Liberals were furious. And Clarence Thomas destroyed Ketanji Brown Jackson with one straight fire smackdown. The Supreme Court struck down affirmative action in college admissions. Schools can no longer use race as a criteria in determining who they admit. Joe Bidens liberal Supreme Court Justice nominee Ketanji Brown Jackson who herself was an affirmative action hire as Biden said he would only consider a black woman to be his nominee threw a temper tantrum in her dissent. Jackson claimed America was a systemically racist country with a history of oppressing minorities and therefore the county needed a new racial spoils system to correct this wrong. Gulf-sized race-based gaps exist with respect to the health, wealth, and well-being of American citizens, her dissent began. Allowing colleges to consider applicants race has universal benefits because it helps to close those gaps and thereby promotes equality, Jackson wrote. With let-them-eat-cake obliviousness, today, the majority pulls the ripcord and announces colorblindness for all by legal fiat. But deeming race irrelevant in law does not make it so in life, Jackson wrote. In his concurring opinion Justice Clarence Thomas took a flamethrower to Jacksons opinion calling Jackson out 18 times by name. Thomas slammed Jackson as seeking to codify institutional racism in America while denying America has made any progress since the nations founding. As she sees things, we are all inexorably trapped in a fundamentally racist society, with the original sin of slavery and the historical subjugation of black Americans still determining our lives today, Thomas wrote The panacea, she counsels, is to unquestioningly accede to the view of elite experts and reallocate societys riches by racial means as necessary to level the playing field, all as judged by racial metrics. I strongly disagree. Thomas blasted Jackson for claiming all black Americans are victims of a racist society. Justice Jackson uses her broad observations about statistical relationships between race and select measures of health, wealth, and well-being to label all blacks as victims. Her desire to do so is unfathomable to me, Thomas wrote. I cannot deny the great accomplishments of black Americans, including those who succeeded despite long odds. Thomas argued that by reducing individuals to the sum total of their skin color Justice Jackson denies the fact that people have agency in their own lives. Justice Jacksons race-infused world view falls flat at each step. Individuals are the sum of their unique experiences, challenges, and accomplishments, Thomas added. What matters is not the barriers they face, but how they choose to confront them. And their race is not to blame for everything good or bad that happens in their lives. A contrary, myopic world view based on individuals skin color to the total exclusion of their personal choices is nothing short of racial determinism.
