DACA isn't a law so it's not necessary to "repeal" it and it isn't even an Executive Order, either. It was only a "policy memo" by Obama that even the Democrats didn't follow by criteria-vetting per the stipulated education and criminal record standards, for example. Trump's DoJ did appeal to the Supreme Court because that's what he thought he should do, I suppose, but his job is to enforce our actual Immigration Laws - not some former administrative contrivance that is contrary to those laws. DACA violates the Constitution's Uniform Rule of Naturalization clause.
