SIERRA VISTA, Ariz. | An anti-illegal immigration activist accused of threatening to shoot a Mexican-American family of hunters with an assault rifle and using racial slurs against them was ordered to pay them $98,000.

A civil jury held rancher Roger Barnett only partly responsible, saying some of the blame lay with the man who sued and the man's father.

Ronald Morales and his father, Arturo, were with his two young daughters and their friend when Barnett confronted them near his Douglas-area ranch and accused them of trespassing Oct. 30, 2004.

Morales' lawsuit claims they were legally crossing land Barnett leases from the state. The Moraleses are U.S. citizens of Mexican descent.

Barnett, who claims to have detained more than 10,000 migrants in the last 10 years, denied threatening the hunting party. He testified that he only took out his AR-15 rifle because the adults in the group were carrying rifles.

Morales, a Navy veteran, said he felt justice had been served by the verdict.

"We came to court and spoke the truth, and the jury heard that truth," Morales said. "Hopefully this sends a message that you can't point a gun at little kids - or anybody for that matter - and then threaten to shoot them."

Barnett declined to comment, saying his lawyer advised him against speaking. His brother, Donald Barnett, expressed disappointment.

"In the Morales family, the father taught the son to trespass, and now the father's teaching the daughters how to trespass in blatant disregard for the law," said Donald Barnett, who was initially named in the suit but later dropped as a defendant. "I guess in this country, private property and a person's rights don't mean much any more."

The lawsuit was sponsored by the Border Action Network and the Southern Poverty Law Center, civil rights groups that have accused Barnett of acting as a vigilante and abusing illegal immigrants he detains on his ranch.

The family sued Barnett for assault, false imprisonment, negligence and intentional infliction of emotional distress. The jury found in favor of all five plaintiffs Wednesday.

Morales said he asked the Cochise County Attorney to press criminal charges against Barnett, but was told no jury would convict him.

It would appear that hunters may lawfully access state lands that are leased to citizens except when limited permits are issued to deny access, and then for no more than 30 days.

And, I'm betting that this individual could tell at a glance that these Mexican-Americans were lawfully hunting or plinking, and were not your average mojados.

In other words, he was wrong to confront them.

An experienced "Wet Mex herder" should be savvy enough to tell the diff between them and legal residents and citizens.

So, he may have been venting his frustrations on browns with little regard for their rights, in which case the judgment was proper.

Using easement rights to get to government land is not 'fucking up.' He only has redress of grievances with hunters if he has posted his land as off limits to hunting and catches people violating that.

He caught them traversing his land to get to public land. The easement for people to do that was something he could not prevent as per well established custom with easements for access.

They lost their case, too.

Those folks were not guilty until they could plead and beg on their knees plaintively that they were innocent. They were innocent until proven guilty.

If they are American citizens, and moving with a purpose in the direction of known public land where people hunt during hunting season, dummy should leave them the hell alone.

The civil case shall be appealed. Lets see the outcome then.

The judgment will be upheld, and then you'll rant against the only other part of Anglo-American jurisprudence that you haven't already trashed. (And, btw the case isn't re-tried in an appeal, only the procedures and proper admission and/or exclusion of evidence will be reviewed. Since no one made any motions to suppress any evidence, i.e. the AZ hunting laws and the facts cannot be re-tried, there are simply no appealable issues but the size of the award. And even that won't affect the finding of liability on the part of the rancher.

Or, perhaps you're hoping that the AZ Court Of Appeals, the state supreme court or even the SCOTUS will find that no white man should ever be criminally convicted or liable for the commission of a willful tort against brown skinned people, or convicted on the testimony of same? Good luck when reality comes crashing in. Hope it doesn't hurt too, too much.

If you still don't understand then I'll explain it to you and the rest of your klavern. It's a principle known as "justice" and it doesn't come from a bunch of drunks with a length of rope. Your thought processes resemble the Mexicans' more than you know, amigo. If you believe that might makes right then you'll fit in perfectly in "Nuevo Aztlan". Oh, wait. You're white, right? No justice for you! (And, you certainly understand that.)

According to you the innocent are guilty and there's no need for evidence beyond a newspaper clipping, and the guilty are innocent despite a trial. And, now you're pinning your hopes on a higher tribunal of the same system that just "got it 100% wrong" to reinforce your irrational hatred and prejudice. So, is the court of appeals all wise and will you accept their findings? Or, are they bunch of turds despite your confidence in them? Why would you display so much confidence in a bunch of turds? Or, are they wise if they agree with you and turds if they don't? (Mommy, I want what I want when I want it! Good mommies gimme what I want. Baaaad mommies say no to mee! BWAAAAAAAAA!!)

Under your system of "justice" newspaper reporters would be virtual gods and citizens would be powerless to resist their powerful spin of newspaper stories and the punishments that would follow. (And, there go your guns, too. Reporters would certainly take them away and who are we to argue with that "wisdom" on your behalf? HAH!)

So, you'd cheerfully destroy a thousand years of law and substitute brute force in service to the whims of childish Pollyannas as long as brown people are made to suffer in this case.
