The ruling is a good start for the Republican campaign who have argued that votes in Pennsylvania received after election day should not be counted and that votes compromised by the refusal to allow Republican ballot watchers to observe should also not be counted. Under state law, voters have until six days after election day to cure problems on their ballots, including providing proof of identity. This year that deadline was November 9, but Pennsylvania Secretary of State Kathy Boockvar submitted guidance earlier this year saying that proof of identity should be given up until November 12. Judge Mary Hannah Leavitt ruled this week that the court concluded Boockvar lacked statutory authority to make the change. [T]he Court concludes that Respondent Kathy Boockvar, in her official capacity as Secretary of the Commonwealth, lacked statutory authority to issue the November 1, 2020, guidance to Respondents County Boards of Elections insofar as that guidance purported to change the deadline
for certain electors to verify proof of identification, the judge said in a court order. Thats precisely what the Trump campaign has been saying not since election day, but since before the election. The Trump campaign and Republicans argued that there was no legal basis for extending the identification deadline
or any basis or argument for it at all. Boockvar, as it turns out, didnt have the power to change it. While its good news for Trump, its only the start and the ruling is not going to flip the state for President Donald Trump. The votes that will not be counted have already been set aside, and if President Trump is to see the results in Pennsylvania change, then it would require large numbers of votes in the state to be deemed invalid for various other reasons. President Donald Trumps lawyers have hundreds of witnesses who have signed sworn affidavits alleging election fraud or obstruction of ballot observation in Pennsylvania, and if the courts side with the president on these issues too, this election could get very interesting. Maybe they've been set aside. Or maybe they've already been mixed with regular ballots. Or maybe Biden ballots in the late pile were switched with Trump ballots.
