Jerell Thomas was convicted after the killing. The Washington state Court of Appeals yesterday overturned the conviction of Jerell Thomas, who killed 20-year-old Kristopher Kime in the 2001 Mardi Gras riot. The decision was not unexpected, but it does put pressure on the King County prosecutor to win a new conviction in a case that shocked the city. Thomas was found guilty in 2001 of second-degree felony murder in the death of Kime, who was punched three times in the head, according to testimony at his trial. Kime was blindsided because he was helping a woman who had also been victimized in the melee. Thomas, then 17, also was convicted of assault in connection with attacks on two other people that day. Thomas appealed his conviction on several grounds, one of which resulted in a clear victory for him. Thomas contended that his conviction of second-degree felony murder was invalid because the Washington state Supreme Court in 2002 threw out the law that covered that crime. In that case, known as the Andress decision, the Supreme Court ruled that an assault that leads to an unintended death cannot be called a murder. Instead, it's manslaughter, a crime that carries a lesser sentence. The court's reasoning went like this: In most murder cases, a prosecutor has to prove the defendant intended to kill. The exception is the felony-murder statute — under which Thomas was convicted — that covers deaths that occur while the defendant was committing another felony, such as rape or arson. In the Andress case, the court ruled that prosecutors could no longer use assault as the basis for a felony-murder conviction. That's because every homicide, by definition, includes an assault, the justices wrote. So if assault could be the basis for a murder conviction, every criminal case that results in death could be called a murder — something the Legislature did not intend. Prosecutors decried the ruling, which overturned years of precedent and cast doubt on hundreds of murder convictions. They have been examining each case as it's overturned, and depending on the facts, they have the option to refile charges (for example, manslaughter) enter into a plea bargain with the defendant or simply drop the case. Attempts to reach King County prosecutors last night to discuss how they might proceed in the Thomas case were unsuccessful. Yesterday's decision did not come as a surprise to Kime's mother, who said prosecutors spoke with the family about the impact of the Andress decision some time ago. "They asked if they wanted to do plea bargain, how would we feel about it," Kim Kime-Parks explained. "We said absolutely not. He needs to serve time. And he will, we're sure of that. If we have to go through another trial, we will do that." Because Thomas' assault convictions still stand, Kime-Parks says he will remain incarcerated while he awaits new charges.

In American courts, when it comes down to black and white, the white will lose. There is no justice in the legal system for whites in this country.

If you defend yourself or a lady or some fellow White person as in the pizza parlor beating you would be guilty of a "hate crime" and face much woe.
I guess that's why we usually just call the PizzaHut delivery guy and dine in, on the nights when I'm not out burning something on the grill. What an effing mess our country has become.

In adopting the quaint custom of Mardi Gras (long a tradition in New Orleans), it sure is swell to see that Washington hasn't done it by halves--they've managed to get the whole package. Situations like this are common during the mob scenes in the French Quarter during New Orleans' street parties. They are not always deadly--but they almost always will cure anyone of false sympathy for "the downtrodden blacks".

Blacks murder, rape, rob, attack--LYNCH--whites on a routine daily basis throughout all cities in America. The local news has the nightly reports but as far as the federal media is concerned, it isn't happening. HOWEVER, in the rare case of a white on black attack--its Prime Time Live 24/7. The perfect example (among the thousands) was the James Byrd incident versus the Carr brothers in Wichita Massacre. In the federal media, the latter was simply ignored.
Sad to watch our descent into madness. I just finished spending 2 weeks in jail. Hadn't been in one for 15 years ... not much has changed except the jailors are a lower form of life than the inmates ... Being an anti-government activist tends to offend the mental midget jailors. It seemed to me that the jailors were far more unhappy than the inmates, and must take some type of asshole pill each shift.
I've heard that one before. I believe it, too.

Now I bet you didn't hear of the little White boy dragged to his death by a black who carjacked the boy's mother car and threw her out the car then dragged the boy to his death, the boy's body came apart. That was 2 months or so after Byrd--did you see it in the MSM?
I never heard those about those awful crimes. It's all evil, but clearly not evenly reported. Like the crimes committed by homosexuals that have much received less media attention than crimes against homosexuals.
That is where one can see the MSM has an agenda
Obviously.. not just in this instance but it is apparent when reading reports of the same incident in the foreign press and in the US MSM.. either its different in that portions are omitted OR it's unreported..
I think the matter goes deeper than that. There is pure evil loose in the world.

Then a mature White woman in Ohio, dragged behind a vehicle by a carload of blacks for miles, again to her death, again pieces of her body scattered all over the road. Did you see that on Jennings or Rather or Brokaw or Wolfie Blitzer et al?
Those are just stories I came across on my own, how many more have happened that I don't know about??
Another one off the top of my head:
What about Kevin Shifflet in Virginia? Playing in his grandma's front yard in the early afternoon, when a black came up and STABBED the 12 year old White boy to death, for nothing, the black stabbed an aunt and the grandma as they came to the boy's rescue.
