No arrests were made in the 3 a.m. Saturday incident at the Waffle House on Smoky Park Highway, and the investigation is continuing, said Capt. Sarah Benson of the Asheville Police Department.

(282 KB) Advertisement But some believe the current immigration debate is fueling tensions between Hispanics and others.

The National Council of La Raza issued a statement Friday asking the U.S. Department of Justice to investigate the recent beating and sexual assault of a 16-year-old Hispanic boy near Houston as a possible hate crime, and last week the Southern Poverty Law Center reported that an anti-immigration activist had urged a neo-Nazi group to harass, rob and beat illegal immigrants.

And the Anti-Defamation League issued a report on what it said is a growing number of assaults on legal and illegal immigrants.

“This report reminds us that there is a direct connection between the national policy debate and the atmosphere surrounding the daily lives of immigrants,” said the league’s national director, Abraham Foxman. “The rhetoric we are seeing about Hispanics is downright scary.

“While these sentiments are often relegated to the private chat rooms, blogs and message boards maintained by hate groups, it only takes one individual with hate in his heart to act on these notions. For us, that’s a real concern as the national discussion on immigration continues to gain momentum.”

Edna Campos, organizer of the recent We Are One America immigration-rights rally in Asheville, said the immigration debate is raising tensions here.

“There is an increase in this area of people being polarized,” she said. “Fear mongers are saying, ‘These criminals are taking our jobs. They are terrorists.’ That’s all raising people’s fear. People want to stir things up. They want people to be polarized.”

In Saturday’s incident, a gunshot from a vehicle leaving the Waffle House shattered a window and caused a minor injury following an argument between whites and Hispanics inside, police said.

“The two groups were jawing back and forth with each other over citizenship issues and whatnot,” Lt. Wallace Welch said.

According to a police report, the shooting suspect was seated at a table with another Hispanic man and two white women. Whites at two other tables made comments “in reference to the suspect being Hispanic,” Benson said.

“The suspect stood up to leave, and the victim, who was seated at one of the tables, saw a gun in his waistband,” she said. “He followed the suspect outside the building, and that’s when the suspect shot toward the victim and into the building.”

The shot shattered a large window at the restaurant. The victim’s arm was bleeding when police arrived, but it’s not known if the injury was cause by a bullet fragment or flying glass. The victim declined medical treatment.

The case remains under investigation, Benson said.

Police Chief Bill Hogan said he’s not aware of any increase in criminal activity related to race or ethnic background. Hate crimes in Asheville are very rare, he said.

“What I’ve seen to this point is conflicts are not really based on race as much as what the incident is,” Hogan said. “As we investigate cases, we keep an eye out to determine if the motive for a criminal act is ethnic or race-based.”

2 charged in Hazleton [Pa.] fatal shooting

Police say a third man will also face charges in the death of Derek Kichline, 29.

HAZLETON – Two illegal immigrants from the Dominican Republic were charged Tuesday in the shooting death of a city man.

Police said a third man, Cesar Ariel Jaquez, will also be charged in connection with the case.

Joan “Mike” Romero and Pedro “Marco” Cabrera are charged with homicide in the killing of Derek Kichline. The 29-year-old was shot once in the head near his East Chestnut Street residence on May 10 just before midnight.

Romero and Cabrera, both 23, of South Cedar Street, are charged with criminal homicide, criminal conspiracy, receiving stolen property, persons not to possess, use, manufacture, control, sale or transfer firearms, police said.

Pennsylvania State Police and the Luzerne County District Attorney’s office assisted city police in arresting both men overnight.

Kichline was shot in the face near his left eye and was pronounced dead at the hospital about 45 minutes later. Luzerne County Coroner Dr. John Consalvo had said the gunshot that killed him was from a .380-caliber handgun that was fired at close range. Police said the gun has been recovered and had been stolen.

Hazleton police said Jaquez was arrested on May 11 and was associated with Romero and Cabrera. Jaquez suffered a self-inflicted gunshot wound when he tried to unload the gun, police said. Jaquez is in federal custody on an Immigration and Custom Enforcement detainer.

The arrest affidavit for Romero said Jaquez had arrived at Hazleton General Hospital at 11:56 p.m. on May 10 to seek treatment for a gunshot wound. Jaquez told police he had been robbed in the city at an unknown location, but police said the wound was not consistent with a robbery.

Police took his bloody clothing as evidence and asked if they could go somewhere to retrieve more clothing for him. He said he lived at 119 S. Cedar St., the same home address Romero and Cabrera provided to police.

The affidavit said that a detective tried to retrieve a bag from an open closet at that address and a Winchester .380-caliber shell casing fell to the floor. The casing was identical to the casing found at the homicide scene. Police executed a search warrant and found a .380-caliber pistol inside a futon mattress. They determined the gun had been stolen from a vehicle in Hazleton last October.

According to police, Romero and Cabrera after the homicide gave the gun to Jaquez, who accidentally shot himself in the leg as he tried to unload it.

During the investigation, a “home invasion” type robbery was linked to the group. Police said Romero’s brother, Juan Carlos Romero, has been charged with receiving stolen property related to the gun and items taken from a residence at 569 Lincoln St. earlier this month. He is also an illegal immigrant, and a federal detainer was placed on him.

The arrest affidavit for Juan Romero said that on May 1, police responded to 569 Lincoln St. and two victims told them that four or five people brandishing handguns had entered the residence, tied them up and ransacked the home.

Since our prisons are full of hispanic criminals who committed crimes against non-hispanics, this line of "reasoning" won't hold water for 2 seconds.

They do not want these stats released, and if it came to court they would be.

With thousands of North Carolinians already out of work because of outsourcing to other countries, and the illegals taking all the rest of the jobs that are left, I think you are right! If amnesty is granted to these millions of illegals, they say we have another possible 200 million here! All hell is about to break loose in this country!!!!!!!!!
