WASHINGTON Sep 29, 2006 (AP)— Rep. Mark Foley, R-Fla., submitted a letter of resignation from Congress on Friday in the wake of questions about e-mails he wrote a former male page, according to a congressional official.

Foley, 52, had been considered a shoo-in for re-election until the e-mails surfaced in recent days.

Campaign aides had previously acknowledged that the Republican congressman e-mailed the former Capitol page five times, but had said there was nothing inappropriate about the exchange. The page was 16 at the time of the e-mail correspondence.

Foley's election opponent, Democrat Tim Mahoney, has called for an investigation.

When you have states rights, community standards, which may differ from area to area, apply. The other alternative would be a uniform federal age, which I would hardly like to see because I don't want to expand the fedgov.

I don't want a Federal minimum age either. It's not necessary. I see the current hodgepodge of laws as a result of replacing common law crimes with statute. That's why they call it "statutory rape". It's something created by arbitrary political edict.

A common law rape has three elements:

A) Was the alleged victim capable of granting consent

B) Was consent granted.

C) mens rea (guilty mind or intent).

It takes into consideration situational conditions and what is "generally accepted by a reasonable person" and allows for juries and judges to exercise common sense. None of this is allowed in statutory crimes.

I read about cases in California where undercover US federal agents hired teen girls aged 14-16 to take their clothes off for the camera.

Isn't it nice how our masters don't have to follow the same laws as us when "pursuing their legal duties"? It's the same as the undercover cop who makes multiple drug purchases and is exempted. It's not a matter of the officer incidentally coming into contact with contraband in the line of duty in order to capture it for evidence, but of someone intentionally seeking out the contraband in a manner that would send anyone of us to the clink.

The name of any person so designated shall be submitted to the Department of State within 7 days after notice to the chair in order that the person designated may have his or her name on the ballot of the ensuing general election. If the name of the new nominee is submitted after the certification of results of the preceding primary election, however, the ballots shall not be changed and the former party nominee's name will appear on the ballot. Any ballots cast for the former party nominee will be counted for the person designated by the political party to replace the former party nominee.

that's exactly correct.

in the cases I read about that occurred in early 1990's I believe it was the federal government that produced what they called 'child pornography', but was in fact girls 14-16 taking off their clothes down to their underwear, no total nudity and no actual sex. and then the federal government marketed the child porn to young men who otherwise would not have bought it. and then these young men are saddled with the felony and the 20 years in jail and forever they are 'child porn' offenders. their lives are ruined. and this is so they can protect us from child porn. they are purposely dysfunctional in their enforcement.

16 year olds are more mature physically than they were even 50 years ago due to nutrition and more sophisticated due to their exposure to media. But at the same time the evidence shows they are less mature mentally and less educated.

100 years ago in this country it was acceptable for a 22 year old to marry a 15 year old and start a family. Age disparate marriages were even encouraged as the older spouse was more financially established. Now in many states this is forbidden without court approval, but that same 15 year old would be tried as an adult in a criminal court. 100 years ago the married 15 year old with a family would be treated as a juvenile in a criminal proceeding. 180 degrees.

those are keen observations in #171. I personally think that the modern practice of preventing or discouraging people from getting married at a young age is frequently very harmful to people. They're physically ready when they're young. and if they wait they will develop bad habits and patterns. that is my opinion anyway.
