TITLE VII – H-5B Non-Immigrants 


Whereas what Congress actually passed is as follows;

From TEXT OF AMENDMENTS -- (Senate - January 24, 2007)

   ``Sec..250A..H- 5B nonimmigrants.''.

   SEC. 1702. ADJUSTMENT OF STATUS FOR H- 5B NONIMMIGRANTS.

    (a) In General.--Chapter 5 of title II of the Immigration and Nationality Act (8 U.S.C. 1255 et seq.) is amended by inserting after section 245A the following:

   ``ADJUSTMENT OF STATUS OF FORMER H-5B NONIMMIGRANT TO THAT OF PERSON ADMITTED FOR LAWFUL PERMANENT RESIDENCE

    ``Sec. 245B. (a) Requirements.- -The Secretary shall adjust the status of an alien from nonimmigrant status under section 101(a)(15)(H)(v)(b) to that of an alien lawfully admitted for permanent residence under this section if the alien satisfies the following requirements:

    ``(1) COMPLETION OF EMPLOYMENT OR EDUCATION REQUIREMENT.--The alien establishes that the alien has been employed in the United States, either full time, part time, seasonally, or self- employed, or has met the education requirements of subsection (f) or (g) of section 250A during the period required by section 250A (e).

    ``(2) RULEMAKING.--The Secretary shall establish regulations for the timely filing and processing of applications for adjustment of status for nonimmigrants under section 101(a)(15)(H)(v) (b).

    ``(3) APPLICATION AND FEE.--The alien who applies for adjustment of status under this section shall pay the following:

    ``(A) APPLICATION FEE.--An alien who files an application under section 245B of the Immigration and Nationality Act, shall pay an application fee, set by the Secretary.

    ``(B) ADDITIONAL FINE.--Before the adjudication of an application for adjustment of status filed under this section, an alien who is at least 21 years of age shall pay a fine of $1,000.

    ``(4) ADMISSIBLE UNDER IMMIGRATION LAWS.--The alien establishes that the alien is not inadmissible under section 212(a), except for any provision of that section that is not applicable or waived under section 250A(d) (2).

    ``(5) MEDICAL EXAMINATION.--The alien shall undergo, at the alien's expense, an appropriate medical examination (including a determination of immunization status) that conforms to generally accepted professional standards of medical practice.

    ``(6) PAYMENT OF INCOME TAXES.--

    ``(A) IN GENERAL.- -Not later than the date on which status is adjusted under this section, the alien shall establish the payment of all Federal income taxes owed for employment during the period of employment required by section 250A(e) by establishing that--

    ``(i) no such tax liability exists;

    ``(ii) all outstanding liabilities have been met; or

    ``(iii) the alien has entered into an agreement for payment of all outstanding liabilities with the Internal Revenue Service.

    ``(B) IRS COOPERATION.--The Commissioner of Internal Revenue shall provide documentation to an alien upon request to establish the payment of all income taxes required by this paragraph.

    ``(7) BASIC CITIZENSHIP SKILLS.--

    ``(A) IN GENERAL.--Except as provided in subparagraph (B), the alien shall establish that the alien--

    ``(i) meets the requirements of section 312; or

    ``(ii) is satisfactorily pursuing a course of study to achieve such an understanding of English and knowledge and understanding of the history and government of the United States.

    ``(B) RELATION TO NATURALIZATION EXAMINATION.--An alien who demonstrates that the alien meets the requirements of section 312 may be considered to have satisfied the requirements of that section for purposes of becoming naturalized as a citizen of the United States under title III.

    ``(8) SECURITY AND LAW ENFORCEMENT BACKGROUND CHECKS.--The Secretary shall conduct a security and law enforcement background check in accordance with procedures described in section 250A(h).

    ``(9) MILITARY SELECTIVE SERVICE.--The alien shall establish that if the alien is within the age period required under the Military Selective Service Act (50 U.S.C. App. 451 et seq.), that such alien has registered under that Act.

