parallels are real and disturbing. Loser thugs taking advantage of their position to abuse anyone they want? Sounds kinda familiar to me.

yes. whether its part of a bigger problem or not about the rule of law etc, there is something utterly vile about a powerful man hurting a weaker woman and then blaming HER while hiding behind his uniform. but then again, he obviously has no honour and doesn't care about letting down his colleagues in the police either.

shame...

Yet another link shows quite clearly that if the police were the protectors of the people rather than enforcers of the system none of this type of thing would be happening.

Michelle's case is evidence that the system is out of control and has become nothing more than organized crime run by gangsters and thugs.

...or have i missed something obvious here? if Gordon HAS disregarded police procedures, can HE be charged with assault? how does it work in the US - can a citizen bring a criminal complaint to a court?

A citizen can bring suit under 42 USC 1983 which in effect makes everyone a citizen prosecutor.

It would also be a good idea to include Title 18 Racketeer Influenced and Corrupt Organizations (RICO) in the suit as well.

After all, we are now at the place where the government is criminal in nature and is running their own racket of unjust enrichement at the expense of the people they have sworn to serve and protect. This is clearly a breach of fiducuary duty and in violation of their oaths of office.

If Michelle has a good attorney they will pursue this for her. I'm sure there are people out there, and good lawyers also, who would be willing to step up to the plate on Michelle's behalf. This could be a big case.

Thanks, ruthie. This sounds a bit as we suspected would happen. Now, Michelle needs to turn this around on them. I hope her lawyer is on the ball enough to use this type of leverage in advance.

The cops use this tactic right away when they throw in an extra charge or two to make it all seem like a mountain has just landed on you, when in fact they are bluffing and have nothing. Michelle seems to be holding all of the cards right now.

interesting, isn't it? of course it could only be inefficiency or indifference but perhaps there's something embarrassing that the police chief might be uncomfortable about sharing....such as Ceaphus Gordon's appalling disciplinary record, or perhaps a lack of solid evidence to present before a court?

There are rogue cops to be found in many places. When it so happens that they find you, it could tend to cause a hurtful situation such as Michelle's. Many are not so lucky and wind up dead.

Not a thing, what was funny was "Richard" thought he was baiting white supremacists.

What a fascist thing to say. What the hell is wrong with you? If you're so "sick and tired" of drunks, why are you hanging out in Deep Ellum?

Dakmar,

Here is your first comment to me.

THIS is where our relationship began.

YOU attacked me from the very start.

Or do you call people "fascists" and ask them "what the hell is wrong with you" as terms of endearment?

ROFLMAO!

Care to try again, child?

no picture of the supposed wounds

If Israel can sue Lebanon for war losses, I guess the police can try and claim that a bruised, scraped, cut and bleeding, slender young woman on roller blades forced down onto the asphalt, managed to injure one of their large and overly aggressive cops.

I'm very happy that the state sees the wisdom of allowing the case against Michelle to collapse.

The lack of timely disclosure is enough to dismiss the case, and that is great news!

My best to Michelle.

hihi everybody and on michelle's behalf, thanks for the kind comments :) it seems very silly that she has been left to wait all this time and still not have a clear answer regarding the Police's internal investigation, or details of the case against her. one begins to wonder if they are trying to find a way out of this mess at all, or simply hoping that by dragging things out she will negotiate for a lesser conviction so they don't get humiliated in court (and sued). watch this space, fellow F4M-ers!

as to my domestic situation, well we have settled down into a routine where i run around after the 2 males in the household and they sort of co-operate in return lol - Michael is due his second op to correct the harelip but everything else is fine (including the volume in his lungs LOL).

all i know is what michelle told me and i know she is using the pictures as part of her defence. the intoxication charge was dropped so now she has to explain how she managed to brutally assault the poor policeman while on skates with one hand grasping some leaflets and her purse and both arms down on the front of his car. obviously she was so dangerous that the fine officer had to ignore the orders of the chief of police about choke holds and applying pressure to the neck of his vic...err i mean attacker (SORRY!)

Yep, can't have these hooligans on skates who are a danger to the fine men and women who run the police state wonderful towns, cities, counties and states that we all love, run loose and cause harm to our protectors. And of course it would be way tragic if she assaulted some federal goon agent. Just a tragedy.

WOOOOOOOHOOOOOO!!!!!!!!!!!!!!!!!!!!!!!!

Roller skater found not guilty of assaulting Dallas officer

Judge rules woman didn't attack official in Deep Ellum

08:03 PM CDT on Thursday, March 13, 2008

By JENNIFER EMILY / The Dallas Morning News jemily@dallasnews.com

A Dallas County judge on Thursday found a 27-year-old roller derby skater not guilty of assaulting a Dallas police officer.

After hearing three days of testimony, Judge Larry Mitchell ruled that Michelle Metzinger didn't attack Officer Ceaphus Gordon in January 2006 in Deep Ellum.

The officer alleged that Ms. Metzinger was belligerent and fought with him after he stopped her to ask for identification because she had been skating recklessly through traffic on Elm Street.

When he tried to arrest her on a charge of public intoxication, Officer Gordon said in his report, Ms. Metzinger tried to gouge his eye with her fingers.

Eight witnesses filed affidavits saying that Ms. Metzinger was not intoxicated and didn't resist when the officer tried to handcuff her that day, her attorneys, Kevin Clancy and Danny Clancy, have said.

The witnesses say that after Ms. Metzinger was forced to the ground, Officer Gordon put his knee on her back or neck while he was handcuffing her. This was not described in the officer's reports.

Officer Gordon described his injuries as three one-eighth-inch scratches near his right eye and scratches and bruises on his chin. He described Ms. Metzinger's injury as a "small laceration that required a stitch." His report indicates that she spent five hours at Parkland Memorial Hospital before being taken to jail.

Officer Gordon has had 27 complaints filed against him in his 14-year career, most of which were ruled "unfounded" or "inconclusive." Of the inconclusive complaints, at least two involved allegations of excessive force.

"Update: 3/17/08

TRIAL IS OVER!!! It took 3 full days of testimony but it's OVER! The judge took NO time to deliberate. He thanked the attorneys for a great trial and ended his sentence with "and the defendant is NOT GUILTY!" OH JUSTICE PREVAILS!!

Ceaphus is STILL out there! The DPD has not reprimanded him AT ALL! he has not missed one days pay since this has started. Please help us raise awareness to this fact. Use the links above and let your mayor know how OUTRAGEOUS this mans CONTINUED actions are. Consequences determine your actions and in 29 incidents the only consequence he has received is suspension from working off duty for 10 DAYS! THAT'S IT! He received that for LYING about an arrest!! Let's make sure this guy doesn't get a chance to injure or EVEN KILL someone while on the job."

hihi

i've been in touch with michelle and asked if everything was finished now but she wrote back...

"No we aren't completely done yet. still trying to figure out the civil case. Officer Gordon has still not been disciplined at all! I can't get any media to pay attention to the story anymore so there is no pressure on the dallas police to do anything. I am at a very frustrating place with this. I do not want to drop it. This man does not deserve to be an officer of any kind. It is just another waiting game at this point.

It seems strange to me that people were so interested in this story when i was this crazy drunk roller derby girl who beat up a cop and now that i have been cleared the truth just doesn't matter. Funny how that works. Tell the folks at F4M that I hope to tell them more good news in the future. :-)"

- anybody have any ideas????
