U.S. border cop charged with murdering Mexican

Tue Aug 7, 2007 7:34AM EDT

BISBEE, Arizona (Reuters) - A U.S. Border Patrol agent must stand trial for murder in the shooting of a Mexican man trying to enter the United States, an Arizona judge ruled Monday in a case that drew criticism from Mexico.

Agent Nicholas Corbett was charged in April with four counts of homicide in the January 12 shooting of Francisco Dominguez Rivera shortly after he crossed the border illegally on a stretch of desert between Douglas and Naco.

Cochise County Justice of the Peace David Morales ruled the evidence supported lesser charges of second-degree murder, but threw out charges of first-degree murder, which supposes premeditation.

The ruling followed a preliminary hearing that heard evidence from three illegal immigrants present at the shooting, a pathologist, county sheriff's detectives and two Border Patrol supervisors.

No date was set for Corbett's arraignment.

Following the killing, Mexico's Foreign Ministry complained of "disproportionate violence" and instructed the Mexican Embassy in Washington to investigate the circumstances.

Last year, border police captured 1.1 million undocumented immigrants crossing over the border from Mexico and recorded a soaring number of attacks on agents.

Lawyers for Corbett argue he shot Dominguez Rivera in self-defense after he was threatened with a rock.

I am amazed how easy people kill, and also how they earn support for killing someone. I agree he is an illegal and they should not come in. If they do i would put my anger towards the goverment. I have in my mighty goverment arsenal many weapons that will knock you out good but NOT kill you. I know they look dirty don't know the language and so on and so on but they still have a mom or a child somewhere...... and however whatever they are it is not an excuse for you becoming a civilized "animal"

You have no idea what it entails, to guard a border. You don't give a soldier or agent a gun, and tell them not to use it. What exactly are these agents supposed to do?

Actually i know it first hand. In Greece there is military draft. As i soldier i we had to control the border to albania. And shooting was only permited if a gun was there. We were not to shoot if we would get attacked with knife if there were more than 2 of us present. And again........ first legs and hands.

The point others made was that you have to be trained to shoot to kill in these instances. Otherwise you are a crap soldier.

Opa!

Percy, a crap soldier is the one who shoots blindly. The one that see's in his complex cyborg training no other way to stop a half size mexican with a stone other than killing him.

Lost, you seem to be a person who plays Monday morning quarterback. I do hear your sadness around human death, but the logic you are using is not good.

Percy, personally i do not give a crap if someone dies. This does not mean i don't know what is right or wrong. I am replying from a logic point of view. The logical view and the humane view is my point.

So you don't care if someone lives or dies, but soldiers should second guess their targets?

Look, here's a really simple example: where I grew up, there was a government piece of land by me. As a kid, I really wanted to snoop around there, and get inside. But in doing so, I knew I would get a butt full of lead. So I didn't do it.

If there is a border, and military or police there, you get shot. It's really that simple.
