Resistance See other Resistance Articles Title: Upstate business owner files lawsuit saying governor's order making him close was unconstitutional ANDERSON, S.C. The owner of an Upstate barber shop has filed a lawsuit seeking to have Gov. Henry McMaster's shutdown order declared unconstitutional by the courts. The lawsuit was filed Tuesday on behalf of Robert Tony McCurry, the 62-year-old owner of McCurrys Barber Shop on Whitehall Road in Anderson. McCurry said his four-chair family-owned business was opened in 1957, and its unusual five-gabled building has been something of a landmark in Anderson for years. He said he has been cutting hair in Anderson since 1982. Barber shops were one of many businesses that were forced to close April 1 due to an executive order by McMaster. They, along with other close-contact businesses, will be allowed to reopen on Monday, May 18, McMaster announced Monday. The lawsuit says McCurry was deprived of income due to the order. McCurry is being represented by Greenville-area attorney Robert Merting. My client was denied his rights to his livelihood, property, and labor. He is suffering under the direct act of the Governor, which was based on a strained interpretation of state law. It is unconstitutional, Merting said. We are seeking to get my client and all other barbers and cosmetologists back to work, and to prevent further abuses of this kind in the future. The suit does not seek monetary damages. It seeks to force the Governor to obey state law and the constitution, and to prevent further harm to South Carolinians from executive orders that deprive them of the use of their property and the ability to earn a living. They're my barbers. Mine's wife came by earlier and let me know they're reopening tomorrow.' Their shop is unique -- got knickknacks and patriotic stuff all over the place.' She says both McCurry and his lawyer are Birchers, so don't say the JBS is entirely useless -- unless of course the lawyer throws the race to please his brother masons in the halls of bastardized power. The funny part is that it had never occurred to me I should do business withem because of those tokens of sanity.
