I'm a gun owner, and I support an extreme-risk law in Iowa

I love this state. I love the culture. I love the people. I love my family, I love my two boys so much it makes my heart swell, and I love raising them here.

Iowa has my heart, and it also has a strong heritage of responsible gun ownership. I’ve been a gun owner my entire life — I grew up with guns, I’m a twice-deployed Army veteran, and I own guns now. So I know how much we cherish this tradition in our state. I also know that protecting our heritage of responsible gun ownership and protecting our communities from gun violence are not mutually exclusive. Because I also know that gun violence is a reality in our communities, that every year there are nearly 300 gun deaths in Iowa — and that every single one of those deaths is preventable.

© Brian Powers/The Register The Iowa State Capitol building on Friday, Jan. 31, 2020, in Des Moines.

Last month, I stood with nearly 100 other concerned Iowans from every corner of the state, some gun owners like myself, and urged our lawmakers to take action to end gun violence. Our group, Iowa Moms Demand Action, is made up of mothers and others, those who own guns and those who don't, Republicans, Democrats, and independents alike. That same day, lawmakers in the House introduced House File 2367, a bill that would create an extreme-risk law in Iowa.

The concept is simple: House File 2367 would allow law enforcement officers to ask a court to temporarily restrict a person’s access to firearms if there are signs the person is dangerous to themselves or others. The person would have to have the opportunity to participate in the hearing, and officers would need to prove the danger by clear and convincing evidence. The final order would last no more than one year, after which a person could regain access to firearms.

The gun lobby wants you to believe that extreme-risk laws are radical, unpopular and unconstitutional, but that couldn’t be further from the truth. Seventeen states have enacted extreme-risk laws — including five states where Republican governors signed the legislation — and these laws have strong due process protections and have been ruled constitutional. Right here in Iowa, extreme-risk laws have overwhelming public support.

New polling shows that 75% of Iowans support extreme-risk laws and that Iowa voters generally support stronger gun safety laws by a 3-to-1 margin. And if that isn’t enough to motivate lawmakers, 75% of voters also consider a candidate’s position on guns “very important” to their vote in 2020. Come November, we’ll make sure that voters know where our leaders stand.

Republicans and Democrats, gun owners and non-owners all support this legislation. Because common-sense gun safety laws are just that: common sense. And extreme-risk laws save lives.

Nearly 300 Iowans die every year from gun violence, and nearly 80% of gun deaths are suicides. It doesn’t have to be this way. Extreme-risk laws have been proven to be an effective way to prevent gun suicide. Temporarily preventing a person in crisis from accessing firearms can mean the difference between life and death, because firearms are an especially deadly means of self-harm. Most people who attempt suicide do not die unless they use a gun.

Between 300-400 people die in automobile collisions every year in Iowa. Are we going to start taking away there right to drive "temporarily"?

Yes of course.

When I worked for State of Illinois, I got hit by a drunk driver at my turn around point on snow and ice at the county line.

When he hit me he knocked the driver side fuel tank plum off the truck.

I had to back up to keep the intersection open. I jumped out of the truck and ran over and pulled the keys from his ignition.

The right front wheel was pushed against the firewall and the engine was still purring like a kitten.

I told the cop that came out the firemen said he was pretty messed up (drunk). The cop said, "That's all I needed to know." He went to the hospital and ordered a blood draw. I bet that guy lost his license and had to go into rehab for the booze.

I had a lawyer check him out. He told me, "He's living at home and has nothing."

I took a week off on comp since I was shook up over the incident. ;)

I hate drunk drivers.

I was out on night patrol once on Milwaukee Ave in Illinois. The Des Plaines River was just to the east of that road.

A car going southbound went off the road since there was a lazy curve to the left and it went thru a guard rail and hit an old bridge wall at the entrance to a restaurant there.

The front wheels were folded up like landing gear on an airplane. The steering wheel took the girls head off. It was pretty gruesome. The cops showed me her license with her picture.

