Appeals court overturns D.C. gun ban 6 minutes ago

The District of Columbia's long-standing ban on handguns was overturned Friday by a federal appeals court, which rejected the city's argument that the Second Amendment right to bear arms applies only to militias, not individuals.

In a 2-1 decision, the judges held that the activities protected by the Second Amendment "are not limited to militia service, nor is an individual's enjoyment of the right contingent upon his or her continued intermittent enrollment in the militia."

A lower-court judge told six city residents in 2004 that they did not have a constitutional right to own handguns. The plaintiffs include residents of high-crime neighborhoods who want guns for protection.

The Bush administration has endorsed individual gun-ownership rights but the Supreme Court has never settled the issue. If the dispute makes it to the high court, it would be the first case in nearly 70 years to address the Second Amendment's scope.

If the case makes it to the SCOTUS, then it will have an impact on all cities that ban gun possession.

My prediction, if the SCOTUS rules for gun rights: the licensing regulations are going to be so complicated and the fees are going to so exorbitant, not much will change.

If you don't own a gun(s) now, you're an idiot. The first ruling in 70 years.

Bonus: The U.S. Court of Appeals for the District of Columbia Circuit also threw out the district’s requirement that registered firearms be kept unloaded, disassembled and under trigger lock.

Caveat: Highly likely another Zion orchestrated school shootout in the works. (Oy, The Harris/Klebold Law.)

.... lower courts in conflict. This would seem to be headed for the supremes and believe me, EITHER way they decide it's going to be BIG!!!

Which is exactly why they have been avoiding the issue for the last 70 years. Having just reread US vs Miller again I continue to be shocked at how far our nation had fallen in just 150 years since its inception as evidenced by the lack of respect for the unalienable Rights referenced in Declaration of Independence and the Constitution.