    ``(b) Treatment of Spouses and Children.--

    ``(1) ADJUSTMENT OF STATUS.--Notwithstanding any other provision of law, the Secretary of Homeland Security shall--

    ``(A) adjust the status to that of a lawful permanent resident under this section, or provide an immigrant visa to the spouse or child of an alien who adjusts status to that of a permanent resident under this section; or

    ``(B) adjust the status to that of a lawful permanent resident under this section for an alien who was the spouse or child of an alien who adjusts status or is eligible to adjust status to that of a permanent resident under section 245B in accordance with subsection (a), if--

    ``(i) the termination of the qualifying relationship was connected to domestic violence; and

    ``(ii) the spouse or child has been battered or subjected to extreme cruelty by the spouse or parent who adjusts status to that of a permanent resident under this section.

    ``(2) APPLICATION OF OTHER LAW.--In acting on applications filed under this subsection with respect to aliens who have been battered or subjected to extreme cruelty, the Secretary of Homeland Security shall apply the provisions of section 204(a)(1)(J) and the protections, prohibitions, and penalties under section 384 of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (8 U.S.C. 1367).

    ``(c) Judicial Review; Confidentiality; Penalties.--Subsections (n), (o), and (p) of section 250A shall apply to this section.''.

    (b) Clerical Amendment.--The table of contents for the Immigration and Nationality Act (8 U.S.C. 1101 et seq.) is amended by inserting after the item relating to section 245A the following:

   ``Sec..245B..Adjustment of status of former H- 5B nonimmigrant to that of person admitted for lawful permanent residence.''.

As it stands now, the Kennedy McCain Amnesty Bill, otherwise known as the Secure America and Orderly Immigration Act, has been inserted as an amendment into the Minimum Wage bill, and has been passed by the senate I believe.

A amnesty bill is just the first step of implementing the NAU, but a critical step to the plan. Without it, things will be a bit more difficult for the NWO to advance their agenda.

These slimeballs are getting away with this because the main stream press is NOT reporting on any of it. Once exposed to the light of day, the cockroaches will scurry, but with the general population in the dark about these things, there isn't much hope.

The minutiae of the immigration bill is supposed to make your head spin.

People should not give the minutiae details of the bill to their next door neighbors or work colleagues or relatives.

One would only need to say that there's a "pending bill" to forgive/give amnesty to 20 Million illegal aliens and the only recompense to the US taxpayer is that the illegal would pay a one time only $1000 fine and illegals under 21 are exempt from the fine.

Then one would encourage one's circle of friends/relative/colleagues to contact their Congressmen and Senators to deep-six this bill since it does not address anchor baby laws, unpaid income taxes, border fences to keep this from happening again, and employer fines for hiring immigrants who were illegal at the time to name a few items that require remedy.

Also the pending legislation increases the total of H-1B visas for engineers from India to displace American engineers.

Giving DVD's to people is a "stretch" remedy, IMO. You need to keep the message short and sweet to get the appropriate reaction and DVD's are not that way. People are busy these days. The only ones who would sit through a DVD presentation are in the choir already.

As for the North American Security Union, I agree with Former Lurker - that's far off and it's not in the bag by any means. We need to stick to the small here and now puzzle pieces that our nation faces today.

And defeating the guest worker amnesty bill would be a major step in thwarting the implementation of the NASU.

Fyi, Canada is a parliamentary system. The PM does not have the same powers as our President. Martin/Harper can't just sign on the dotted line. The PM would need to present this NASU to his Cabinet and after that, it would need to be voted on in Parliament and then passed on to the Senate. Where it gets tricky is the Parliamentary vote especially in the case of PM Harper. He is skating on thin ice with a minority government. His days are numbered. At this stage, Harper's gov't can be brought down with a "no confidence" vote. He does not want anything controversial coming up to a vote these days. Minority gov'ts last approx. 18 months. Harper was sworn into office in February, 2006. He's got another 6 month shelf life. Jorgas and Mexico's whatever would be nuts to think that Harper is going to chance his spot as PM with a vote on any NASU bill the next 6 months. No way. And it will be Canadians who will buck the idea of a contiguous border with the USA and Mexico - believe it or not it will be the USA part that will gall Canadians. There is no chance that Canadians want to share anything more than trade with the elephant.

