A federal Department of Homeland Security agent passed along information about student protests against military recruiters at UC Berkeley and UC Santa Cruz, landing the demonstrations on a database tracking foreign terrorism, according to government documents released Tuesday.

The documents were released by the American Civil Liberties Union, which filed a Freedom of Information Act request on behalf of student groups that protested against recruiters who visited their campuses in April 2005.

The students were angry when they turned up in the database of a Pentagon program called Threat and Local Observation Notice, or TALON, which the government started in 2003 as a way to collect data that could help stop terrorist attacks. Officials have acknowledged that the reports on protests should not have been included.

In the Santa Cruz and Berkeley reports, the source of information was listed as an agent for Homeland Security's Federal Protective Service. The reports were filed by the 902nd Military Intelligence Group, the Army's largest counterespionage unit.

"This raises questions about whether the Department of Homeland Security tasked somebody to gather information about anti-war activities," said Mark Schlosberg, police practices policy director for the ACLU's Northern California office.

Dennis O'Connor, a spokesman for the Federal Protective Service, said his agency protects 9,000 federal sites. Agents disseminate publicly available information about protests, he said, but do not investigate them or their organizers, spy on them or try to hinder them. He said he did not know how the information ended up in the terror database.

"If we're not aware of what's going on around us, we can't do our job effectively," he said. "Even if a protest is going to be peaceful, we have to be aware of it."

The reports say the FBI's Joint Terrorism Task Force in San Francisco had been briefed on the protests. FBI spokeswoman LaRae Quy said the agency had taken no action related to the protests.

The report on the Berkeley protest said the Homeland Security agent received an e-mail on April 18, 2005, announcing a "counter-recruitment" and civil disobedience action three days later, when recruiters would be at a career fair. In a section titled "Agent Notes," the report states, "There is a strong potential for a confrontation at this protest given the strong support for anti-war protests and movements in the past."

NBC News revealed the database in December. The Pentagon acknowledged that the protest reports should not have been included in the database, which now has more than 13,000 entries.

The reports "have been removed," Pentagon spokesman Greg Hicks said Tuesday.

Schlosberg said the ACLU is seeking further information. In the documents released Tuesday, the government blacked out the source of the e-mails to the Homeland Security agent.

Unfortunately. bush and company have a huge man-power pool to draw from w/o instituting the draft. I refer to reserves, NGs, and class I, class II and even class III military retirees.

I'd like to see some figures on actual illeagals in the military. When I was a 'cruiter the only way we could put a non-citizen in, is if they had a green card. Have these requirements changed?

Better information and commentary here -

The first soldier to die in the latest US war, the war on Iraq, was a Latino- American, and one of the first captives in this war was an African American female from Georgia. When we look at the ethnic composition of US soldiers, we see a high percentage of Latinos and African Americans. There is no corresponding numbers of Asian Americans.

The word was circulated in US/Mexico border states that the US was recruiting Mexicans into the military with the promise of citizenship to those who enlisted, and many young Mexicans went to the US embassy and recruiting stations seeking to enlist if the promise were true. The US later released a statement that this promise of citizenship was not true.

Rather than staunching the tide of recruits that tide kept coming, especially after a number of Latinos were killed or wounded. For they saw that those killed were awarded posthumous citizenship, and those wounded were awarded actual citizenship, with the benefits of their military services.

Beyond military recruiting at American high schools and colleges, the US is also recruiting in Border States to get young Mexicans to enlist in the military. These young people feel their chances of becoming a citizen of the US are better if they enlist and fight. While the US has disclaimed any promises of citizenship, this enticement is, no doubt, still there whether it is being explicitly offered or implicitly dangled before them. So young Mexicans are enlisting in the US military, and as we can see, they are dying in the US military.

This recruitment of Mexicans to fight in the US military raises ethical problems that should trouble our leaders. Why should a nation recruit foreigners to fight its wars? When a war is unjust mercenaries and proxies are the standard methods of fighting such wars? It does not matter historically that this has occurred, the fact is that when US citizens are in the US military and are dying openly, our leaders and our people think more carefully before cavalierly marshaling our forces into a needless battle, like Iraq.