A buddy of mine knew her. He said they used to party together. She was likely very drunk when that wreck happened. :-/

Yeah I always think that the due process of law is trivial as well. Here is the problem with these red flag laws. They are going to be easily misused. Imagine writing something on Facebook or some other website and having some algorithm pick you out of nowhere and assign a threat level.

Imagine a relative, an ex friend, an ex wife, and ex girlfriend, some random fuck you talked to on the net that did not like what you said. Imagine Swatting law abiding gun owners simply because.

That is why these laws are so obscene because there is no recourse for the person in question to face their accusers, address a court, or even prove anything with regard to their personality or mental state. You simply have some goons show up at your house, they take your guns, leaving you defenseless and if you protest, you get shot or go to jail either way.

The courts will then destroy your guns, and you’ll get “Fair Market Value” which of course means what they pay the people for their gun “buy back” program.

No, these laws are wrong, and you know what? If someone wants to kill themselves, fucking let them. Who are you to judge how someone’s life is to where you have any say over what is best for them? Let those who want to kill themselves do so I say.

...that every year there are nearly 300 gun deaths in Iowa — and that every single one of those deaths is preventable.

++++++++++++++++

bullshit

According to data from the Centers for Disease Control and Prevention (CDC), from 2007 to 2016, 2,253 Iowans were killed with a gun. This breaks down to 1,846 gun-related suicides, 325 homicides, 38 unintentional shootings, 21 shootings by law enforcement, and 23 gun deaths for which the intent could not be determined.12 The burden of this violence is not borne equally across all communities in the state. For example, while African Americans make up 4 percent of the state’s population, they account for 31 percent of its gun homicide victims.13

Imagine a relative (say an estranged older sister), an ex friend, an ex wife, and ex girlfriend (yeah, her too), some random fuck you talked to on the net that did not like what you said. Imagine Swatting law abiding gun owners simply because.

Been there, done that. Twice. Sucks. The first time they had 20-30 cop cars surrounding my block, only 3 or 4 at my now late mother's house (she was just out of the hospital from having a heart attack). We were accused of killing my younger Down's Syndrome and handicapped sister. This was 2014, FWIW my younger sister died of Sepsis in a Medicaid Waiver home in August 2019.

Correct.

The courts will then destroy your guns,...

Or the cops keep them or sell them.

...and you’ll get “Fair Market Value” which of course means what they pay the people for their gun “buy back” program.

A little careful analysis brings the truth to light.

Exactly. Discounting the suicides, in ten years there were 407 gun deaths in Iowa. I doubt that many other states have that low a statistic.

1st, I have always appreciated your direct, honest, and insightful posts. I don't believe I have said so in the past but am saying so now.

My immediate family has experienced 4 suicides, one was accidental, the other three were suicide by way of a pistol, no accident. One comment I'd like to make right off is that trying to figure out suicides is a waste of time. There's no figuring it out unless an explanation is left by the person committing the act. Secondly, I am a gun owner that doesn't go hunting wild game. I have weapons for self protection from whatever human animals decide to fuck up my day.

I have been asked by friends and other family members whether I own guns. My reply is yes, why do you ask. These people remind me of my family history and ask if owning guns doesn't bother me. My response is that it's my choice and up until lately I have always aimed the other way.

Your analysis of the law (red flag) is spot on. This red flag law should be completed by placing the hammer and sickle appropriately upon every expression of it. Most of us that participate on this 4UM have sat idly by for many years while America has become a communist shit hole. Flag waving, speech giving pieces of shit have become our rulers while we have patiently awaited a savior. There ain't one other than the united efforts of the American people standing firmly against the tyrants that have infected D.C. like syphilis, slowly killing the spirit of a once great nation.

Lastly, I would like to state for the RECORD that suicide should be a last resort. However, when terminally ill and suffering the ravages of some likely man made fucking disease, in my most humble opinion, suicide is the wiser choice than bankrupting one's heirs with hospital bills, and burial arrangements. (There must have been a mortician involved in anti-suicide propaganda). Like you said Mr. Mad Artist, if they want to kill themselves "FUCKING LET THEM" and leave it. There's no figuring it out.
