More than five years on, we're still uncovering how officials in our government either knew about, or more likely, were in on 9/11.

President Clinton's national security adviser removed classified documents from the National Archives, hid them under a construction trailer and later tried to find the trash collector to retrieve them, the agency's internal watchdog said Wednesday.

The report was issued more than a year after Sandy Berger pleaded guilty and received a criminal sentence for removing the documents.

Berger took the documents in the fall of 2003 while working to prepare himself and Clinton administration witnesses for testimony to the Sept. 11 commission. Berger was authorized as the Clinton administration's representative to make sure the commission got the correct classified materials.

Notice they say "the correct documents" and not ALL the documents pertinent to the investigation.

Berger's lawyer, Lanny Breuer, said in a statement that the contents of all the documents exist today and were made available to the commission.

But Rep. Tom Davis, R-Va., outgoing chairman of the House Government Reform Committee, said he's not convinced that the Archives can account for all the documents taken by Berger. Davis said working papers of National Security Council staff members are not inventoried by the Archives.

"There is absolutely no way to determine if Berger swiped any of these original documents. Consequently, there is no way to ever know if the 9/11 Commission received all required materials," Davis said.

I think it's pretty safe to assume that they DID NOT.

Berger pleaded guilty to unlawfully removing and retaining classified documents. He was fined $50,000, ordered to perform 100 hours of community service and was barred from access to classified material for three years.

WTF???

The man obstructed an investigation into the worst terrorist attack on U.S. soil in the history of our nation and he doesn't get jail time??? Un-f*cking-believable!

Inspector General Paul Brachfeld reported that National Archives employees spotted Berger bending down and fiddling with something white around his ankles.

The employees did not feel at the time there was enough information to confront someone of Berger's stature, the report said.

Later, when Berger was confronted by Archives officials about the missing documents, he lied by saying he did not take them, the report said.

Brachfeld's report included an investigator's notes, taken during an interview with Berger. The notes dramatically described Berger's removal of documents during an Oct. 2, 2003, visit to the Archives.

I have to get a hold of this report.

Berger took a break to go outside without an escort while it was dark. He had taken four documents in his pockets.

"He headed toward a construction area. ... Mr. Berger looked up and down the street, up into the windows of the Archives and the DOJ (Department of Justice), and did not see anyone," the interview notes said.

He then slid the documents under a construction trailer, according to the inspector general. Berger acknowledged that he later retrieved the documents from the construction area and returned with them to his office.

"He was aware of the risk he was taking," the inspector general's notes said. Berger then returned to the Archives building without fearing the documents would slip out of his pockets or that staff would notice that his pockets were bulging.

The notes said Berger had not been aware that Archives staff had been tracking the documents he was provided because of earlier suspicions from previous visits that he was removing materials. Also, the employees had made copies of some documents [Good for them!].

In October 2003, the report said, an Archives official called Berger to discuss missing documents from his visit two days earlier. The investigator's notes said, "Mr. Berger panicked because he realized he was caught."

The notes said that Berger had "destroyed, cut into small pieces, three of the four documents. These were put in the trash."

After the trash had been picked up, Berger "tried to find the trash collector but had no luck," the notes said.

Significant portions of the inspector general's report were redacted to protect privacy or national security.

This is just astonishing - NOTHING could be more important to National Security than apprehending and bringing to JUSTICE the criminals who orchestrated 9/11.

I totally agree. And if any common plebian tried to pull off this criminal caper that's where the person would be sentenced to serve his/her time.

Not that it will do much good at this point in time, but I'm going to write my 2 invisible senators and complain about this Berger case and ask why Berger should not be re-tried for war crimes against our nation state - Berger deliberately destroyed sensitive national documents - we are "at war" after all as of 09/11/01 according to Dear Leader - Berger's actions are tantamount to treason and that's the crime that fat ugly SOB should be tried for. A special prosecutor appointed by GWB should bring new war crimes charges. This Berger case bugs the heck out of me. If not Leavenworth, then Berger should be spirited away to Gitmo.

Becasue made members of the DC mafia don't do prison time. Men with security clearences like Berger has had will never do time. He has been inside the star chamber. He has seen the emperor naked. With what he knows- he could do massive damage to many insiders- expose the two party fraud- even pull the plug on a great number of Big Lies. Berger ins't some douche bag congressman who knows shit and is too stupid to know how to take legal bribes rather than illegal ones. Those asses get sent to prison. But not real insiders like Berger.

No major players or men with high security clearences do time unless it is going to be the big bitch - life- in a federal slam like Hanson or Aldridge Ames- and they are under strict control of whom they get to see and speak to because of what they know as well.

Nope- political battle among DC oligarchy made members is limited to petty ante "probes" that, at worst, amount to slaps on the wrist, probation, or removal of security clearences (which is like having the New York Times of insiders denied to you- the real news). The various factions have settled into a more or less standarized gentlemen's agreement about what is acceptable political warfare among their ranks- with the worst penalities pretty much known. And even if- they do actually manage to draw a prison sentence- like Web Hubbell- they are taken care of (like the half million he was given for "consulting" by connected Dem orgs within weeks of getting out of his 10 month prison term at a farm.)

This was more or less what Soviet apparatchik political battle settled into after the Death of Stalin. Instead of winding up in the Gulag- the worst that could happen to an apparatchik who lost a political struggle was no longer a bullet in the back of the head- but cozy forced retirment to his country dacha to play with the grandkids on a state pension with his access to the "special stores" still in tact.
