First, to all of those who came to the assistance of Bill Benson and me, a truly heartfelt thank you. Because of your spirit and generousity, the fight continues for another month or so.
We have added three people to the law suit who have filed motions to intervene; they are John Doe I, John Doe II and Jane Roe. John Doe I, who files tax returns and pay taxes, petitioned the IRS for redress of grievance. John Doe II read Bill's material but never used any of it. Jane Roe wants to read Benson's material, but can't because of the government's attempt to penalize Bill for making it available.
In addition to the motion to intervene, Bill and the interveners have filed a joint motion for a protective order to prevent the government from deposing Bill and compelling him to turn over the names of those who received his material. The government responded to Bill's exercise of his 5th Amendment right not to provide the names with immunity. We have countered with the First Amendment.
The hearing on the motions is scheduled for July 10, 2007. I am attaching copies of the motions and points and authorities, as many of you have asked to be kept informed of developments and the pleadings filed.
FYI, the government has just unsealed an indictment wherein they allege obtaining Bill's material constitutes an overt act of income tax evasion. A copy is attached for your information. This precedent setting allegation is both extremely dangerous to the American people, but also opens the door to modify the Cheek decision. Just as in Bill's case that allowed him to fully brief the 16th Amendment issue, they have opened the door in the criminal context to do the same thing.
Mr. Hughes is currently represented by a public defender. I am precluded from representing him because I represent Bill, who could be called as a witness. I have a call into the public defender to discuss the importance of the case. Obviously the pleadings and documents filed in Bill's case can be modified with little effort to be used in the criminal case. Please pray that the public defender has an open mind and the heart of a lion.
