Bragg’s high-profile case is collapsing. And now Alvin Bragg is going to hate this bombshell development in his big trial. Alvin Bragg is trying to sentence Marine veteran Daniel Penny to prison for killing mentally ill homeless man Jordan Neely. Bragg caved to pressure from the Left – led by Alexandria Ocasio-Cortez who tried to turn this into another George Floyd situation – and arrested Penny after police initially let him go upon recognizing that Penny acted in self-defense. Penny’s lawyers released a new video where Penny describes what happened and completely destroyed Bragg’s case. In the video, Penny described how a clearly agitated – and potentially intoxicated – Neely boarded the subway car and began acting violently. “The man stumbled on, he appeared to be on drugs, the doors closed, and he ripped his jacket off and threw it down at the people sitting next to me at my left,” Penny stated. Penny described how Neely made it clear he was willing to kill and suffer the legal consequences. “I was listening to music at the time, and I took my headphones out to hear what he was yelling,” Penny added. “The three main threats that he repeated over and over again were ‘I’m going to kill you,’ ‘I’m prepared to go to jail for life’ and ‘I’m willing to die.’” Penny explained that even though he is a Marine, he still feels fear and that Neely’s state of mind led him to fear for his safety and those of his fellow passengers. “There’s a common misconception that Marines don’t get scared. We’re actually taught one of our core values is courage, and courage is not the absence of fear but how you handle fear,” Penny continued. “I was scared for myself but I looked around there was women and children, he was yelling in their faces saying these threats. I just couldn’t sit still.” Penny also debunked the narrative that he held Neely in a choke hold for 15 minutes saying it was only a matter of minutes and Penny was still clearly breathing. “Some people say that I was holding on to Mr. Neely for 15 minutes. This is not true — between stops is only a couple of minutes. So the whole interaction lasted less than 5 minutes,” Penny said. “Some people say I was trying to choke him to death — which is also not true. I was trying to restrain him. You can see in the video there’s a clear rise and fall of his chest, indicating that he’s breathing. I’m trying to restrain him from being able to carry out the threats.” Neely had been arrested dozens of times including for punching an elderly woman in the face. But Alvin Bragg is a Soros-backed prosecutor who critics contend sees his job as defending the Left’s allies and punishing their enemies.
