This sounds like treason to me. Can a dead man be tried and convicted after the fact? After all, Reagan did call the Soviet Union an "evil empire".

Not only that but they hated Reagan as much or even more than they hate Trump. Trump is, after all, our saving grace. He has kept us out of the dead zone for sure.
Now if he can rescind the order W made that put us all in the ash heap and suspended our constitutional rights. He (W) declared the Global War on Terror. But that is not a formal Congressional declaration of war.
One thing you should note is how the Bush administration was continually harping on WMDs and preventing them from falling into the hands of terrorists.
