WASHINGTON: Plagued by high homicide rates, city officials in the U.S. capital said Monday they will petition the Supreme Court as they seek to defend Washington's 30-year-old ban on most handguns.

A federal appeals court panel struck down the law in March, rejecting the city's argument that the Second Amendment of the U.S. Constitution, which upholds people's right to bear arms, applied only to militias. The full appeals court refused to reconsider the decision in May. The law has remained in effect during the appeals process.

"We have made the determination that this law can and should be defended," Mayor Adrian M. Fenty said in a statement Monday.

Washington's gun law dates back to 1976, and bars residents from keeping handguns in their homes and carrying a gun without a license. Registered firearms must be kept unloaded and disassembled. The city's sweeping gun ban is matched only by Chicago among large U.S. cities.

If the high court takes up the case, it would mark the first time in 70 years that justices will consider the breadth of the Second Amendment. In 2003, the court chose not to take a case that challenged California's ban on assault weapons.

The high court will have to grant certiorari in this case because they cannot allow subjects in the District of Criminals to have a lawful right to own or carry shooting irons.

I say this because as the court well knows and as former NAACP prez Kweisi Mfume said "Blacks cannot responsibly own firearms."

And, politicians won't want to walk about in the district without a gun ban to "protect them". Despite the fact that such laws do nothing to deter crims and in fact increase violent crime because crims know that law abiding peeps are unarmed, we'll see once again that politicians feel safer with such laws in place.

It's a religious belief, you see.

Just as Trent Lott and Denny Hastert threatened the senators and congressmen who were reluctant to sign the Patriot Act by saying, "If you don't sign then the next bomb that explodes will be on you!" so will the high court and/or the congress tell members who wish to kill the ban that if they vote to do so the next gun murder will be on them, and that will chill them nicely and the ban will stand.

Be prepared for the high court to kill the 2nd amendment by ruling that it guarantees the national guard's right to hunt ducks, or something equally silly.

If the NRA brought this suit then they're assholes.

Why would anyone choose the mostly black district to make a stand? Who cares if those assholes are barred from firearms ownership? They ignore the law and the gun charges are the first to be plea bargained away (assuming they catch the perps, which they never do) so the law is de facto dead in the district and the end result will be that the NRA or whoever ended up forcing the court to hear the matter and to rule on the rights of the most violence prone and fearsome criminals in America. (No, the feds will not issue carry permits or honor state permits for law abiding folks so there will be no net gain if the ban falls)

In fact the NRA is the last bunch who wants the issue resolved in our favor because that would put their well heeled lobbyists and their revenue generating association out of bizness.

So, perhaps they're hoping for a complicated ruling that will re-energize their members and force them to open their checkbooks to "Win the battle for our freedoms once and for all!"

I've predicted that Bush will sign the most sweeping gun ban in our history before he leaves office as payback for the loss of his support base.

As candidate Bush he promised to renew the AWB but he wasn't going to do that before the last election. But before he leaves he'll remind us all of his promise, and the majority of Pubs who voted for it the first time will introduce the new law and vote for it, with unanimous support from the DEMS. (to keep the turrists from rising up and making war against us here)

And the SCOTUS majority won't make any rulings that pre-empt this power grab.

And then everyone will know that the republic is dead.