I expect that eventually the 20 Million illegals will gain some sort of legal staus but I don't think the cart should be put before the horse - what about employer fines? or anchor baby practice? or a proper fence like what we pay for Israel to have? or what about income tax back payments? and what about the Mexocans who are waiting in the legal immigration queue, shouldn't they get into America first over the illegals and what about the Mexican oligarch families, what payment are they making to our General Treasury to pay for our educating and medicating and welfareizing their countrymen??

There are quite a few outstanding issues that need to be resolved before/if illegals can get their slates wiped clean.

Me too. He seemed like a fixture there, but lately it seemed he was TRYING to get himself banned, while trying to take a few of us down with him. Hello everyone!

In my first post here at Freedom4um, I wish to set the record straight regarding my recent banning at LibertyPost by that forum's owner.

Post #293 of the following LP thread,

is where Goldi-Lox kicked me off her forum. She stated I was "disruptive" to the thread (and it's "important message").

Her banning post was a response to a post I made to samcgwire. Goldi deleted, in its entirety, the post I made to samcgwire (#235), calling my post "UNCIVIL".

Now you can decide for yourself whether I was disruptive (at least, any more so than scores of other folks have been on thousand other threads at LP).

Before you do that, however, keep in mind that she responded to a post I'd made nearly 12 hours earlier, and between that time and her post, I posted nothing further to the thread (and there were another 60 posts added by then). I'd hardly characterize that the massive disruption she claimed it to be. And my response was a response to a very hostile post directed at me. Was I supposed to be the only one at LP to just turn the other cheek? Just as I was the only one not allowed to post the word KOOK?

Furthermore, to single me out and ignore countless other examples of folks disrupting the forum in other threads says, I think, something about the consistency of Goldi's management of the forum. Many of these other cases have been pointed out to her (not just by me) and she took no action. So perhaps my banning just shows that only HER "issues" matter at LP. LP'ers take note. But that's ok. She is the owner and can do what she wants.

And a final bit of irony. Note that the assertion being made in the thread by Goldi and others apparently turned out to be more hysteria and rumor, than actual fact. I'm not saying those in Washington aren't above trying to slip something by us, but in this case it appears her concerns were a little overblown. But that's ok. She is the owner and can do what she wants.

Goldi-Lox chose to ban me ... permanently ... and without a real warning ... but that is her right as forum owner. She can do what she wants. So here I am, on Freedom4um. The same is true of this forum's owners. Should they decide I'm no longer welcome, they can ban me and I will make no effort to return. And for the record I have not posted at FR since Jim tossed me nor have I posted (or will I) at LP (unless, of course, invited to do so by Goldi). But, I do intend to give this forum's owner no legitimate cause to cancel my access. More on that later.

First, I do feel that Goldi's pulling my comment #235 and labeling it UNCIVIL is a naked effort to hide the hypocrisy of her own actions. So here are the facts regarding that deleted post (and you know how I love facts).

How can Goldi find that comment uncivil, yet not consider calling someone a "POS" and an "SOB" uncivil? Does she not know what POS and SOB stand for? Or are they okay because they are abbreviations of foul language? And she must think that a death wish is civil, too. I hardly see the logic in that. But it's her forum.

Next, in response to samcgwire's statement "This might be my last night on LP", I wrote "Why? You folks own this forum. I'm one little voice. What do you fear?"

Again, does Goldi think that's being uncivil? There's no foul language. No labels. Just the simple truth. Folks like samcgwire do seem to dominate her forum. And I was just one little voice of rationality (IMO). What did she fear?

Finally, in response to what I perceive to be a highly uncivil death threat, "Chooser, you and everyone like you will hang before this is over", I wrote "This is the sort of person you are associating yourself with, Goldi."

I see nothing uncivil in that observation, either. And it was the truth. She was associating herself with that individual. Later, she even went out of her way in the thread to tell samcgwire to not quit the forum but just take some time off and come back. And samcgwire wasn't the only problematic individual she was chummy with in that thread. In my opinion.

