Dead Constitution See other Dead Constitution Articles Title: The Sentencing of Matt Hale Another Gross Injustice in a Tyrannical State Well, it's no surprise that Matt Hale received the maximum sentence of 40 years. The sentencing hearing was a farce in the first degree. Judge Moody knew going in that with the added label of domestic terrorist he could give Matt 40 years instead of 12. Judge Moody in his little speech as the proceedings began, even used the figure 40 years as being the max but then later on when Matt suggested that he had already made up his mind as to sentencing, Moody, unconvincingly uttered, "Oh, no, no, I haven't." Yeah, that's why during the little over two hours that Matt spoke, the judge watched the clock and appeared to be falling asleep. The whole morning was theatrics at his finest. Every FBI agent in the Chicago area was in the courtroom. Rows and rows of them, several surrounding Matt as he spoke. You had seasoned, gray-haired agents, down to rookies looking to climb the kosher ladder, they were all there. Our local media weren't as brutal as I expected. Some called Matt's speech impassioned; others said it was a tirade. All I know is we were very proud of him, he told the world how the FBI lied and set him up. He turned and pointed at the stuttering prosecutor Weisman and called him a shameful liar. One of the news stations reported that Matt made some very good points during his speech and the judge listened intently. Of course the judge did not listen intently. I would like to get Judge Moody in a poker game sometime; he has quite a story to tell. When Matt pointed out certain errors the judge had made, he developed this very visible twitching from his right cheek down to his chin. Matt told him how he instructed Weisman he was not to bring up Ben Smith in closing, Weisman defied the court and Judge Moody sat there and did nothing. Matt told Judge Moody he could not add on the terrorist enhancement because nowhere was that written in any government filings or was that brought out at trial that he was a terrorist. Again, Moody twitched up a storm. Matt pointed to different FBI agents, named them by name and told the world what they did to convict him, such as threatening Jon Fox with taking away his kids, he pointed to the hispanic female agent who made the threat to Fox. He pointed to agents that took one of his members in handcuffs from Central Illinois to Chicago and threatened him and told him what to testify at trial. This young man has put that in an affidavit that he was threatened. Matt pointed out how the "jew rat" all of a sudden two e-mails later became "female jew rat", and he suggested that Tony Evola screwed up and the FBI told him to use the word "female." Matt said jew rat has always been the jew attorney in the trademark case. Matt said besides, nobody ever refers to females as rats. Well, I don't know, the JDL has called me worse. Matt pointed to the fact that there was no American flag in the courtroom. He quoted from the Star Spangled Banner. He talked about loving his country and being a patriot and how he was taught by his police sergeant father to respect the badge. Matt talked about his life in jail the last two plus years and what a hell it's been. We just found out yesterday that because Matt's mother violated the SAM's by relaying a message from Matt to the press, they are cutoff from him for one year. Prior to sentencing Matt filed a motion asking to remain in Chicago for six months to finish working on his appeal and then he asked that the remainder of his sentence be served in Pekin, Illinois, a 20 minute ride from his parents. Those motions were granted this morning so we are relieved that he will not be going to Florence, CO. So if and when this year suspension is challenged and defeated, at least his parents will have him close by and that made a huge difference for them. Matt's mother cried through most of the two hour speech and his father was visibly nervous. I feel that it didn't matter if it was four years or 40 years, it was still on to the appeal process. I personally am not angry at the sentence, I expected it, I'm angry that he even had to be in a position to be sentenced, that flimsy, cheap-ass evidence that convicted him and he gets 40 years, all because of a terrorist enhancement. I am furious with the Chicago press, they are 90% responsible for his conviction, they tried and convicted him and tainted the jury. I am angry at his attorney Durkin who should have fought a change of venue all the way to the Supreme Court. I hounded them endlessly to fight that change of venue but one denied motion and they moved on. I pleaded with Durkin to object, to something to get the Ben Smith angle out of the trial; it's the single most important factor in that conviction. I told Durkin to put an FBI agent on the witness stand and ask him if it were not true that Matt Hale was exonerated of any wrongdoing in 1999. Durkin didn't do it, Ben Smith dominated the trial and they got their conviction. You can all imagine the media circus that went on. Calls from Greta Van Susterin again, etc., all looking to do that tabloid bit on it. The media literally chased us for over a mile. We had cameramen running backwards in order to get the cameras on us, some of them pushing microphones and cameras right up to your nose and mouth. They are shameless media whores. They almost knocked Matt's father down to get around him to put the camera on him. I had to finally push one cameraman away and he fell into another cameraman. They wouldn't take no for an answer, they followed us all the way to the parking garage. When we finally stopped and decided to give them a statement, they didn't show anywhere near what we said to them, so as usual scripted and censored. Free press? Not even close. At least Matt got his day in court; he got to say all the things he's had a chance to think about for over two years. He looked his enemies right in the face and called them liars as they hung their heads, refusing to look at him. I was not allowed to bring a tape recorder into the courtroom so I am sorry I cannot share his speech with you. I was not allowed to bring a Stenograph machine into the courtroom to record the proceedings so it is a travesty that Matt's speech is not memorialized. Thank you all for continuing to support Matt and it's on to the appeal. If and when the "SAM" comes off, I will certainly let everybody know so you can go to Pekin to visit him.

Wasn't the "suicide" suspect of Lefkow killings a Jew? Had ear marks of the "Russian mob" style hit...
