Robert Kosilek, who is serving life in prison for strangling his wife, was back in federal court yesterday, again demanding that the state Department of Correction pay for his sex-change operation. A similar bid was denied in 2002, and his latest attempt has infuriated Lt. Gov. Kerry Healey. I strongly oppose using taxpayer dollars to fund a sex-change operation for any prisoner, but especially a convicted murderer, Healey said. Should taxpayer money be used for a sex-change operation? I think the answer is a resounding no, she said. He shouldnt be receiving any special treatment whatsoever. Kosilek, 57, claims he is suicidal and needs the sex change for medical reasons. A psychiatrist testified in federal court that Kosilek - who is now known as Michelle - will kill himself if the surgery is not allowed. In 2002, Judge Mark Wolf ordered the DOC to provide him with female hormones but refused to order the surgery. Kosilek has also received therapy and laser hair removal treatments behind bars but wants the state to pick up the tab for the operation. We ask that gender identity disorder be treated like any other medical condition, said Kosileks attorney, Frances Cohen. Kosilek, who wears his hair long and tucked behind his ears, has developed larger breasts since beginning hormone treatments. He has testified that he suffered from gender identity disorder since he was 3 years old and had attempted suicide twice. He has also said he tried to castrate himself. The con began his crusade for a taxpayer-funded sex change after his 1990 arrest for strangling his 36-year-old wife, Cheryl. Her body was dumped in a parking lot. Kosilek was convicted in 1993 of first-degree murder and is serving life without parole. DOC lawyers argued that it would be a security risk to allow the operation because Kosilek would likely be targeted for attack by other inmates.
