Justice Dept: Judge's Ruling Blocking Asylum 'Absurd'

The U.S. Department of Justice on Tuesday said it would continue to defend President Donald Trump's decision to make immigrants who enter the country illegally from Mexico ineligible for asylum, after a federal judge temporarily blocked the policy.

Trump cited an overwhelmed immigration system for his recent proclamation that officials will only process asylum claims for migrants who present themselves at an official entry point along the U.S.-Mexico frontier.

But civil rights groups sued, and on Monday U.S. District Judge Jon Tigar in San Francisco issued a temporary restraining order saying Congress has clearly allowed immigrants to apply for asylum regardless of how they entered the country.

The Justice Department on Tuesday said it was "absurd" that Tigar allowed civil rights groups to have the ability "to stop the entire federal government from acting so that illegal aliens can receive a government benefit to which they are not entitled."

The asylum ruling came as thousands of Central Americans, including a large number of children, are traveling in caravans toward the U.S. border to escape violence and poverty at home. Some have already arrived at Tijuana, a Mexican city on the border with California.

"We look forward to continuing to defend the Executive Branch's legitimate and well-reasoned exercise of its authority to address the crisis at our southern border," the Justice Department said.

In a statement after the ruling, American Civil Liberties Union attorney Lee Gelernt said Trump's policy puts people's lives in danger.

"There is no justifiable reason to flatly deny people the right to apply for asylum, and we cannot send them back to danger based on the manner of their entry," Gelernt said.

Tigar, whose decision to block the asylum restriction marked the latest courtroom defeat for Trump on immigration policy, was nominated to the court by former President Barack Obama. His Monday order, which took effect immediately, applies nationwide and lasts until Dec. 19, when the judge scheduled a hearing to consider a more long-lasting injunction.

No State shall, without the Consent of Congress, lay any duty of Tonnage, keep Troops, or Ships of War in time of Peace, enter into any Agreement or Compact with another State, or with a foreign Power, or engage in War, unless actually invaded, or in such imminent Danger as will not admit of delay.

Do sanctuary statutes fit the bill here? I'm loathe to call them laws, since they violate the very spirit of such.

There should be a permanent injunction against Leftists/Democrats ever participating at all in America's governance, as well as their Neocon/RINO/"Never Trumper" allies -- all of which are like gremlins, jeopardizing not only the security and well-being of this country for their "interests" but the world too. [Ref. their "Russiagate" machinations] Democrats are a Communist frontgroup, not a political "Party" aligned with America's true governing system. They long ago seceded from our Republic's Constitution and practically everything they say or do "concerning" it demonstrates their determination to mangle, demolish and abolish it. In less than 1 year after the 2016 election, they thoroughly destroyed 150+ years of Post-Civil War reconciliation efforts and legislatively "criminalized" more of our rights. Those are just 3 insidious examples of what they grandiosly consider as "Progressive" achievements and good works by them.

The Supreme Court of the United States already ruled in the National Security "Travel Ban" case (lawfareblog.com Ref.) that the President can block the entire populace of countries from entering here. He can similarly ban any border scofflaw "caravan" migrants enmasse from the countries of Central America, Mexico or anywhere else, regardless of what their foreign origins are claimed to be. He can block all illegal entrance and even deport every foreign violator of our National Security/Immigration Laws. He could also do much more than that to secure America by vastly slowing down the numbers of unskilled workers worldwide coming here to get jobs that Americans need for survival and societal equilibrium.

District Judges aren't authorized to dictate that America's National Security be weakened because they said so. Here's what SCOTUS Justice Clarence Thomas had to say on that matter:

Justice Thomas first says that Section 1182(f) of the Immigration and Nationality Act does not provide any “judicially enforceable limits that constrain the President,” “nor could it” given the president’s “inherent authority to exclude aliens from the country.” ... further, ... the alleged discrimination is directed at aliens abroad, not U.S. persons.

The body of Justice Thomas’s concurrence focuses on the remedy that the plaintiffs sought and obtained from the district court: a nationwide injunction. Justice Thomas first emphasizes the negative impact of nationwide injunctions, which first emerged in the 1960s, arguing that they prevent “legal questions from percolating through the federal courts”; promote forum shopping; and make “every case a national emergency for the courts and for the Executive Branch.” He then questioned the district court’s specific authority to issue such injunctions, concluding that they “appear to be inconsistent with longstanding limits on equitable relief and the power of Article III courts” because:

No statute expressly grants the district courts the power to issue universal injunctions; and

The court’s inherent constitutional authority is limited by the traditional rules of equity at the time of the founding (Guaranty Trust Co. v. York), which did not provide for universal injunctions.


Neither is it permissible for the "immigration" Organized Crime Leagues -- of so-called "humanitarians", "charities", religious affiliates, Commerce associates, financier "sponsoring" enablers, NGOs/Non-Governmental "organizers", government "assistance" installations, the United Nations and such [aka Human Trafficking RICO-Racketeers] facilitating unlawful entry migrations, mass migration invasions and Economic Shopper barrages of phony "refugee" asylum claimants straining our procedural screening systems -- to impose their disastrous "unrestricted Open Borders/Open Society" schematics here to endanger America's National Security and stability.

Indeed, RICO is the main reason that the various organized crime cartels in the U.S. (The Outfit in Chicago and La Cosa Nostra in New York, just to name two) have basically been broken up. It has become unprofitable to try and fight a system that is aligned against you.

I don't know for sure. Maybe there is some Imminent Danger involved from Mafioso sorts and foreign Power entities if they don't hide tons of invaders for them to divide Americans and disintegrate the soveriegn nationhood of the United States into: 1. UN partitioned and ruled regions or 2. (as Ann Coulter describes it) just another third world country or 3. (as Bill Whittle describes it) just a general postal destination for mail or 4. all of the above. Possibly such declarative "sanctuary" zones would require our Military's intervention to liberate our States from the coercive forces. This Federal statute, though, prohibits "sanctuarial" Harboring of aliens: Title 8 U.S. Code § 1324
