US Officials To File Terror Charges Against Hicks

American defence officials say a military judge is to file terror charges against an Australian held without trial at Guantanamo Bay for five years.

They say David Hicks is to be charged with providing material support for terrorism.

The decision comes despite Australian officials asking the United States not to bring such charges.

David Hicks was captured in Afghanistan, where the US alleges he fought alongside Taleban forces.

Hicks was one of the Guantanamo prisoners who were petitioners in the Supreme Court case Rasul. Hicks is even mentioned in Justice Stevens's opinion for the court. As Stevens's Footnote 5 indicates, the U.S. authorities long did not allow any lawyer to have contact with Hicks.

Hicks and the other prisoners won their case in Rasul.
