Witnesses denied she was aggressor; internal investigation continuing

A Dallas Roller Derby skater was indicted Thursday on a felony charge of assaulting a Dallas police officer stemming from a January incident in which she and several witnesses say the officer was the aggressor and used excessive force.

Reports related to the indictment charge that Michelle Metzinger, 25, was belligerent and fought with Officer Ceaphus Gordon after the officer asked to see her identification because, he said, she had been roller skating recklessly through traffic on Elm Street in Deep Ellum.

According to Officer Gordon's report, Ms. Metzinger tried to gouge his eye with her fingers when he tried to handcuff and arrest her on a charge of public intoxication.

The officer then tried to force Ms. Metzinger to the sidewalk using a "straight arm bar take down," but instead, she "rolled from the police car to the ground," his report says. Ms. Metzinger continued scratching and kicking the officer on the ground, the report says.

Officer Gordon described his injuries as three 1/8th-inch scratches near his right eye and scratches and bruises on his chin.

He described Ms. Metzinger's injury as a "small laceration that required a stitch," although his report indicates that she spent five hours at Parkland Memorial Hospital before she was taken to jail.

Kevin Clancy, Ms. Metzinger's attorney, said he was disappointed that he was not allowed to present evidence to the grand jury that would have offered a different account of what happened.

Eight witnesses to the arrest have filed affidavits saying that Ms. Metzinger was not intoxicated and that she did not resist the officer.

The witnesses state that after Ms. Metzinger was forced to the ground, Officer Gordon put his knee on her back or neck while he was handcuffing her, which is not described in the officer's reports.

"I think it's a travesty that this poor girl was charged with this," Mr. Clancy said. "I really do think that the grand jury did not look at the evidence."

A separate investigation into the incident by Dallas police internal affairs is ongoing.

Mr. Clancy said Dallas police have so far not interviewed any of the witnesses.

Officer Gordon has had 27 complaints filed against him in his 14-year career, most of which were ruled "unfounded" or "inconclusive." Of those inconclusive complaints, at least two involved allegations of excessive force.

hihi everybody and on michelle's behalf, thanks for the kind comments :) it seems very silly that she has been left to wait all this time and still not have a clear answer regarding the Police's internal investigation, or details of the case against her. one begins to wonder if they are trying to find a way out of this mess at all, or simply hoping that by dragging things out she will negotiate for a lesser conviction so they don't get humiliated in court (and sued). watch this space, fellow F4M-ers!

as to my domestic situation, well we have settled down into a routine where i run around after the 2 males in the household and they sort of co-operate in return lol - Michael is due his second op to correct the harelip but everything else is fine (including the volume in his lungs LOL).

umm that's about as exciting as it gets!

I have a good feeling about this case. I believe that they'll dismiss the charges. *Muff* may not get satisfaction against the arresting "officer" but she won't be convicted, either.

we are all doing fine - michael's op was a success and he's a normal healthy noisy baby (arrrghhh!!!!) and takes after his father (pretends to listen then does the opposite LOL).

all i know is what michelle told me and i know she is using the pictures as part of her defence. the intoxication charge was dropped so now she has to explain how she managed to brutally assault the poor policeman while on skates with one hand grasping some leaflets and her purse and both arms down on the front of his car. obviously she was so dangerous that the fine officer had to ignore the orders of the chief of police about choke holds and applying pressure to the neck of his vic...err i mean attacker (SORRY!)

when i hear more, i'll be sure to let you know :)

A Dallas County judge on Thursday found a 27-year-old roller derby skater not guilty of assaulting a Dallas police officer.

After hearing three days of testimony, Judge Larry Mitchell ruled that Michelle Metzinger didn't attack Officer Ceaphus Gordon in January 2006 in Deep Ellum.

The officer alleged that Ms. Metzinger was belligerent and fought with him after he stopped her to ask for identification because she had been skating recklessly through traffic on Elm Street.

TRIAL IS OVER!!! It took 3 full days of testimony but it's OVER! The judge took NO time to deliberate. He thanked the attorneys for a great trial and ended his sentence with "and the defendant is NOT GUILTY!" OH JUSTICE PREVAILS!!

Ceaphus is STILL out there! The DPD has not reprimanded him AT ALL! he has not missed one days pay since this has started. Please help us raise awareness to this fact. Use the links above and let your mayor know how OUTRAGEOUS this mans CONTINUED actions are. Consequences determine your actions and in 29 incidents the only consequence he has received is suspension from working off duty for 10 DAYS! THAT'S IT! He received that for LYING about an arrest!! "No we aren't completely done yet. still trying to figure out the civil case. Officer Gordon has still not been disciplined at all! I can't get any media to pay attention to the story anymore so there is no pressure on the dallas police to do anything. I am at a very frustrating place with this. I do not want to drop it. This man does not deserve to be an officer of any kind. It is just another waiting game at this point.

It seems strange to me that people were so interested in this story when i was this crazy drunk roller derby girl who beat up a cop and now that i have been cleared the truth just doesn't matter.
