After prison sentence: The woman, whose son was killed in Iraq, may be sent back to Mexico because of meth use

OGDEN - The mother of a soldier killed in Iraq admitted in a Thursday court hearing to abusing methamphetamine, breaking the conditions of her treatment program.

Angela Cabral was sentenced to up to 5 years in the Utah State Prison, a term that will apparently end with her deportation from the country for which her son died.

Cabral, a legal resident of the United States but not a citizen, already was struggling with drug abuse when she learned that her son, Juan Carlos Banuelos Cabral, had been killed in a roadside bomb attack near the city of Kirkuk on Jan. 31, 2004. She says her life spiraled even more out of control in the following year as she mourned the loss of her son.

Apparently moved by Cabral's plight when she came before his court in 2005, 2nd District Court Judge Parley Baldwin allowed Cabral to participate in a monitored substance abuse program known as drug court, rather than send her to jail. Under the watchful eye of the program's counselors, Cabral stayed clean for more than nine months, according to court records. As the two-year anniversary of her son's death approached, however, she relapsed.

At Thurs- day's hearing, Baldwin looked saddened to see Cabral back in his court. After sentencing her to prison - the length of her stay there will be determined by the State Board of Pardons and Parole - he shook his head slightly and sighed.

“I wish you well, ma'am,” Baldwin said. “You've been given a lot of opportunities and you need to take advantage of some of them.”

It is unclear how many more opportunities Cabral will have, in this nation. A Utah State Prison official confirmed on Thursday afternoon that the 45-year-old woman, who has been in the United States for three decades, still has an immigration hold on her record - prompted by a felony conviction for drug possession. She will be turned over to U.S. Immigrations and Customs Enforcement officials upon her release and faces deportation to Mexico.

No date has yet been set for Cabral's parole hearing, but prison spokesman Jack Ford said she will likely be seen by the board within months. mlaplante@sltrib.com (2 images)

the mexicans and others come into our country in large numbers. They're able to get jobs. they're able to buy houses. their kids go to regular schools. They live regular lives. But they remain in legal limbo for decades. They are harassed legally. They can be sent home at any time. They hate this. their grudge grows. and they will seek revenge. the policies are set to maximize the immigration that drives wages down and upsets the americans and at the same time the policies are set to maximize the grudges that the mexicans develop. and what is their fix? to turn the 'illegals' into indentured servants. This will just drive wages down further and give us a class of semi-slaves.

They are harassed legally.

On this I disagree.. they have more rights than US citizens.. the INS/Homeland Security ignore the issue.. they all need to bet sent back to their own country.. They make up a huge % of the prison population.. Bringing in disease that were once eradicated in this country.. using hospital and school services and are breaking this country financially.. spending little of their money in this country sending it back to Mexico.. also the drug and meth labs are mainly come thru Mexico.. and most of the meth labs are operated by illegals..

There's people who've been here for 20 years, but are still illegals, have families where the children speak english as first language and think they are american and go all the way through american schools. and when they have any legal scrape they are immediately threatened with deporation. that's legal harassment.

Ronald Reagan was right, when people build roots in this country they should be allowed to stay. Only the new arrivals should be sent back.

All the government has to do is look at the payroll data already reported to facilitate payroll taxes being collected in order to identify illegal aliens. You give amnesty to all as Reagan did in 1986 and then you look at the payroll data and keep new illegals out. It was the republicans in the US senate who stopped us from doing this in 1986, but that is what Reagan wanted and he was right then and it is the right solution today.

How can you send a 10 year old child who was born here and goes to american school and speaks english as first language back to mexico where she's never lived and would be a foreigner? And how can you do that to their parents even?

The policy is set to keep these people in limbo for decades. It is wrong.

Sorry Red I so disagree.. it's not legal harassment.. they're here illegally I dont care if it's one day or 20 years.. they're breaking the law.. taking over OUR country.. send them back where they came from the sooner the better..

Send a child back?? I have NO problem with it.. of course that won't happen cause of the anchor baby issue.. their loyality is not to this country.. its to their home country.. my son was married to a LEGAL .. and her first loyality was NOT to this country..