So here was a thread with it's very important topic (and I do think stopping illegal immigration is important) and Goldi willingly associates herself and the topic with an extremist who utters death threats and foul language at the drop of a hat, and others who I had shown (on other threads Goldi was pinged to) have a propensity for lying. I warned her in two emails after my banning that such associations are not going to get her views about this issue any favorable response from anyone who matters. Nor is allowing liars to corrupt a forum going to do that. My emails to her said quite a bit about the topic of liars. She ignores what I said at the risk of her own forum's future. But then it is her forum and I'll say no more on that matter unless asked to do so by her. I'm not holding my breath.

Now, as to my presence on THIS forum, I'd going to try something different. I will not be calling anyone any names or labels (you know ... kook, liar, 5th Columnist, anti-American). No matter what you call me or uncivility you post to me. I won't bozo you (don't believe in that). I'm simply going to turn the other cheek. And we will see who comes out looking the worse in the long run.

I'm also not going to engage in long debates, taking apart posts line by line. But I will be posting linked sources that will allow any open minded visitor to FD4UM to see that a claim made by a poster or a claim made in an article is false. They can draw their own conclusion from that.

One last comment. I appreciate this forum's owners giving me the opportunity to join, despite our past differences. I sure this will be interesting.

Now let the games begin ...

Its confusing because the bill in question is from may 2005, for the secure and orderly whatever. And formerlurker has amendments for a house bill.

STicking on amendment to other chambers bills will result in conference committees because the bills must pass in exact matching form before presenting to the liar in chief.

There are a couple here that I dislike, but while I don't reply or post to them, I don't have them on bozo either. I choose not to respond, participate and separate myself from their nonsense.

I followed a couple of the long threads you were involved in. While I completely disagree with your position on the said topic, you should have never been banned, but its her site, and her rules.

I do believe this whole methamphetamine hullaballoo is over-rated. And I say this as a man who, today, has fifty yards of fence to replace.

It's rather odd. I live above a 'holler, and my neighborhood, such as it is, is composed of hardworking, God-fearing rednecks. The next hill over, is populated entirely by white trash meth-addicts.

Anyhow: What happened to me last night. Since we had a big blackout in January I've had myself hooked up to the local radio net.

Last night, my brother came over, but I kicked him out of the weight-room early: thouight he went home.

I was squat pressing about twenty minutes later, when the radio came on. Seems there'd been a car crash down the valley.

I and several neighbors converged on the scene almost simultaneously. Seems a van run off the road, crashed down a hill, through a barbed wire bull fence, into our hay field, and run along the fence for ten or fifty yards, before stalling in a ditch.

The driver and his wife were completely out of it. They looked like they were in their sixties, but you never can tell with these people.

The guy literally fell into my arms, which annoyed me no end. If my immediate neighbors hadn't been watching, I think a couple of backhands to the face would have brought him out of it, pretty quick.

He didn't know who he was, (I still don't, either) where he was, or where he lived.

His whole mouth looked rotten, and I've known bag ladies who dressed better than his wife.

About this time, the tenants who run cattle in that area showed up loaded for bear.

The guy was just aware enough to tell us where he lived on the next ridge, and evidently some of the other people knew him. He said he'd call a friend to pull him out of hte ditch. As he was doing so, the cattleman and son claimed they saw another guy running through the field and they took off after him. I left about this time, but my brother got there later, and stayed afterwards.

It seems the that this guy called a friend to pull him out, but the friend didn't trust him, so he called the state troopers in. There wasn't much they could do. My brother pulled out the van (which I had no intention of doing; the boy is soft in the head).

Anyway, got a whole line of fence to repair today. Haven't had to deal with tweakers like this for a long time. Guy down the road makes meth, (and allegedly child porn). Everytime I pass his place I see a lot of young girls around, for some reason...

Anyway that's my adventure for last night, written this morning, under hte influence of a hang-over. I still support ALL drug legatlization, btw. Even tho I'm going to tear up my hands this afternoon on the barbed wire... Posted 02/09/2007 09:02:32 am CST by continental op
