SIERRA VISTA, Ariz. | An anti-illegal immigration activist accused of threatening to shoot a Mexican-American family of hunters with an assault rifle and using racial slurs against them was ordered to pay them $98,000.

A civil jury held rancher Roger Barnett only partly responsible, saying some of the blame lay with the man who sued and the man's father.

Ronald Morales and his father, Arturo, were with his two young daughters and their friend when Barnett confronted them near his Douglas-area ranch and accused them of trespassing Oct. 30, 2004.

Morales' lawsuit claims they were legally crossing land Barnett leases from the state. The Moraleses are U.S. citizens of Mexican descent.

Barnett, who claims to have detained more than 10,000 migrants in the last 10 years, denied threatening the hunting party. He testified that he only took out his AR-15 rifle because the adults in the group were carrying rifles.

Morales, a Navy veteran, said he felt justice had been served by the verdict.

"We came to court and spoke the truth, and the jury heard that truth," Morales said. "Hopefully this sends a message that you can't point a gun at little kids - or anybody for that matter - and then threaten to shoot them."

Barnett declined to comment, saying his lawyer advised him against speaking. His brother, Donald Barnett, expressed disappointment.

"In the Morales family, the father taught the son to trespass, and now the father's teaching the daughters how to trespass in blatant disregard for the law," said Donald Barnett, who was initially named in the suit but later dropped as a defendant. "I guess in this country, private property and a person's rights don't mean much any more."

The lawsuit was sponsored by the Border Action Network and the Southern Poverty Law Center, civil rights groups that have accused Barnett of acting as a vigilante and abusing illegal immigrants he detains on his ranch.

The family sued Barnett for assault, false imprisonment, negligence and intentional infliction of emotional distress. The jury found in favor of all five plaintiffs Wednesday.

Morales said he asked the Cochise County Attorney to press criminal charges against Barnett, but was told no jury would convict him.

The Commission may grant permission to lock or obliterate a gate or close a road or trail that provides legally available access to state lands for licensed hunters and fishermen if access to such lands is provided by a reasonable alternate route. Under R12-4-610, the Director may grant a permit to a state land lessee to temporarily lock a gate or close an existing road that provides access to state lands if the taking of wildlife will cause unreasonable interference during a critical livestock or commercial operation. This permit shall not exceed 30 days. Applications for permits for more than 30 days shall be submitted to the Commission for approval. If a permit is issued to temporarily close a road or gate, a copy of the permit shall be posted at the point of the closure during the period of the closure.

K. When hunting, fishing, or trapping on state land, a license holder shall not:

1. Break or remove any lock or cut any fence to gain access to state land;

2. Open and not immediately close a gate;

It would appear that hunters may lawfully access state lands that are leased to citizens except when limited permits are issued to deny access, and then for no more than 30 days.

And, I'm betting that this individual could tell at a glance that these Mexican-Americans were lawfully hunting or plinking, and were not your average mojados.

In other words, he was wrong to confront them.

An experienced "Wet Mex herder" should be savvy enough to tell the diff between them and legal residents and citizens.

So, he may have been venting his frustrations on browns with little regard for their rights, in which case the judgment was proper.

Good post. I am irritated to see so many at LP sounding and acting so FReeperish on this story. Goldi has succeeded in driving any element of reasoned voice out of an argument when you hear a lynch mob's chorus instead of a reasoned discussion on issues.

The immigration problem denotes why I throw up at the hypocrisy of Christianity.

Anti-immigration people are so self righteous in decrying how they are hated and disrespected so much as Americans by the influx, but they are too chicken to take on those promoting the influx scared by their political and economic power and do exactly the wrong thing which is hate and bait the desperate mases coming in scapegoating them as the easier target.

Why can't they see how much like a cowardly bully this makes them look?

Criticism of one's neighbor as these folks surely are should come with an acknowledgment of their humanity and a warm hand of friendship and empathy.

Even if it is extended with the desire for them to go back home in he heart of the hand's owner.

Being concerned on an issue never is an excuse to blindly hate a group of people.

That is just wrong.

He fucked up, and he didn't follow the standard of innocent until proved guilty. I would have taken his land away from him over this being he obviously is too immature to handle the stewardship responsibilities of it.

I have had to walk into a patch of government land through private property too. If a land owner pulled a piece on me and irrationally tried to make me his bitch because he was annoyed at dealings with other people in the past, I'd center shoot him at first opportunity for having put me in fear of my life.

Actually, he didn't "fuck up." The US government is responsible for border oversight ... they did not do their job. The State of Arizona is responsible for ensuring licensed hunters operate on state approved land.

He was simply doing the job he had to, since the government on all levels, neglected their duties. They must have been out to Starbucks for a coffee.

Using easement rights to get to government land is not 'fucking up.' He only has redress of grievances with hunters if he has posted his land as off limits to hunting and catches people violating that.

He caught them traversing his land to get to public land. The easement for people to do that was something he could not prevent as per well established custom with easements for access.

He was wrong and was admittedly rude and nasty because of their ethnic background assuming incorrectly they were Mexicans. He got off light in this tort filing.

So that's worth $98,000? The case was already thrown out of criminal court (Ronald, the gun toting Mexican, attempted to file criminal charges), so they used this back-handed venue which has little or no evidence requirements.

You buy that sort of stuff?

Ronald is an American of Mexican decent. I am an American of Irish and Puerto Rican decent. There's the rub. Ronald ain't no Mexican.

Many times a DA will avoid cases that are politically contentious or that do not have the chance of meeting the standard of prove of guilt beyond a reasonable doubt.

I'm sure you like the civil decision proven by preponderance of the evidence in OJ Simpson's case, and civil torts are not validated or invalidated based on criminal court considerations.

The ruling was fair and the award was too low, so it goes. He played the bigot game against an ethnic group that has the largest percentage of Medal of Honor awards and is noted for serving in the armed forces with distinction and lost.

As he deserved to.
