MILLERSBURG, Ohio - A judge has ruled that a state dairy law prohibiting the sale of raw milk does not violate an Amish dairy farmer's religious beliefs and has ordered him not to sell unlabeled milk from his farm.

Arlie Stutzman, who owns a herd of 27 cows near Mount Hope, appeared in court June 30 to protest a law that he says violates his religious beliefs because it prohibits him from sharing milk he produces with others.

Holmes County Common Pleas Judge Thomas D. White wrote that Stutzman may give his unpasteurized milk away to people in need, but may not accept donations for it.

"Calling the compensation for milk a 'donation' is clearly a subterfuge to skirt the requirements of the law," White wrote in his decision issued Friday.

Stutzman lost his dairy license after an undercover agent from the Ohio Department of Agriculture gave him $2 for a gallon of milk last September. He was cited for selling milk in an unlabeled container. He got a new license in April.

Sales of raw milk are illegal in Ohio and 24 other states.

"We're pleased with the decision and it makes a lot of sense," said Melanie Wilt, spokeswoman for the agriculture department. "The judge understands Ohio's dairy laws are there to protect consumers."

Organizations such as the U.S. Food and Drug Administration say raw milk contains health risks because it has not been heated to kill bacteria, such as E. coli.

Groups such as the Weston A. Price Foundation, which advocate restoring nutrient-dense foods to people's diets, advocate the consumption of raw milk, saying pasteurization diminishes vitamin content and kills beneficial bacteria.

A phone message left for Stutzman was not immediately returned Wednesday. His attorney, Gary Cox, said he didn't know whether they would appeal the ruling.

"We disagree with it, but obviously Arlie has to comply with it," Cox said.

Stutzman's Amish faith places an emphasis on the community. To preserve their lifestyle, the Amish avoid the use of electricity and automobile ownership. They typically don't get involved in politics.

White wrote that state dairy law does not violate Stutzman's First Amendment rights because he "produced no evidence that his religion compels him to make money from feeding the hungry." He also rejected Stutzman's argument that he had been entrapped.

White's ruling that Stutzman may give away his milk seems to conflict with state law, which prohibits the distribution of raw milk, regardless of whether it's sold.

Cox said he would ask the judge for a clarification.

That damned license is what got him in this mess to start with. When you get a license for ANYTHING, you are entering into a contract with the party issuing the license and agree to be bound to ALL provisions of the issuer.

In this case he gave up his God given RIGHT to own dairy cows, and barter with the goods produced from the fruits of his labor; and instead accepted the "privelege" of having a dairy farm and abiding by all the rules and regulations set forth by the Department of Agriculture..

The legal definition of a license is "Permission granted to do something which would otherwise be illegal, a tort, or a trespass". Being Amish, it surprises me that he would ever even CONSIDER that there could be anything illegal about the God given right to produce food that he would need to "obtain permission - AKA get a license" to enjoy his right!

That is why I don't have any licenses. I have a God given right to travel, there is nothing illegal about travelling, so why have a driver's license? Because I want to subject myself to the Transportation Code? Without a DL I haven't agreed to the terms of that Code - and they can't enforce it on me. Ditto for marriage, hunting, or any of the myriad of other "illegal" things that most of us get a "license" to do.. And because of this I have fared much better in court than most........

If it hadn't been for that license, I don't think they could have prosecuted him very easily.

The virtues REALLY start when you formally expatriate. This is done by getting out of the Social(ist) Security system. That number is what makes you an American Citizen as oppposed to a state sovereign. It is what makes you a slave to government instead of a free individual. Here is something interesting from Scripture - in Luke 22:25 we see "And he said unto them, The kings of the Gentiles exercise lordship over them; and they that exercise authority upon them are called benefactors." Mind you, this is the words of the Messiah. Now if you look at the SS system, the government is called the benefactor, and YOU are the beneficiary! Scripture goes on to say in verse 26 "But ye shall not be so"...... Something to think about!!

Noone222 can inform you much better than I can about how this whole scheme has been implemented in such a clever way that there are MANY bases to cover to totally remove yourself from the system.

You should listen to some of his programs, and for the purposes of this thread a good one to start with is Retirement at Risk. One thing is for sure - if you DO decide to get out of the system, you will have to learn enough about law to be able to handle yourself in court. That is where Gordon's school would be so valuable. You may also be able to find someone that is COMPETENT at dealing with law for guidance, BUT you'll still have to do it yourself for the most part.

There are many deceptions in the system, and it's not hard to learn the whats and hows of it. For example if you look at your driver's license you'll notice that your name is in all caps. What that is the CORPORATION named xxxxxxxx, NOT the PERSON named xxxxxxxx.. And when you go to court, and they call your name, you are answering on behalf of the CORPORATION!!!! See what I mean by they are sneaky? Like I said, there is quite a bit of stuff to cover.

That is why I think a blog type site would be a benefit to anyone thinking about becoming a person again.I can set up various topics under which articles can be posted, that might help lead someone in the right direction.