With US citizens in war, our leaders are still callous about their lives because they have no children, relatives, or friends on the battlefield. But with non-citizens from countries such as Mexico fighting and dying for the flag, that fuels their callous fire even more.

Our political leaders, who mostly have no shame about matters that are utterly shameful in which they involve this nation, ala Bush versus Hussein, need to be watched and tethered closely to certain principles, lest they act precipitously and personally, plunging this nation into battles that kill Americans and other people, as they glory in war and the beauty of their military killing machinery.

With Afghanistan and Iraq not nearly finished, arm-chair, battle-thirsty old men in the White House have announced that Syria has weapons of mass destruction and is harboring terrorists. Hence, they are marshaling their rhetoric against that state for a future marshalling of military forces against it.

This nation under George Bush of Texas and Dick Cheney of Halliburton has become a war-like nation, but it cannot fight the many battles these warriors by proxy want to fight using mercenaries, whether they are paid in dollars or in citizenship. For as long as others are dying, non-Americans are dying, we will fight war after war in the name of preemption, in the name of terrorism, in the name of homeland security, in the name of liberating others from dictators and self-appointed leaders, in the name of installing democracy, in the name of any other seeming noble rationale as long as our unspoken but certain end is met--avarice and power.

OK.

According to the Army recruiting website you STILL must have an I-151 or "green" card to be elgible for enlistment. Hence "ILLeagals" are NOT qualified for enlistment.

Having said that, I guess one could posit the proposition that a recruiter(s) would fanbricate an alien resident card in order to inlist an applicant, but this would be fool-hardy to say the least. It would be easily detected and the penalty for same would be much more than, say, asking an aplicant to lie about moral or physical deficincies.

So I guess what is ACTUALLY being said is that "the military is offering fast track citizenship to resident aliens after serving." That is quite a different propostion than "fast tracking ILLeagal aliens."

I am as distressed as the next person as to what bush has done to the military...it is broken. But I never could accept the notion of recruiting Jose and Juan fresh from jumping the border.

Unless there is something else I don't see here, I have to believe that the talk of "ILLeagal alines" being recruited in droves is urban legend.

This week, a general court martial is to begin at Parris Island, South Carolina, for a U.S. Marine recruiter accused of selling and delivering counterfeit documents to illegal aliens in order for them to join the service. Gunnery Sergeant Hubert A. Lucas, 35, is one of four suspects named in a report by the Naval Criminal Investigative Service, part of which was obtained by the Voice.

The report says an investigation began on August 11, 2004, after an intelligence report by the U.S. Immigration and Customs Enforcement agency revealed that a Marine at Camp Pendleton in California, who had admitted to entering the United States illegally and enlisting with a counterfeit green card and stolen Social Security number, identified Lucas as the individual who charged her $250 for the documents for the purpose of effecting her fraudulent enlistment in the Marine Corps.

During an interview, the Marine told immigration authorities that she bought the counterfeit documents from people in New York City who told her they’d be delivered to a specific hotel in Miami and to await further instructions. Those eventual instructions were to enlist at the Marine recruiting sub-station in Perrine in Miami-Dade County, Florida. According to the report, the recruit also said she “engaged in a consensual sexual relationship” with Lucas. (One of the charges against Lucas is that he housed one or more prospective recruits in his personal quarters.)

Her accusations prompted a review of recruiting activity at the Perrine sub- station. According to the report, investigators found 23 recruits who may have fraudulently entered the Marine Corps. Twenty suspect alien registration numbers, along with Social Security numbers for all 23 recruits, were queried through federal databases. It turned out that every single one was “either completely fraudulent or assigned to a different person.” The investigation later identified three more alien recruits suspected of fraudulently enlisting.

