New Jersey lawmaker wants buildings, cars taken if firearms not permitted

Posted: May 10, 2005

A New Jersey state assemblyman has introduced a bill that would allow the government to seize the home or car of anyone whose property contains an illegal firearm.

The legislation, sponsored by Assemblyman Louis Manzo, D-Jersey City, authorizes the forfeiture of "motor vehicle, building or premise" if a firearm is found in it that is not possessed legally per state law – "even if the firearm was not possessed by the owner of the motor vehicle, building or premise," states a summary of the bill, A3998. The legislation was introduced Thursday.

Manzo pointed out his bill extends government power now reserved for targeting those in possession of illegal drugs.

"If we will do this when someone is caught with illegal drugs, it only makes sense that we should do it for when someone has an illegal weapon," Manzo told the Hudson Reporter.

"We currently allow this to take place when illegal drugs are found. This is to keep a landlord or someone driving the car from turning a blind eye to the drugs people in an apartment or passenger in the car is doing," he said. "I think if a landlord knows there is an illegal gun in the house, he or she should do something about it. And this may encourage someone driving a car to keep a person from carrying a gun."

Under the proposed law, an unlicensed machine gun, handgun, rifle or shotgun are considered illegal.

Larry Pratt, executive director of Gun Owners of America, slammed the proposal.

Lovely, no potential for abuse there.

.. a rifle or shotgun? No doubt there are plenty of homes that have rifles and shotguns given to them by their fathers or grandfathers who hunted.. and haven't been used in years.. and not licensed.. so those people are at risk of losing their HOMES?? I'll bet most drug dealers rent and their landlords have NO idea that there are guns in their apartments..there may be hundreds of apartments in a complex, so those people could lose their apartment buildings?

There is already plenty of abuse.

About 18 years ago I began working for a small startup company that had just moved into a new building in Carlsbad, CA. The nearby local airport had been of use to the previous building tenants; they were drug dealers.

Everything in this building had missing parts. Even the peep-hole into the conference room had been removed. When winter came, it was discovered that the heating system had all kinds of missing parts.

The federal agents take whatever they feel like taking in a drug bust, apparently.

Guess what christine. From what I know of the citizens of NJ, they won't raise as much as a peep when the door to their house get kicked in. So, that said, I actually don't blame government in this case. It's doing what it does. The NJ sheeple, otoh, are ultimately responsible for this intrusion. So be it, I’ve done my best to raise the alarm. It’s fallen on deaf ears and frankly, I no longer care much what hapens to them or other gutless Americans :)

No Gov't Firearms Permitted!"

New Jersey, historically, has been one of the most anti-gun states. The saying, "When guns are outlawed, ......", is never more true than in N.J..

Boycott N.J. Don't buy anything made in N.J.

I sick to death of Government trying to morph innocent people into law enforcement officers.

There's laws against this sort of thing, aren't there, Mr. Manzo?

If you're so damned concerned about this gun crisis, then it seems logical that you would just enforce the laws already on the books.

Of course, if you did.. then you'd have no way of getting other peoples property for free, now would you?

And it probably falls on deaf ears.

Most people are like animals who were raised (for slaughter) in captivity and don't know the meaning of freedom.
