With so much attention focused on George W. Bush's "Freedom Agenda" oversees in Iraq, Afghanistan, secret CIA torture prisons, and the like, I'd like to direct your attention to the Freedom Agenda here in what used to be known, until 2000, as the United States of America.

We all know Greg Palast as one of the last of an endangered species in this country - the investigative journalist. He has reported on everything from shady big business dealings to electoral shenanigans that have clouded the last several national US elections, and if the current reincarnation of Richard Nixon squatting in our White House has his way, Greg might be in big trouble...

Writing for Greg's website, Zach Roberts reports that Palast is under criminal investigation by the Department of Homeland Security for filming a site owned by Exxon Mobil for a Hurricane Katrina documentary.

Yes, the rumor's true. Greg Palast is facing a criminal complaint from the Department of Homeland Security stemming from his filming the Hurricane Katrina investigation for Link TV and Democracy Now. The film's producer, Matt Pascarella, is also facing the legal wrath of Big Brother.

It appears the complaint is about filming a sensitive national security site owned by Exxon petroleum. It seems that photographing major Bush donors is now a federal offense.

Reached at an undisclosed location, Palast says, "Let's not get over-excited. They haven't measured us for our orange suits yet."

During questioning by Homeland Security, Palast asked, "Hey, aren't you supposed to be looking for Osama? Or for guys with exploding shoes? ... We're journalists." At Palast's request, Homeland Security confirmed that Louisiana is, indeed, still part of the USA but did not respond when asked if the First Amendment applies there.

Exxon-Mobil now apparently has DHS protection.

Taking a quick glance at history and the state of our own Republic, this is, in my view, another textbook example of authoritarianism in collusion with corporatism bound in a determined pact to destroy liberty in the name of advancing it.

We must be ever vigilant.

I can't help remember that I heard Greg Palast's charges about Katrina on an interview of him by Mike Malloy, subbing as host of Randi Rhodes's radio show, a couple of weeks ago, and that the very next day it was announced that Malloy had been fired by Air America. Coincidence?

smoke and mirrors, fraud and deception, call it what you will. The USA, aks U.S., etc. is a corporation. There are two United States, or three.... There are two "Constitutions", the one signed by George Washington et al, and the one instituted by the banksters in 1871. For the most part, it looks like the original, but they doctored the name, left off the Preamble to the Bill of Rights [ http://www.harbornet.com/righ ts/lindat.html ], took out and disappeared the original thirteenth amendment [ http://www.barefootsworld.net/ 13essay.html ], added the deceptive, fraudulent, and unratified 14th, and then the 15th, and the unratified 16th [ http://www.thelawthatnever was.com/new/home.asp ], and the 17th amendment that allowed Senators to be bought and sold on the world market.

It bears the original 10 amendments [Bill of Rights], but they are negated by the 14th, which is communist, and calls for privileges bestowed and taken away by government. So as not to alarm us, they pretend that the Bill of Rights is in effect, but don't try to argue your rights in a court with the Martial Law flag, gold-fringed with the eagle [Ezekiel 17:7-10] on top. "The Constitution is a contract, it is true, but [the people] are not a party to it." [search]

However, this could prove to be GOOD news:

".....Jefferson also noted that the federal government and its courts are not the final arbitrator of the Constitution or the extent of the powers delegated to the federal government. Since the Constitution is a compact between the several States, and the federal government is not a party, but the result of that compact, it has no constitutional power to define the extent of the powers delegated to itself. Only the individual States, as the exclusive parties to the compact between themselves, possess that power. The Constitution, as stated above, is a compact, or in modern terminology, a contract. Black's Law Dictionary, the definitive legal dictionary of the twentieth century defines a compact as:

An agreement; a contract. Usually applied to conventions between nations or sovereign states.

The Constitution, as discussed previously, was established by a federal convention of sovereign States. The parties to the contract, known as the Constitution for the United States of America, are the individual States. Neither the federal government, nor the people, as comprising one nation, are a party to the agreement between the several States. It is a fundamental principle of contract law that a contract cannot be applied or enforced against any entity or individual that is not a party to the contract. Since the American people are not a party to the contract, and have no direct voice in the amendment of that contract, the federal government cannot have any general legislative authority over the people of the several States.

Agent of the States

In his classic work of 1868, "The Federal Government, Its True Nature and Character," Abel Upshur construed the federal government as a mere agent created by several States via the Constitution. He also stated the Constitution was a compact [contract] between the several States:

The Federal Government is the creature of the States. It is not a party to the Constitution, but the result of it — the creation of that agreement which was made by the States as parties. It is a mere agent, entrusted with limited powers for certain specific objects; which powers and objects are enumerated in the Constitution.

He continued by stating:

According to the principles of all our institutions, sovereignty does not reside in any government whatever, neither State nor federal... The true sovereignty of the United States...is in the States, and not in the people of the United States, nor in the Federal Government. That government is but the agent through whom a portion of this sovereign power is exerted; possessing no sovereignty itself, and exerting no power, except which only as its constituents [the States] have conferred on it. In ascertaining what these powers are, it is obviously proper that we should look only to the grant from which they are derived. The agent can claim nothing for itself, and on its own account. The Constitution is a compact, and the parties to it are each State, with each and every other State. The Federal Government is not a party, but is the mere creature of the agreement between the States as parties.

Upshur, who had been Secretary of State and Secretary of the Navy, had an intimate knowledge of the Constitution and the purpose of the federal government. His book remains, in the authors' opinion, the definitive commentary on the nature of the Constitution and the character of the federal government.

Conclusion

Contrary to popular belief, the Constitution is simply a contract between the several States. When the States adopted the Constitution, they created a common agent called the federal government. They authorized their agent, through the contract, with the authority to perform limited enumerated functions that would be difficult or impossible for the States to perform individually. As stated by Alexander Hamilton, the powers of the States' agent, the federal government, pertain to the States in their united or collective capacity. Thus, the federal government is the common government of the several States, not the general government of the American people, as comprising one nation. As such, it has no general authority over the people of the several States because they are not a party to the contract commonly known as the Constitution for the United States [States united]."
