Another Man Charged in Connection to Kyle Rittenhouse Shooting Case

A 19-year-old Wisconsin man is facing felony charges for helping Kyle Rittenhouse get the rifle he used in Kenosha during rioting there in August.

Rittenhouse has said he was acting in self-defense when he shot three people, two of whom died, but he faces charges that include homicide.

Dominick David Black of Kenosha has been charged with two felony counts of intentionally selling a gun to a minor, according to The Washington Post.

Black appeared in Kenosha County Circuit Court on Monday.

Kenosha County Assistant District Attorney Tom Binger said the 19- year-old “has generally been cooperative with police” and has no criminal record, according to the Kenosha News.

Binger said he expected Black to be released on $2,500 bond and return to court Nov. 19 for a preliminary hearing.

Authorities say Black bought a Smith & Wesson M&P-15 rifle in Ladysmith, Wisconsin, using money Rittenhouse gave him. Rittenhouse could not buy the gun himself because he was 17.

Black told police the gun was to be used only while hunting up north at his family’s property, according to the Milwaukee Journal Sentinel.

The gun was allegedly stored at Black’s stepfather’s home in Kenosha.

Black’s stepfather told authorities he removed the guns from the safe where they were stored in his garage as rioting flared in Kenosha following the police shooting of Jacob Blake. He said he did not know the guns had been taken from his house until the day after the shooting.

According to the criminal complaint cited by the Kenosha News, Black “volunteered to go out after curfew” on Aug. 25 armed with another AR-15 style rifle” to “protect the Car Source business” and asked Rittenhouse to go with him.

Black “gave (the gun) to Mr. Rittenhouse to use that evening,” the complaint said.

On the night of the shootings, Black had positioned himself on the roof of the auto repair shop they were guarding, according to the Journal-Sentinel. He has told investigators he did not witness the shootings for which Rittenhouse faces charges.

However, in a criminal complaint, he is listed as having identified Rittenhouse as the shooter.

According to police, Black said he “told Kyle that he (Black) was going to be in more trouble than Kyle. He told Kyle that he (Kyle) was defending himself and said he told Kyle ‘in all reality, you are not supposed to have that gun. That gun was in my name.'”

Police said the Black had the gun in the trunk of his car when police came calling on Rittenhouse after the shooting, and he surrendered it then.

Black’s stepfather told police that “he was not approving of Black buying this firearm for Kyle” and “refused to have the rifle housed anywhere other than his locked safe at his home in Wisconsin,” according to court records.

Rittenhouse remains in the Kenosha County Jail, having lost his battle to fight extradition from Illinois, where he lives.

This guy did not sell a gun to a minor. It was a straw purchase.

It will be argued that he did not do either.

It's perfectly legal to loan others money, even for 17 year olds.

That money was used to buy a rifle. Fine. Still not illegal.

But the rifle was primarily retained by the purchaser. It was only loaned to Rittenhouse on particular occasions, after which it was returned to the purchaser.

Had the purchaser given the rifle to Rittenhouse after buying it for him to keep permanently, THEN you have a straw purchase. But in this case, the rifle needed to be returned to the purchaser after each use. I think the guy has a good chance of getting off.

A jury will weight that point, unless he takes a plea.

When they fail to charge him for knowingly selling a gun to a minor, they can always fall back on the Straw purchase. Nice... Two charges for the price of one.

As an instructor for self defense, the one thing I stress is not to go where problems are going to happen for you. It’s called “Avoidance”. His mom failed to keep her son at home. The law is going to see it only one way and Kyle Rittenhouse is going to go to jail for shooting 3 felons, one of which was a felon in possession of a firearm.

They are going to aim high but likely settle for Manslaughter and Kyle will be out in 3 to 5 years. Won’t that be great??? Another kid who goes into the system and comes out a criminal, barred for life from law enforcement, and of course, owning a firearm.

I think there is now a concerted effort by leftists to create these situations and then cry crocodile tears as the Anti-Gun machine rolls into action using “Victims” like that one cuck who had the pistol who was going to shoot Kyle.

I am not against a kid owning a gun and defending himself, I am simply saying that the criteria for self defense is almost non existent to the eyes of the prosecution as their mantra will be that “HE SHOULD NOT HAVE EVEN BEEN THERE.”

Mark my words, Trump is the only chance this kid has of getting a full on pardon.

I think Trump can only pardon folks with federal charges, like Reagan did with Junior Johnson (NASCAR guy) for past moonshine charges (Federal revenooers). That's why I pinged GDT, he'd probably know for sure.

Correct. Trump can only pardon federal offenses, and Rittenhouse faces state charges. Only the governor of WI can pardon him. Last gov was an R and current gov is a dem. The election is 2 years from now.

His best chance is a jury trial failing to convict. Convictions require a unanimous guilty call by 12 jurists so a lone holdout is all it takes, and his case is adequately politicized so if the jury is fairly selected, a conviction may be hard.

The biggest problem he faces is his age and the charge of unlawful possession of a weapon by a minor. That charge is probably the hardest to escape conviction on, and what prosecutors may attempt is to argue that if he's convicted of that lone charge, that the self-defense argument will be invalidated as his possession of the weapon will have been deemed illegal before the shootings took place.

A similar thing happened to some Waco survivors who where charged after the infamous raid there. The jury convicted them only of minor charges and acquitted of all serious charges, but the prosecutors used the minor convictions to somehow invalidate acquittals and the guys spent years in jail. The jury was outraged and went public, saying if they knew that would have happened, they would have simply acquitted of all charges.

Rittenhouse faces the same danger so it's important he not be convicted of possession. This should be seen as an age discrimination case, being convicted of doing something as a minor that is perfectly legal to do as an adult. And to be tried as an adult for something he did as a minor in an adult court is rather backward. The state should be forced to try him in juvenile court for the juvenile charge, but they are not.

When I lived in he Group Home here the Manager called me into her office and she starts to read this stuff from her file. This is me talking, "I'm gonna get a gun."

Then she said, "If you bring a gun in here you will be arrested".

I never said it. She was making it up.

Then some woman with that federal agency HHS came to my apartment. My boss from work was here as a witness. That woman starts to talk about guns.

I said, "There are no guns here. I don't own any guns. Why are you coming here asking about guns?"

She said, "That shooting happened out near Denver..."

I said, "Denver is a long way from here and why are you coming HERE asking about guns?"

There is no reason Kyle should take a plea. He has a defense fund set up with GiveSendGo since that other outfit would not give him the time of day.