The charges against Lucas span from late 2001 to mid-2004, and include fraudulent enlistment, conspiracy to commit fraud, and dereliction of duty. Potential sanctions include dishonorable discharge, several years’ jail time and forfeiture of pay, according to a Marine Corps spokesman.

Captain John Schwab, defense counsel for Lucas, was unable to comment for this article.

Investigators seem prepared to say this was simply a money-making scheme. “The facts seem to indicate that this was only a for-profit fraud case and it is being investigated as such,” said NCIS spokesman Ed Buice in an e-mail.

Lucas’s trial comes at time when the Army is having trouble meeting its recruiting goals, a shortfall generally attributed to the prolonged and bloody combat in Iraq. But unlike the Army, the Marine Corps reported that it has been exceeding its goals, enlisting 29,173 recruits between October 1, 2004, and August 31 of this year. At the Lucas sub-station, “productivity was about average,” said Master Sergeant Rhys Evans, a spokesperson for the Sixth Marine Corps District.

Legal permanent residents are allowed to serve in the armed forces, if they present a green card. It used to be that those cards, as with documents from native-born recruits, where vetted by the recruiter and a liaison from the local Military Entrance Processing Station, according to a Marine Corps spokesman.

But last year, after several cases surfaced of illegal aliens enlisting in the military using counterfeit documents, the Defense Department told the Military Entrance Processing Command to begin verifying alien registration and Social Security numbers with the appropriate federal authorities. This may mean that many illegal aliens who have enlisted since are case s of identify-theft.

There are currently about 37,500 foreign nationals from over 200 countries serving in the active duty forces and reserves . Seventy-one have died in Iraq and three in Afghanistan. The law currently provides for expediting the citizenship applications of U.S. service personnel, who become eligible to apply the first day they enlist. The presence of non-citizens in the U.S. armed forces dates back to the 18th century—“more than 660,000 military veterans became citizens through naturalization between 1862 and 2000,” according to a report by the nonprofit CNA Corporation.

Service by illegal immigrants is another matter entirely. The penalty for emerging from invisibility varies from case to case. Some have faced discharge and even deportation from the country they have sworn to defend.

Here's my take-

During the late 70s when they began recruiting for the all volunteer army and things were tough, there was a group of army recruiters in the San Diego area that were PRINTING I-151 cards, and holding English and ASVAB classes for ILLeagals. they were caught up early on and charged with crimes including military and federal civilian crimes. Christ, what they were doing sounded like a lot more work to me than just doing some honest(?) recruiting!!! Secondly, anyone with a brain would KNOW, as the more recent offenders found out that frauding a citizenship issue is folley.

Another issue, as far as importing illeagals into the military straight from jumping the border is the ASVAB issue. If you are not fluent in written English, you ain't gunna pass. Sure, there are some tricks, I've known 'cruiters that had 'professional test takers' those that would take the asvab under another applicants name...these guys always got caught up pretty quick.

Then there is the documents issue, SSAN card, birth certificate and possibly HS diploma, all easily forged, but when you look at it, the amount of fraud necessary to enlist one ILLeqagal is huge.

Sure, it's been tried, and it's been done. But not on any large scale. It would require so many people in so many areas to turn a blind eye or be devestatingly stupid, it is beyond belief.

While I was on recruiting duty, most of the rule twisting and bending was done on the morals and physical issues. Try and find a young man in the SF bay area that hasn't smoked grass...if he don't lie about it, he ain't getting in. There are also some pretty stupid physical disqaulifications that recruiters would tell applicants to shut up about. Getting busted for any of that alone would be a career ender.

The reason there are so many hispanics/minorities in the military is the same reason there are so many poverty prone whites in there...lack of education, lack of skills/training, and it's easier to sell them a bill of goods.

Lod, those are just observations and thoughts from what I've seen. Sure things change, but unless I see something in B&W numbers on actual ILLeagal aliens in the military, I ain't buying it.

Of course there IS the possibility that INS is in cahoots and issuing I-151s to border jumpers for enlistment purposes...but there are still the tests and language problems...JMHO, ol' buddy.
