Neocon Academics: Constitution is a “Suicide Pact”

It should come as no surprise Sanford Levinson, professor at the University of Texas School of Law, mistrusts the Constitution and the Bill of Rights, as he has little idea of what the document stands for. It is not surprising, as Levinson hobnobs with the Federalist Society, the “conservative” legal association funded lavishly by the CIA asset Richard Mellon Scaife. As well, the Federalist Society received seed funding from Irving Kristol, the grand daddy of the neocon cabal, and his son, Bill Kristol, the neocon voice of Fox News, is connected at the hip to the Federalist Society.

According to Levinson, the Constitution is “undemocratic,” a remarkable comment from a supposed law professor. Article 4, Section 4 of the Constitution guarantees to every state a republican form of government, not a democratic one. In a republic, people enjoy natural rights, while in a democracy they are limited to “civil rights” granted by the government. In other words, under Levinson’s democracy, the Bill of Rights is meaningless, as it protects minority rights. In a democracy, 51% of the people can vote to rob the remainder of their money, property, even their lives.

7th U.S. Circuit Court of Appeals Judge Richard Posner, also closely related to the Federalist Society, believes the Constitution was never meant to be a “suicide pact” during a time of “national emergency,” that is to say five years after nine eleven, an unsolved crime blamed on Muslims, minus any convincing evidence. Posner argues “that in a terrorism-induced choice between individual freedoms and collective security, the Constitution was never intended to side with the first at the expense of the second,” explains CBS legal analyst Andrew Cohen. “Judge Posner is ready to make malleable the protections contained in the Constitution; he’s ready to have bedrock individual rights and protections ebb and flow along a sliding scale depending upon the scope of the crisis,” a reaction that would likely raise the hair on the back of Thomas Jefferson’s neck, if he was around to witness the destruction of the Constitution and the Bill of Rights.

“Yale Law School guru Bruce Ackerman,” writes Cohen, “also doesn’t want to be ‘blindly devoted’ to the document we all are taught in public school to be blindly devoted to.” Ackerman envisions an “emergency” Constitution, or rather a series of provisions tacked on to the existing Constitution, “that will help guide us when the next terrorism attack surely comes.” According to Ackerman, we need a new law “that allows for effective short-term measures that will do everything plausible to stop a second strike—but which firmly draws the line against permanent restrictions.” It would seem Ackerman had his nose buried so long in a law book that he never had a chance to read a history book. Natural rights taken in the name of expediency are never restored, but rather need to be wrested back through revolution and violence.

In effect, Richard Posner, as a judge, is legally a traitor, as he swore to uphold and protect the Constitution of the United States. Levinson and Ackerman, on the other hand, are simply quislings, no different than the autocratic and fascistic neocons who loathe the Constitution, as it stands opposed to their Machiavellian plan, mixed with a heaping dose of the authoritarian theories of the Nazi “crown” jurist Carl Schmitt, who denied free will and natural rights.

It should be obvious by now that the neocons and their allies are using the engineered threat of terrorism to undermine our liberties and reduce America to a dictatorship. Bush’s so-called Military Commissions Act is a huge leap in that direction, as it guts the underlying premise of the Constitution, namely that citizens of a republic are entitled to habeas corpus.

Expect more authoritarian salvos directed against the Constitution—indeed, against the bedrock premise of natural rights—in the weeks and months ahead, especially after the Republicans steal the midterm elections. Of course, even if they are unable to do this, and the Democrats regain control of the House and the Senate, nothing will change, as the Democrats are as dedicated to destroying the Constitution and carrying on the bogus war against manufactured terrorism

All except for most notably and heroically Patrick Henry, George Mason, perhaps, and a couple of others, I seriously doubt it.

Truthfully, it started when President Washington used the first "emergency power’s act" in 1791, so he could, unconstitutionally in peace time, but constitutional in war time because it was "necessary" to install the first private bank in America. He then set up each State as a "district State" so the United States could control through its "district courts" what it could not do under the original constitution in time of peace. They took the physical State and overlaid it with a fictitious "district state." That is why you have U.S. district courts in every State of the Union. To get to the bottom of all your woes today, one must go back in time to see how they accomplished this. This is why I have stated that IF the people, the common everyday people, had really drafted AND ratified their own creation of a contract, do you think they would, or rather put you in their position, drafted such a damaging piece of paper called the "Constitution?" I know I would not have. Especially the emergency powers part where once the President took control, constitutionally mind you, that it would be the engine for total control. Such has been the case since 1791. Patrick Henry and the other anti- federalists saw what was happening and the common average man on the street, just like today, said it could not happen and allowed this to happen out of shear ignorance. Today we have most of the people who have no clue what really took place. They cannot fathom why they rape them repeatedly again and cannot claim their unalienable rights. They cannot understand why the so-called Bill of Rights can no longer be used. They cannot understand why the Constitution that they thought was theirs, is not, and cannot be used in the prize courts of admiralty. Simply stated, "enemies have no rights."

What is fascinating is this passage from Solicitor of Lincoln's War Department, William Whiting's book on War Powers, where he wrote;

"The belligerent right of the government to confiscate enemy's real estates, situated in this country, can hardly admit of question. The title is to no inconsiderable part of real estate in each of the original States of the Union, rests upon the validity of confiscation acts, passed by our ancestors against loyal adherents to the crown. Probably none of these States failed to pass and apply these laws. English and American acts of confiscation were recognized by the laws of both countries, and their operation modified by treaties; their validity was never denied. The only authority which either of the States or colonies ever had for passing such laws was derived from the fact that they were belligerents."

Right here it is evident that the States, created the same way the United States was, by the aristocrats, would consider themselves belligerents against the common man on the street who had no say in the drafting and ratifying of any of the constitutions of any of the States. The common man had no money to speak of nor any large amount of real property to be able to become a member of the contract called the State. In all the States you had to have at least 500 pounds sterling or a land mass equivalent to that amount before becoming an elector or even thinking of running for office. This is but another small proof that you and me, the common man of that era, was considered as nothing. Just like we look at street bums of today, they looked at the common man. No dear people, we were never considered part of their posterity and never drafted nor ratified any constitution. The statement the constitution was "divinely inspired" is so far from the truth that it should be stated that it was the "works of the devil."

The Constitution, preaching life, liberty, and the pursuit of happiness, was a ploy to get their foot in the door in order to destroy all those things.

Yet the Bible says, If the Son hath made you free, YE SHALL BE FREE INDEED. Our hope is not in the Constitution, but in God.

Incidentally, Mount Vernon has apparently just finished a new museum extolling their 'god' George Washington, and have come up with a statue, that, in my opinion, shows him as I have seen him for a long time....a pompous ass. Why they gave him the expression they did, something on the order of the smirk's, I don't know, but it sure fits. He brought the militia down on ex-Revolutionary War soldiers trying to make a dime to support their families by distilling their grain, and shipping it on its long route to market. They taxed the small farmer something like 9 cents to the big producers' 2 or 3 cents. After destroying the competition, George Washington became one of the biggest distillers in the colony. Guess I better stop there. I'm no fan of George Washington.
